Svesrpski nacionalni projekt gradnje triju hidroelektrana, nazvan Hidroenergetski sustav "Gornja Drina", dospio je u slijepu ulicu. Kineske banke, pomalo neočekivano za vlasti u Beogradu i Banjoj Luci, povukle su ručnu kočnicu i ne žele financirati niti jednu od svojih kompanija koje su se javile na zajednički natječaj Srbije i Republike Srpske za gradnju prve HE u nizu, one "Buk bijela", i to dok ne bude riješen spor pred Ustavnim sudom BiH, kao i onaj pred UNESCO-om, koji je pokrenula Crna Gora. Na velika zvona kamen temeljac za prvu elektranu na Drini, vrijednu pola milijarde konvertibilnih maraka (oko 250 milijuna eura) položili su u svibnju 2021. godine premijeri Srpske i Srbije, Radovan Višković i Ana Brnabić. Euforija se nije ni stišala kada su bošnjački zastupnici u Parlamentu Federacije BiH, njih dvadeset četvoro, pokrenuli spor pred državnim Ustavnim sudom.

Ova pravosudna instanca polovicom iste godine utvrdila je kako postoje pravne dvojbe u vezi s dodjelom koncesije za ovaj projekt te naložila Komisiji za koncesije BiH da u roku od tri mjeseca riješi spor. Problem je bio što je koncesiju dodijelila Republika Srpska, a ne BiH. Iako su od tada prošle dvije i pol godine, Komisija nije još donijela nikakvu odluku. Kao i u mnogim drugim stvarima u susjednoj državi, sve se pretvorilo u međunacionalnu i međudržavnu trzavicu, pa je predmet na kraju preuzelo Tužiteljstvo BiH i on još tamo stoji.

Nitko ne želi posao...

– Kinezi su zatražili dodatne garancije o ovom projektu, navodeći kao razlog sporove koji se o njemu vode pred Ustavnim sudom BiH i UNESCO-om.

Prema našim informacijama, kineske banke ne žele financirati projekt dok situacija ne bude potpuno čista, odnosno dok se ne riješe oba spora. Vlasti RS-a ne brine previše spor pred UNESCO-om, već onaj pred Ustavnim sudom za koji se trenutno ne vidi rješenje – objavio je poslovni portal Capital.ba.

Da je zapeo posao, potvrdio je ministar energetike i rudarstva RS-a Petar Đokić, inače blizak predsjedniku entiteta Miloradu Dodiku. Ustvrdio je da Kinezima kada je u pitanju Ustavni sud on ne može dati bilo kakve garancije te da njihov zahtjev smatra – nekorektnim.

– Kinezi su željeli jasan odgovor na ta dva pitanja. Međutim, to nisu korektna pitanja s njihove strane jer oni nisu investitor. Rekao sam im da što se tiče Ustavnog suda ne možemo dati garanciju jer mi nemamo tu nadležnost. BiH bi se sigurno suočila s arbitražom "teškom" više od milijardu eura ukoliko bi taj sud donio odluku koja bi išla na štetu ekonomskih interesa RS-a. Još nije izabrana nijedna od te tri firme – izjavio je Đokić.

Kineske banke ne žele financirati niti jednu od svojih kompanija koje su se javile na zajednički natječaj Srbije i Republike Srpske

Na natječaj su se, inače, javile kompanije "Dongfang Electric Corporation", "Power China" i "Energy China", od kojih neke već imaju odrađene poslove u ovom dijelu Europe.

Od njih se tražilo dovršenje projekta po principu "ključ u ruke", a same su trebale osigurati i financiranje na svom domaćem financijskom tržištu. Srbija i Republika Srpska imaju dogovor da će sve tri elektrane, koje bi trebale na koncu koštati 520 milijuna eura, financirati u omjeru 51:49 posto.

‘Pripremne radnje‘ pri kraju

Istovremeno se na lokaciji "Buk bijela" završavaju pripremne radnje. Tako barem uvjerava predsjednik Upravnog odbora poduzeća "HES Gornja Drina" Milan Baštinac.

