U naselju Zatoglav, smještenom istočno od Rogoznice, koje je izgubilo svaki trag izvornog mjesta, izgleda da je dozvoljeno uzurpirati priobalnu šetnicu, ali i samo more, a da se "graditelju" ništa neće dogoditi.

Slovenska, odnosno mariborska obitelj Zadravec stoji iza zagrebačke tvrtke na koju je uknjiženo vlasništvo nad zemljištem, površine 1000 četvornih metara, na kojem su izgrađeni zidovi cijelom dužinom obiju bočnih "međa" terena, i to sve do plavog Jadrana, a kraj suhozida nalazi se doslovno u moru.

Na nekretnini su postavljene brojne drvene nastrešnice, staze i platoi, tu su i neizostavne ležaljke i stolovi, a dio te kupališne opreme nalazi se i na šetnici koja se nalazi na nespornoj zoni pomorskog dobra. U nacionalnom Informacijskom sustavu prostornog uređenja, iza kojeg stoji Ministarstvo graditeljstva, nema zabilježbe traženja ikakvih dozvola ili dokumenata vezanih uz bilo kakav građevinski zahvat.

Kako sada stvari stoje, a prema informacijama iz Općine Rogoznica, ispada da su na tom turističkom imanju sporne samo drvene kućice, ali sporno je doslovno sve. I kućice koje su iznikle bez ikakvih dozvola i uzurpacija priobalne staze i suhozidi koji su "rastegnuti" do mora, čime su zapriječili slobodan prolaz duž obalne crte.

Nadležne vlasti i institucije olako prelaze preko kršenja zakona i otimačine (javnog) pomorskog dobra u općoj uporabi. Valja istaknuti da na tom dijelu rogozničke obale nije označena granica tog prostora, ali i postojeći zakon je jasan i detaljno utvrđuje granične dijelove kopna koji bez iznimaka moraju ući u obuhvat pomorskog dobra na kojem, ponovimo, nije moguće zasnivanje nikakvih prava, a posebno vlasničkog.

Za kopno je definirano da ako neposredno iza morskog dijela postoji nerazvrstana cesta, onda je "morska granica" takve prometnice ujedno i granica pomorskog dobra, a ako postoji šetnica, onda se vanjski rub šetnice smatra granicom pomorskog dobra. Širinu od šest metara morske obale mjerenu od crte srednje više razine mora smatra se neospornim javnim pojasom.

Starosjedicima u Zatoglavu i drugim priobalnim dalmatinskim mjestima i gradovima devastacija i otimanje obale i more bila je nezamisliva. Morski okoliš za njih je bio svetinja.

Na ovakvim primjerima je očito da odgovorne gradske, općinske i lučke vlasti, te nadležne inspekcijske službe dozvoljavaju bahatluk i totalno uništenje prirodne obale i morske flore i faune. Netko će se valjda u neko doba sjetiti da je to nelegalno i onda će, na temelju nekakve naknadne pameti i (pre)dugih pravnih postupaka, nakon proteka od dvadesetak godina spektakularno dovesti bagere. U naselju Zatoglav, smještenom istočno od Rogoznice, koje je izgubilo svaki trag izvornog mjesta, izgleda da je dozvoljeno uzurpirati priobalnu šetnicu, ali i samo more, a da se "graditelju" ništa neće dogoditi.

Slovenska, odnosno mariborska obitelj Zadravec stoji iza zagrebačke tvrtke na koju je uknjiženo vlasništvo nad zemljištem, površine 1000 četvornih metara, na kojem su izgrađeni zidovi cijelom dužinom obiju bočnih "međa" terena, i to sve do plavog Jadrana, a kraj suhozida nalazi se doslovno u moru.

Na nekretnini su postavljene brojne drvene nastrešnice, staze i platoi, tu su i neizostavne ležaljke i stolovi, a dio te kupališne opreme nalazi se i na šetnici koja se nalazi na nespornoj zoni pomorskog dobra. U nacionalnom Informacijskom sustavu prostornog uređenja, iza kojeg stoji Ministarstvo graditeljstva, nema zabilježbe traženja ikakvih dozvola ili dokumenata vezanih uz bilo kakav građevinski zahvat.

Kako sada stvari stoje, a prema informacijama iz Općine Rogoznica, ispada da su na tom turističkom imanju sporne samo drvene kućice, ali sporno je doslovno sve. I kućice koje su iznikle bez ikakvih dozvola i uzurpacija priobalne staze i suhozidi koji su "rastegnuti" do mora, čime su zapriječili slobodan prolaz duž obalne crte.

Nadležne vlasti i institucije olako prelaze preko kršenja zakona i otimačine (javnog) pomorskog dobra u općoj uporabi. Valja istaknuti da na tom dijelu rogozničke obale nije označena granica tog prostora, ali i postojeći zakon je jasan i detaljno utvrđuje granične dijelove kopna koji bez iznimaka moraju ući u obuhvat pomorskog dobra na kojem, ponovimo, nije moguće zasnivanje nikakvih prava, a posebno vlasničkog.

Za kopno je definirano da ako neposredno iza morskog dijela postoji nerazvrstana cesta, onda je "morska granica" takve prometnice ujedno i granica pomorskog dobra, a ako postoji šetnica, onda se vanjski rub šetnice smatra granicom pomorskog dobra. Širinu od šest metara morske obale mjerenu od crte srednje više razine mora smatra se neospornim javnim pojasom.

Starosjedicima u Zatoglavu i drugim priobalnim dalmatinskim mjestima i gradovima devastacija i otimanje obale i more bila je nezamisliva. Morski okoliš za njih je bio svetinja.

Na ovakvim primjerima je očito da odgovorne gradske, općinske i lučke vlasti, te nadležne inspekcijske službe dozvoljavaju bahatluk i totalno uništenje prirodne obale i morske flore i faune. Netko će se valjda u neko doba sjetiti da je to nelegalno i onda će, na temelju nekakve naknadne pameti i (pre)dugih pravnih postupaka, nakon proteka od dvadesetak godina spektakularno dovesti bagere. Jadno.
