Zbog liječničke greške, Specijalna bolnica za ortopediju u Biogradu mora pacijentici iz Zadra isplatiti pretrpljenu nematerijalnu štetu s osnova tuđe njege i pomoći u iznosu od 7.655,00 kn sa zakonskom zateznom kamatom, kao i troškove sudskog postupka od 32.226,50 kuna.

Utvrđeno je to u ponovljenom postupku na Općinskom sudu u Zadru, iako je prilikom podnošenja tužbe 12. lipnja 2015. pacijentica najprije zatražila 350 tisuća kuna radi naknade štete za koju tvrdi da joj je nastala propustom djelatnika u liječenju njezine ozljede. Medicinsko vještačenje Medicinskog fakulteta Sveučilišta u Zagrebu potvrdilo je liječničku grešku u tretiranju koštano zglobne traume ruke, no na sudu je utvrđeno da pacijentica nije imala dokaza kojima bi opravdala iznos koji je tražila. U prvom postupku joj je dosuđeno 26.700 kuna, no Županijski sud u Zadru naložio je ponavljanje postupka kako bi se utvrdilo koliko je dana pacijentici bila potrebna tuđa pomoć i njega, te da je u tom dijelu potrebno dopuniti vještačenje.

U ponovljenom postupku medicinski vještak je u svom nalazu naveo da je sveukupno liječenje ozljede pacijentice trajalo od 5. veljače 2012. do 13. svibnja 2015., te da se zbog utvrđene liječničke greške liječenje produljilo za 12 mjeseci. Utvrdio je da je u tom razdoblju pacijentici bila potrebna tuđa njega i pomoć jedan sat dnevno, odnosno ukupno 365 sati, što se odnosilo na pomoć pri aktivnostima koje zahtijevaju uporabu obje ruke poput pranja kose, kao i aktivnostima koje zahtijevaju jaču tjelesnu silu poput nošenja tereta, te podizanja predmeta s obzirom da je lijeva ruka pacijentice bila u pogibnoj konturi, slabije snage, te se nije mogla potpuno ispružiti, zbog čega nije određene radnje mogla izvršiti bez pomoći druge osobe.

Zglobna trauma

Pacijentica je pak osporila kompetencije vještaka koji je izradio dopunu, ističući da on kao dječji kirurg nije kompetentan za koštano zglobnu traumu i ortopediju. Međutim, budući da je na ročištu održanom 4. veljače 2021. izričito navela da ne prigovara nalazu i mišljenju vještaka u dijelu u kojem je dao izračun tuđe njege i pomoći koja je bila potrebna, već da podnesak od 2. prosinca 2020. predstavlja samo općenit osvrt na dosadašnji tijek postupka, ovaj sud nije pozivao vještaka na dodatno očitovanje, već je zaključio s raspravljanjem u ovoj pravnoj stvari.

- Iz nalaza vještaka doc. dr. sc. Roberta Karla, prim. dr. med. stalnog sudskog vještaka za kirurgiju, hitnu medicinu i traumatologiju, proizlazi da se zbog utvrđene liječničke greške liječenje tužiteljice produljilo za 12 mjeseci, u kojem razdoblju joj je bila potrebna tuđa njega i pomoć jedan sat dnevno, odnosno ukupno 365 sati. Budući da je vještak svoj nalaz temeljio na medicinskoj dokumentaciji te je isti detaljno i logički obrazložio, a na koji nalaz na kraju niti stranke nisu imale prigovora, to je ovaj sud nalaz u cijelosti prihvatio i na njemu temeljio svoju odluku. Slijedom navedenog, ovaj sud je našao da tužiteljici za ukupno 365 sati tuđe njege i pomoći koja joj je bila potrebna u razdoblju od svibnja 2014. do svibnja 2015., odnosno posljednju godinu liječenja za koliko se isto produžilo zbog greške djelatnika tužene, pripada pravična naknada u iznosu od 7.655,00 kn, a do koje se došlo na način da je jedan sat tuđe pomoći i njege, primjenom odredbe čl. 223. ZPP vrednovano u iznosu od 21,00 kn, uzimajući pri tome u obzir satnicu najniže plaćene kategorije NKV radnika prema općepoznatim podacima Državnog zavoda za statistiku u 2014. i 2015. godini - navodi se u obrazloženju presude sutkinje Općinskog suda u Zadru Katje Morić Arambašić.

Zbog liječničke greške, Specijalna bolnica za ortopediju u Biogradu mora pacijentici iz Zadra isplatiti pretrpljenu nematerijalnu štetu s osnova tuđe njege i pomoći u iznosu od 7.655,00 kn sa zakonskom zateznom kamatom, kao i troškove sudskog postupka od 32.226,50 kuna.

