Prema sadašnjim procjenama, prijedlog novog Zakona o radu trebao bi se naći u saborskoj proceduri u prvoj polovici 2022. godine, kažu nam u Ministarstvu rada, piše jutarnji.hr.
Drugim riječima, ni nova regulacija rada na daljinu, koja je postala osobito aktualna u koronakrizi, u kojoj velik broj radnika radi od kuće, a o kojoj se priča od prošle jeseni, neće biti moguća prije toga. I dok u sindikatu smatraju da nema razloga za žurbu, budući da postojeći zakon u članku 17 propisuje uvjete obavljanja rada na izdvojenom mjestu (to smatraju primjerenim za regulaciju rada na daljinu), u Hrvatskoj udruzi poslodavaca nisu zadovoljni.
Zastario propis
"Nismo zadovoljni najavama da će ZOR u saborsku proceduru tek u prvoj polovici 2022. godine jer će to značiti prilično kasnu implementaciju, tj. zakonsko uređenje brojnih instituta unutar ZOR-a koji trebaju biti uređeni što je ranije moguće, kao što je, na primjer, rad na daljinu.
Ustrajat ćemo na tome da se procedura ubrza jer je ZOR uistinu jedan od najvažnijih zakona za gospodarstvo i imati zastarjeli zakon u današnjem vremenu, znači ne biti dovoljno konkurentan s onim zemljama koje su te promjene već provele", poručuju.
Sada još traju preliminarne konzultacije socijalnih partnera o izmjenama Zakona. Kako nam kaže Krešimir Sever iz Nezavisnih hrvatskih sindikata, posljednji sastanak uživo održao se 30. listopada, a od tada se zbog pandemije konzultacije provode online i putem elektroničke pošte, što smatra nedovoljnim te zbog obima promjena i značenja ZOR-a očekuje raspravu uživo.
- Razmjenu poruka ne smatram konzultacijama - naglašava.
U svakom slučaju, među socijalnim partnerima trenutno nema konačno usuglašenih stavova. Plan je, pak, da Se faza konzultacija završi do kraja ožujka, kažu u Ministarstvu, nakon čega se osniva radna skupina koja bi do kraja godine trebala doći do Nacrta prijedloga Zakona.
Kako to tumače u sindikatu, tek će u sklopu radne skupine zapravo početi pravi pregovori. Inače, Ministarstvo rada lani je predložilo da se razmotre izmjene triju instituta u ZOR-u: ugovora o radu, dodatnog rada za drugog poslodavca te mogućnost rada od kuće, odnosno rad na daljinu. No, kako sada kažu, tijekom konzultacija prihvaćeni su prijedlozi poslodavaca i sindikalnih središnjica da se redefinira širi dio Zakona.
Dopusti i plaće
"Do sada su razmijenjeni stavovi o nizu radno-pravnih instituta, a preostale teme se namjeravaju raspraviti do kraja ovog mjeseca. Nakon toga slijedi formalni početak normativnog postupka i osnivanje radne skupine", odgovaraju.
Zakonske promjene odnose se, primjerice, i na materiju radnog vremena, odmora i dopusta, zatim na institute plaće i naknade plaće, moguće i na materiju kolektivnih radnih odnosa. Razgovarat će se i o radu putem internetskih platformi te o institutu skraćenog radnog vremena.

‘Četvrtina zaposlenika radi na daljinu, nešto se mora pokrenuti‘
Poduzetnici nikako nisu zadovoljni najavama iz Vlade.
- Čudno je da se toliko dugo čeka na izmjene Zakona o radu u dijelu koji se odnosi na rad od kuće, a još je čudnije da se od strane sindikata već dosad iznijelo toliko prigovora na račun rada od kuće pa ispada da je to nešto što šteti radniku, a koristi poslodavcu.
Za tvrtku koju vodim rad od kuće je manje poželjan nego redoviti rad u tvrtki, i to je nešto što nastojimo izbjeći. No, prošle godine morali smo zbog epidemioloških razloga organizirati posao tako da nam je četvrtina zaposlenih radila od kuće, i to na način da su tri dana radili od kuće, a četvrti dan dolazili na posao.
Spremni smo ponovo za takav ili scenarij, a što se tiče izmjena ZOR-a u dijelu koji se odnosi na rad od kuće, pozdravljamo da se nešto napokon pokrenulo - kaže nam Ivan Topčić iz TimKabela.

- U mojoj tvrtki dio zaposlenih već dulje vremena radi od kuće, odnosno kombiniramo rad od kuće s radom u uredu, ovisno o potrebama i konkretnim aktivnostima. I sam dijelom radim od kuće.
Prema tome, držim da uopće nije bilo potrebno zakonski regulirati rad od kuće, da je to stvar internih akata poslodavca, što potvrđuje i primjer moje tvrtke i brojnih drugih tvrtki. Kod najnovijih izmjena ZOR-a opet se na pogrešan način prišlo promjenama radnog zakonodavstva.
Ima puno važnijih dijelova radnog zakonodavstva koji trebaju reformu, primjerice prava i obveze iz područja zdravstvenog osiguranja - kaže.