– Do kraja prosinca ćemo završiti pripremne radove koji su, također, prolongirani iz objektivnih razloga. Trenutno se radi ostala projektna dokumentacija vezano za mrijestilište za ribu koje je sastavni dio projekta i obveza po ekološkoj dozvoli – izjavio je Baštinac, također za Capital.ba, ponavljajući argumente svoje vlade:

–​ Hidroelektrana se gradi jedanaest kilometara od granice sa Crnom Gorom, a Drina u gornjem dijelu toka nije granična rijeka, što automatski implicira da je pitanje koncesije potpuno u nadležnosti Republike Srpske. Očekivati od Komisije za koncesije da riješi ovaj slučaj ili nađe neki kompromis, čini se iluzornim. U njoj umjesto sedam predviđenih članova, sjede samo četiri, a i njima su istekli mandati. Stare i nove vlasti u susjednoj državi ne mogu se nikako dogovoriti.

– Problem je što nas jedan od članova Komisije, Mensur Šehagić, opstruira. On nije želio nazočiti sjednicama navodeći tisuću različitih razloga. Zbog toga nismo imali kvorum za održavanje sjednice na kojoj bi se mogla donijeti odluka. Zato smo donijeli određene zaključke u kojima smo naveli da ne vidimo što je sporno u tom predmetu i te zaključke smo dostavili Ustavnom sudu. Međutim, Ustavni sud traži odluku, a mi je ne možemo donijeti zato što nemamo kvorum – opisuje situaciju šef Komisije Milomir Amović.

Ustavni sud digao ruke

Sam Ustavni sud je digao ruke i time također priznao nemoć, tvrdeći da bi se sada slučajem trebali baviti tužitelji.

Što se Crne Gore tiče, ona pred UNESCO-om vodi spor zbog potencijalnog narušavanja zaštićenog područja Durmitora. Pokrenula ga je, istina, prijašnja vlada, koja je dugo bila u tehničkom mandatu. Sada su u Podgorici zapuhali neki novi, prosrpski vjetrovi pa Đokić očekuje da bi zajedno s kolegicom iz Beograda, Dubravkom Đedović Handanović, barem mogao dobiti podršku predsjednika Jakova Milatovića i nove vlade.

Ono što je sigurno jest da kineske tvrtke, inače pod jakom državnom kontrolom, ne zatežu na svoju ruku, već su dobile mig iz viših struktura.

Ovo bi mogao biti i znak da odnosi na relaciji Peking – Banja Luka (Beograd) nisu više tako bajni. Još do jučer Kinezi su s obje strane Drine proglašavani istinskim partnerima, pogotovo u RS-u, koji su trebali spašavati, također, kreditima od bankrota zbog dugova teških 1,2 milijarde maraka.

Svesrpski nacionalni projekt gradnje triju hidroelektrana, nazvan Hidroenergetski sustav "Gornja Drina", dospio je u slijepu ulicu. Kineske banke, pomalo neočekivano za vlasti u Beogradu i Banjoj Luci, povukle su ručnu kočnicu i ne žele financirati niti jednu od svojih kompanija koje su se javile na zajednički natječaj Srbije i Republike Srpske za gradnju prve HE u nizu, one "Buk bijela", i to dok ne bude riješen spor pred Ustavnim sudom BiH, kao i onaj pred UNESCO-om, koji je pokrenula Crna Gora. Na velika zvona kamen temeljac za prvu elektranu na Drini, vrijednu pola milijarde konvertibilnih maraka (oko 250 milijuna eura) položili su u svibnju 2021. godine premijeri Srpske i Srbije, Radovan Višković i Ana Brnabić. Euforija se nije ni stišala kada su bošnjački zastupnici u Parlamentu Federacije BiH, njih dvadeset četvoro, pokrenuli spor pred državnim Ustavnim sudom.

Ova pravosudna instanca polovicom iste godine utvrdila je kako postoje pravne dvojbe u vezi s dodjelom koncesije za ovaj projekt te naložila Komisiji za koncesije BiH da u roku od tri mjeseca riješi spor. Problem je bio što je koncesiju dodijelila Republika Srpska, a ne BiH. Iako su od tada prošle dvije i pol godine, Komisija nije još donijela nikakvu odluku. Kao i u mnogim drugim stvarima u susjednoj državi, sve se pretvorilo u međunacionalnu i međudržavnu trzavicu, pa je predmet na kraju preuzelo Tužiteljstvo BiH i on još tamo stoji.

Nitko ne želi posao...

– Kinezi su zatražili dodatne garancije o ovom projektu, navodeći kao razlog sporove koji se o njemu vode pred Ustavnim sudom BiH i UNESCO-om.

Prema našim informacijama, kineske banke ne žele financirati projekt dok situacija ne bude potpuno čista, odnosno dok se ne riješe oba spora. Vlasti RS-a ne brine previše spor pred UNESCO-om, već onaj pred Ustavnim sudom za koji se trenutno ne vidi rješenje – objavio je poslovni portal Capital.ba.