Utvrđeno je to u ponovljenom postupku na Općinskom sudu u Zadru, iako je prilikom podnošenja tužbe 12. lipnja 2015. pacijentica najprije zatražila 350 tisuća kuna radi naknade štete za koju tvrdi da joj je nastala propustom djelatnika u liječenju njezine ozljede. Medicinsko vještačenje Medicinskog fakulteta Sveučilišta u Zagrebu potvrdilo je liječničku grešku u tretiranju koštano zglobne traume ruke, no na sudu je utvrđeno da pacijentica nije imala dokaza kojima bi opravdala iznos koji je tražila. U prvom postupku joj je dosuđeno 26.700 kuna, no Županijski sud u Zadru naložio je ponavljanje postupka kako bi se utvrdilo koliko je dana pacijentici bila potrebna tuđa pomoć i njega, te da je u tom dijelu potrebno dopuniti vještačenje.

U ponovljenom postupku medicinski vještak je u svom nalazu naveo da je sveukupno liječenje ozljede pacijentice trajalo od 5. veljače 2012. do 13. svibnja 2015., te da se zbog utvrđene liječničke greške liječenje produljilo za 12 mjeseci. Utvrdio je da je u tom razdoblju pacijentici bila potrebna tuđa njega i pomoć jedan sat dnevno, odnosno ukupno 365 sati, što se odnosilo na pomoć pri aktivnostima koje zahtijevaju uporabu obje ruke poput pranja kose, kao i aktivnostima koje zahtijevaju jaču tjelesnu silu poput nošenja tereta, te podizanja predmeta s obzirom da je lijeva ruka pacijentice bila u pogibnoj konturi, slabije snage, te se nije mogla potpuno ispružiti, zbog čega nije određene radnje mogla izvršiti bez pomoći druge osobe.

Zglobna trauma

Pacijentica je pak osporila kompetencije vještaka koji je izradio dopunu, ističući da on kao dječji kirurg nije kompetentan za koštano zglobnu traumu i ortopediju. Međutim, budući da je na ročištu održanom 4. veljače 2021. izričito navela da ne prigovara nalazu i mišljenju vještaka u dijelu u kojem je dao izračun tuđe njege i pomoći koja je bila potrebna, već da podnesak od 2. prosinca 2020. predstavlja samo općenit osvrt na dosadašnji tijek postupka, ovaj sud nije pozivao vještaka na dodatno očitovanje, već je zaključio s raspravljanjem u ovoj pravnoj stvari.

- Iz nalaza vještaka doc. dr. sc. Roberta Karla, prim. dr. med. stalnog sudskog vještaka za kirurgiju, hitnu medicinu i traumatologiju, proizlazi da se zbog utvrđene liječničke greške liječenje tužiteljice produljilo za 12 mjeseci, u kojem razdoblju joj je bila potrebna tuđa njega i pomoć jedan sat dnevno, odnosno ukupno 365 sati. Budući da je vještak svoj nalaz temeljio na medicinskoj dokumentaciji te je isti detaljno i logički obrazložio, a na koji nalaz na kraju niti stranke nisu imale prigovora, to je ovaj sud nalaz u cijelosti prihvatio i na njemu temeljio svoju odluku. Slijedom navedenog, ovaj sud je našao da tužiteljici za ukupno 365 sati tuđe njege i pomoći koja joj je bila potrebna u razdoblju od svibnja 2014. do svibnja 2015., odnosno posljednju godinu liječenja za koliko se isto produžilo zbog greške djelatnika tužene, pripada pravična naknada u iznosu od 7.655,00 kn, a do koje se došlo na način da je jedan sat tuđe pomoći i njege, primjenom odredbe čl. 223. ZPP vrednovano u iznosu od 21,00 kn, uzimajući pri tome u obzir satnicu najniže plaćene kategorije NKV radnika prema općepoznatim podacima Državnog zavoda za statistiku u 2014. i 2015. godini - navodi se u obrazloženju presude sutkinje Općinskog suda u Zadru Katje Morić Arambašić.

Zbog liječničke greške, Specijalna bolnica za ortopediju u Biogradu mora pacijentici iz Zadra isplatiti pretrpljenu nematerijalnu štetu s osnova tuđe njege i pomoći u iznosu od 7.655,00 kn sa zakonskom zateznom kamatom, kao i troškove sudskog postupka od 32.226,50 kuna.

Utvrđeno je to u ponovljenom postupku na Općinskom sudu u Zadru, iako je prilikom podnošenja tužbe 12. lipnja 2015. pacijentica najprije zatražila 350 tisuća kuna radi naknade štete za koju tvrdi da joj je nastala propustom djelatnika u liječenju njezine ozljede. Medicinsko vještačenje Medicinskog fakulteta Sveučilišta u Zagrebu potvrdilo je liječničku grešku u tretiranju koštano zglobne traume ruke, no na sudu je utvrđeno da pacijentica nije imala dokaza kojima bi opravdala iznos koji je...