Prema sadašnjim procjenama, prijedlog novog Zakona o radu trebao bi se naći u saborskoj proceduri u prvoj polovici 2022. godine, kažu nam u Ministarstvu rada, piše jutarnji.hr.
Drugim riječima, ni nova regulacija rada na daljinu, koja je postala osobito aktualna u koronakrizi, u kojoj velik broj radnika radi od kuće, a o kojoj se priča od prošle jeseni, neće biti moguća prije toga. I dok u sindikatu smatraju da nema razloga za žurbu, budući da postojeći zakon u članku 17 propisuje uvjete obavljanja rada na izdvojenom mjestu (to smatraju primjerenim za regulaciju rada na daljinu), u Hrvatskoj udruzi poslodavaca nisu zadovoljni.
Zastario propis
"Nismo zadovoljni najavama da će ZOR u saborsku proceduru tek u prvoj polovici 2022. godine jer će to značiti prilično kasnu implementaciju, tj. zakonsko uređenje brojnih instituta unutar ZOR-a koji trebaju biti uređeni što je ranije moguće, kao što je, na primjer, rad na daljinu.
Ustrajat ćemo na tome da se procedura ubrza jer je ZOR uistinu jedan od najvažnijih zakona za gospodarstvo i imati zastarjeli zakon u današnjem vremenu, znači ne biti dovoljno konkurentan s onim zemljama koje su te promjene već provele", poručuju.
Sada još traju preliminarne konzultacije socijalnih partnera o izmjenama Zakona. Kako nam kaže Krešimir Sever iz Nezavisnih hrvatskih sindikata, posljednji sastanak uživo održao se 30. listopada, a od tada se zbog pandemije konzultacije provode online i putem elektroničke pošte, što smatra nedovoljnim te zbog obima promjena i značenja ZOR-a očekuje raspravu uživo.
- Razmjenu poruka ne smatram konzultacijama - naglašava.
U svakom slučaju, među socijalnim partnerima trenutno nema konačno usuglašenih stavova. Plan je, pak, da Se faza konzultacija završi do kraja ožujka, kažu u Ministarstvu, nakon čega se osniva radna skupina koja bi do kraja godine trebala doći do Nacrta prijedloga Zakona.
Kako to tumače u sindikatu, tek će u sklopu radne skupine zapravo početi pravi pregovori. Inače, Ministarstvo rada lani je predložilo da se razmotre izmjene triju instituta u ZOR-u: ugovora o radu, dodatnog rada za drugog poslodavca te mogućnost rada od kuće, odnosno rad na daljinu. No, kako sada kažu, tijekom konzultacija prihvaćeni su prijedlozi poslodavaca i sindikalnih središnjica da se redefinira širi dio Zakona.
Dopusti i plaće
"Do sada su razmijenjeni stavovi o nizu radno-pravnih instituta, a preostale teme se namjeravaju raspraviti do kraja ovog mjeseca. Nakon toga slijedi formalni početak normativnog postupka i osnivanje radne skupine", odgovaraju.
Zakonske promjene odnose se, primjerice, i na materiju radnog vremena, odmora i dopusta, zatim na institute plaće i naknade plaće, moguće i na materiju kolektivnih radnih odnosa. Razgovarat će se i o radu putem internetskih platformi te o institutu skraćenog radnog vremena.

‘Četvrtina zaposlenika radi na daljinu, nešto se mora pokrenuti‘
Poduzetnici nikako nisu zadovoljni najavama iz Vlade.
- Čudno je da se toliko dugo čeka na izmjene Zakona o radu u dijelu koji se odnosi na rad od kuće, a još je čudnije da se od strane sindikata već dosad iznijelo toliko prigovora na račun rada od kuće pa ispada da je to nešto što šteti radniku, a koristi poslodavcu.
Za tvrtku koju vodim rad od kuće je manje poželjan nego redoviti rad u tvrtki, i to je nešto što nastojimo izbjeći. No, prošle godine morali smo zbog epidemioloških razloga organizirati posao tako da nam je četvrtina zaposlenih radila od kuće, i to na način da su tri dana radili od kuće, a četvrti dan dolazili na posao.
Spremni smo ponovo za takav ili scenarij, a što se tiče izmjena ZOR-a u dijelu koji se odnosi na rad od kuće, pozdravljamo da se nešto napokon pokrenulo - kaže nam Ivan Topčić iz TimKabela.

- U mojoj tvrtki dio zaposlenih već dulje vremena radi od kuće, odnosno kombiniramo rad od kuće s radom u uredu, ovisno o potrebama i konkretnim aktivnostima. I sam dijelom radim od kuće.
Prema tome, držim da uopće nije bilo potrebno zakonski regulirati rad od kuće, da je to stvar internih akata poslodavca, što potvrđuje i primjer moje tvrtke i brojnih drugih tvrtki. Kod najnovijih izmjena ZOR-a opet se na pogrešan način prišlo promjenama radnog zakonodavstva.
Ima puno važnijih dijelova radnog zakonodavstva koji trebaju reformu, primjerice prava i obveze iz područja zdravstvenog osiguranja - kaže.
