Nakon objave članka o zatvaranju kultnog splitskog kluba "Zanat", koji je navodno ispražnjen zbog previsokog najma od gotovo 12 tisuća eura koji je odredio Grad kao vlasnik prostora, javili su nam se iz ureda v.d. pročelnika Upravnog odjela za gradsku imovinu Nikše Maletića dopisom u kojem stoji kako je Ugovor o zakupu poslovnog prostora sklopljen između Grada Splita kao zakupodavca, i Udruge Zanatlija kao zakupca, istekao 26. veljače 2022. godine za prostor u Krešimirovoj 7, površine 158 metara kvadratnih.

- Novi ugovor o zakupu na određeno vrijeme na rok od pet godina pod istim uvjetima nije se mogao sklopiti budući je Udruga Zanatlija imala prema Gradu Splitu nepodmireno dugovanje u iznosu od 8.116 eura.

Odredbom Zakona o zakupu i kupoprodaji poslovnog prostora propisano je da jedinica lokalne samouprave kao zakupodavac može dati pisanu ponudu za sklapanje novog ugovora o zakupu na određeno vrijeme na rok od pet godina pod istim uvjetima kao u postojećem ugovoru o zakupu kada je to ekonomski opravdano, odnosno kada je mjesečni iznos zakupnine veći od cijene zakupnine po odluci jedinice lokalne samouprave za djelatnost koju zakupnik obavlja isključivo zakupniku koji s jedinicom lokalne samouprave ima sklopljen ugovor o zakupu na temelju javnog natječaja i koji u potpunosti ispunjava obveze iz ugovora o zakupu, kada mu istječe takav ugovor o zakupu sklopljen na temelju javnog natječaja, a na njegov pisani zahtjev.

Nadalje, istim zakonom propisano je da ugovor o zakupu poslovnog prostora sklopljen na određeno vrijeme prestaje istekom vremena na koje je sklopljen.

Ugovor o zakupu poslovnog prostora sklopljen na određeno vrijeme ne može se nakon proteka vremena važenja ugovora prešutno obnoviti, budući da mora biti sklopljen u pisanom obliku i potvrđen po javnom bilježniku jer je u protivnom ništavan – objašnjavaju u Upravnom odjelu.

- Udruga Zanatlija pozvana je u više navrata da podmiri dugovanje prema Gradu Splitu i da mirnim putem vrati predmetni prostor slobodan od osoba i stvari.

Posljednji poziv upućen je Udruzi Zanatlija u siječnju 2023. godine. S obzirom da prostor nije vraćen, Udruga Zanatlija je u travnju 2023. godine zadužena za naknadu za bespravno korištenje u visini od 60 eura po kvadratu poslovnog prostora sukladno Zaključku o utvrđivanju visine naknade za korištenje bez valjanog pravnog osnova poslovnih prostora u vlasništvu, suvlasništvu ili pod upravljanjem Grada Splita.

Na iznos naknade obračunat je i pripadajući iznos PDV-a. Na dan 22. siječnja 2024. godine Udruga Zanatlija dužna je Gradu Splitu iznos od 134.097 eura – navode iz Banovine.

Dakle, stanje duga Udruge zanatlija prema Gradu Splitu je 28. veljače 2022. godine iznosilo 8.116 eura s PDV-om, a 22. siječnja 2024. godine 134.097 eura s PDV-om.

Nakon objave članka o zatvaranju kultnog splitskog kluba "Zanat", koji je navodno ispražnjen zbog previsokog najma od gotovo 12 tisuća eura koji je odredio Grad kao vlasnik prostora, javili su nam se iz ureda v.d. pročelnika Upravnog odjela za gradsku imovinu Nikše Maletića dopisom u kojem stoji kako je Ugovor o zakupu poslovnog prostora sklopljen između Grada Splita kao zakupodavca, i Udruge Zanatlija kao zakupca, istekao 26. veljače 2022. godine za prostor u Krešimirovoj 7, površine 158 metara kvadratnih.

- Novi ugovor o zakupu na određeno vrijeme na rok od pet godina pod istim uvjetima nije se mogao sklopiti budući je Udruga Zanatlija imala prema Gradu Splitu nepodmireno dugovanje u iznosu od 8.116 eura.

Odredbom Zakona o zakupu i kupoprodaji poslovnog prostora propisano je da jedinica lokalne samouprave kao zakupodavac može dati pisanu ponudu za sklapanje novog ugovora o zakupu na određeno vrijeme na rok od pet godina pod istim uvjetima kao u postojećem ugovoru o zakupu kada je to ekonomski opravdano, odnosno kada je mjesečni iznos zakupnine veći od cijene zakupnine po odluci jedinice lokalne samouprave za djelatnost koju zakupnik obavlja isključivo zakupniku koji s jedinicom lokalne samouprave ima sklopljen ugovor o zakupu na temelju javnog natječaja i koji u potpunosti ispunjava obveze iz ugovora o zakupu, kada mu istječe takav ugovor o zakupu sklopljen na temelju javnog natječaja, a na njegov pisani zahtjev.

Nadalje, istim zakonom propisano je da ugovor o zakupu poslovnog prostora sklopljen na određeno vrijeme prestaje istekom vremena na koje je sklopljen.

Ugovor o zakupu poslovnog prostora sklopljen na određeno vrijeme ne može se nakon proteka vremena važenja ugovora prešutno obnoviti, budući da mora biti sklopljen u pisanom obliku i potvrđen po javnom bilježniku jer je u protivnom ništavan – objašnjavaju u Upravnom odjelu.

- Udruga Zanatlija pozvana je u više navrata da podmiri dugovanje prema Gradu Splitu i da mirnim putem vrati predmetni prostor slobodan od osoba i stvari.

Posljednji poziv upućen je Udruzi Zanatlija u siječnju 2023. godine. S obzirom da prostor nije vraćen, Udruga Zanatlija je u travnju 2023. godine zadužena za naknadu za bespravno korištenje u visini od 60 eura po kvadratu poslovnog prostora sukladno Zaključku o utvrđivanju visine naknade za korištenje bez valjanog pravnog osnova poslovnih prostora u vlasništvu, suvlasništvu ili pod upravljanjem Grada Splita.

Na iznos naknade obračunat je i pripadajući iznos PDV-a. Na dan 22. siječnja 2024. godine Udruga Zanatlija dužna je Gradu Splitu iznos od 134.097 eura – navode iz Banovine.

Dakle, stanje duga Udruge zanatlija prema Gradu Splitu je 28. veljače 2022. godine iznosilo 8.116 eura s PDV-om, a 22. siječnja 2024. godine 134.097 eura s PDV-om.