Da je zapeo posao, potvrdio je ministar energetike i rudarstva RS-a Petar Đokić, inače blizak predsjedniku entiteta Miloradu Dodiku. Ustvrdio je da Kinezima kada je u pitanju Ustavni sud on ne može dati bilo kakve garancije te da njihov zahtjev smatra – nekorektnim.

– Kinezi su željeli jasan odgovor na ta dva pitanja. Međutim, to nisu korektna pitanja s njihove strane jer oni nisu investitor. Rekao sam im da što se tiče Ustavnog suda ne možemo dati garanciju jer mi nemamo tu nadležnost. BiH bi se sigurno suočila s arbitražom "teškom" više od milijardu eura ukoliko bi taj sud donio odluku koja bi išla na štetu ekonomskih interesa RS-a. Još nije izabrana nijedna od te tri firme – izjavio je Đokić.

Na natječaj su se, inače, javile kompanije "Dongfang Electric Corporation", "Power China" i "Energy China", od kojih neke već imaju odrađene poslove u ovom dijelu Europe.

Od njih se tražilo dovršenje projekta po principu "ključ u ruke", a same su trebale osigurati i financiranje na svom domaćem financijskom tržištu. Srbija i Republika Srpska imaju dogovor da će sve tri elektrane, koje bi trebale na koncu koštati 520 milijuna eura, financirati u omjeru 51:49 posto.

‘Pripremne radnje‘ pri kraju

Istovremeno se na lokaciji "Buk bijela" završavaju pripremne radnje. Tako barem uvjerava predsjednik Upravnog odbora poduzeća "HES Gornja Drina" Milan Baštinac.

– Do kraja prosinca ćemo završiti pripremne radove koji su, također, prolongirani iz objektivnih razloga. Trenutno se radi ostala projektna dokumentacija vezano za mrijestilište za ribu koje je sastavni dio projekta i obveza po ekološkoj dozvoli – izjavio je Baštinac, također za Capital.ba, ponavljajući argumente svoje vlade:

–​ Hidroelektrana se gradi jedanaest kilometara od granice sa Crnom Gorom, a Drina u gornjem dijelu toka nije granična rijeka, što automatski implicira da je pitanje koncesije potpuno u nadležnosti Republike Srpske. Očekivati od Komisije za koncesije da riješi ovaj slučaj ili nađe neki kompromis, čini se iluzornim. U njoj umjesto sedam predviđenih članova, sjede samo četiri, a i njima su istekli mandati. Stare i nove vlasti u susjednoj državi ne mogu se nikako dogovoriti.

– Problem je što nas jedan od članova Komisije, Mensur Šehagić, opstruira. On nije želio nazočiti sjednicama navodeći tisuću različitih razloga. Zbog toga nismo imali kvorum za održavanje sjednice na kojoj bi se mogla donijeti odluka. Zato smo donijeli određene zaključke u kojima smo naveli da ne vidimo što je sporno u tom predmetu i te zaključke smo dostavili Ustavnom sudu. Međutim, Ustavni sud traži odluku, a mi je ne možemo donijeti zato što nemamo kvorum – opisuje situaciju šef Komisije Milomir Amović.

Ustavni sud digao ruke

Sam Ustavni sud je digao ruke i time također priznao nemoć, tvrdeći da bi se sada slučajem trebali baviti tužitelji.

Što se Crne Gore tiče, ona pred UNESCO-om vodi spor zbog potencijalnog narušavanja zaštićenog područja Durmitora. Pokrenula ga je, istina, prijašnja vlada, koja je dugo bila u tehničkom mandatu. Sada su u Podgorici zapuhali neki novi, prosrpski vjetrovi pa Đokić očekuje da bi zajedno s kolegicom iz Beograda, Dubravkom Đedović Handanović, barem mogao dobiti podršku predsjednika Jakova Milatovića i nove vlade.

Ono što je sigurno jest da kineske tvrtke, inače pod jakom državnom kontrolom, ne zatežu na svoju ruku, već su dobile mig iz viših struktura.

Ovo bi mogao biti i znak da odnosi na relaciji Peking – Banja Luka (Beograd) nisu više tako bajni. Još do jučer Kinezi su s obje strane Drine proglašavani istinskim partnerima, pogotovo u RS-u, koji su trebali spašavati, također, kreditima od bankrota zbog dugova teških 1,2 milijarde maraka.
