Stjepan Jurišić (50) dobio je spor protiv Republike Hrvatske pred Europskim sudom za ljudska prava (ESLJP) jer hrvatske vlasti nisu izvršile tri sudske odluke kojima su bili uređeni kontakti između njega i sina u razdoblju od 13 godina.

- Iako sam dobio presudu na sudu u Strasbourgu, slučaj u Hrvatskoj još uvijek nije riješen i to smatram sramotnim. Ustavni sud je prošle godine u travnju naložio da se do listopada okončaju svi postupci i da mi se omogući susret s djetetom, ali oni još uvijek nisu okončani. Poliklinika za zaštitu djece i mladeži grada Zagreba odbila je provesti vještačenje iz samo njima znanih razloga, iako sam ja za to vještačenje uplatio 14.200 kuna i iako im je Ustavni sud naložio provođenje vještačenja. Nadam se da će se sada konačno nešto i poduzeti da se ti postupci okončaju i da će država shvatiti da je pogriješila - izjavio je u četvrtak navečer za Jutarnji list Stjepan Jurišić.

- Otkako je Jutarnji pisao o ovom slučaju, ja sam sina vidio u samo nekoliko navrata, i to na nekoliko minuta. Ravnatelj Centra za socijalnu skrb u Novoj Gradišci odbija dati dežurnog socijalnog radnika da ide sa mnom kad idem vidjeti dijete, iako sam to tražio - rekao je Jurišić.

U presudi koju je sud objavio u četvrtak navodi se da mu je na taj način bilo povrijeđeno pravo na poštivanje obiteljskog života. ESLJP je utvrdio da hrvatske vlasti nisu u potpunosti izvršile tri sudske odluke kojima su uređeni kontakti podnositelja i njegova sina u razdoblju od 13 godina, a ovršni postupci traju već dulje od devet godina. Dakle, vlasti nisu poduzele potrebne korake da održe obiteljske veze između podnositelja i njegova sina, što je rezultiralo odbijanjem djeteta da kontaktira s ocem i njegovim potpunim otuđenjem od oca.

Naime, unatoč činjenici da su se vlasti suočile s teškom obiteljskom situacijom u kojoj su se roditelji međusobno sukobljavali, Sud smatra da nedostatak suradnje između roditelja ne oslobađa državu od njezinih pozitivnih obveza koje proizlaze iz čl. 8. Konvencije. Također, unatoč činjenici da se protiv majke vode kazneni postupci zbog opstruiranja kontakta između oca i djeteta, vlasti nisu poduzele učinkovite korake kako bi isto spriječile, a osobito s obzirom na potrebu hitnog postupanja.

Zbog svega navedenog, a uzevši u obzir i odluku Ustavnog suda Republike Hrvatske koji je u konkretnom slučaju ranije utvrdio da je zbog nerazumne duljine trajanja ovršnih postupaka podnositelju povrijeđeno pravo iz čl. 8. Konvencije, Europski sud je dosudio podnositelju zahtjeva iznos od 15.000 eura na ime neimovinske štete, kao i iznos od 1500 eura na ime troškova zbog povrede prava na obiteljski život.

Ova presuda još nije konačna, to će postati ako niti jedna od strana u postupku u roku od tri mjeseca od dana objave presude ne podnese zahtjev za preispitivanje presude pred Velikim vijećem, piše Jutarnji list.

Stjepan Jurišić (50) dobio je spor protiv Republike Hrvatske pred Europskim sudom za ljudska prava (ESLJP) jer hrvatske vlasti nisu izvršile tri sudske odluke kojima su bili uređeni kontakti između njega i sina u razdoblju od 13 godina.

- Iako sam dobio presudu na sudu u Strasbourgu, slučaj u Hrvatskoj još uvijek nije riješen i to smatram sramotnim. Ustavni sud je prošle godine u travnju naložio da se do listopada okončaju svi postupci i da mi se omogući susret s djetetom, ali oni još uvijek nisu okončani. Poliklinika za zaštitu djece i mladeži grada Zagreba odbila je provesti vještačenje iz samo njima znanih razloga, iako sam ja za to vještačenje uplatio 14.200 kuna i iako im je Ustavni sud naložio provođenje vještačenja. Nadam se da će se sada konačno nešto i poduzeti da se ti postupci okončaju i da će država shvatiti da je pogriješila - izjavio je u četvrtak navečer za Jutarnji list Stjepan Jurišić.

- Otkako je Jutarnji pisao o ovom slučaju, ja sam sina vidio u samo nekoliko navrata, i to na nekoliko minuta. Ravnatelj Centra za socijalnu skrb u Novoj Gradišci odbija dati dežurnog socijalnog radnika da ide sa mnom kad idem vidjeti dijete, iako sam to tražio - rekao je Jurišić.

U presudi koju je sud objavio u četvrtak navodi se da mu je na taj način bilo povrijeđeno pravo na poštivanje obiteljskog života. ESLJP je utvrdio da hrvatske vlasti nisu u potpunosti izvršile tri sudske odluke kojima su uređeni kontakti podnositelja i njegova sina u razdoblju od 13 godina, a ovršni postupci traju već dulje od devet godina. Dakle, vlasti nisu poduzele potrebne korake da održe obiteljske veze između podnositelja i njegova sina, što je rezultiralo odbijanjem djeteta da kontaktira s ocem i njegovim potpunim otuđenjem od oca.

Naime, unatoč činjenici da su se vlasti suočile s teškom obiteljskom situacijom u kojoj su se roditelji međusobno sukobljavali, Sud smatra da nedostatak suradnje između roditelja ne oslobađa državu od njezinih pozitivnih obveza koje proizlaze iz čl. 8. Konvencije. Također, unatoč činjenici da se protiv majke vode kazneni postupci zbog opstruiranja kontakta između oca i djeteta, vlasti nisu poduzele učinkovite korake kako bi isto spriječile, a osobito s obzirom na potrebu hitnog postupanja.

Zbog svega navedenog, a uzevši u obzir i odluku Ustavnog suda Republike Hrvatske koji je u konkretnom slučaju ranije utvrdio da je zbog nerazumne duljine trajanja ovršnih postupaka podnositelju povrijeđeno pravo iz čl. 8. Konvencije, Europski sud je dosudio podnositelju zahtjeva iznos od 15.000 eura na ime neimovinske štete, kao i iznos od 1500 eura na ime troškova zbog povrede prava na obiteljski život.

Ova presuda još nije konačna, to će postati ako niti jedna od strana u postupku u roku od tri mjeseca od dana objave presude ne podnese zahtjev za preispitivanje presude pred Velikim vijećem, piše Jutarnji list.

Stjepan Jurišić (50) dobio je spor protiv Republike Hrvatske pred Europskim sudom za ljudska prava (ESLJP) jer hrvatske vlasti nisu izvršile tri sudske odluke kojima su bili uređeni kontakti između njega i sina u razdoblju od 13 godina.

- Iako sam dobio presudu na sudu u Strasbourgu, slučaj u Hrvatskoj još uvijek nije riješen i to smatram sramotnim. Ustavni sud je prošle godine u travnju naložio da se do listopada okončaju svi postupci i da mi se omogući susret s djetetom, ali oni još uvijek nisu okončani. Poliklinika za zaštitu djece i mladeži grada Zagreba odbila je provesti vještačenje iz samo njima znanih razloga, iako sam ja za to vještačenje uplatio 14.200 kuna i iako im je Ustavni sud naložio provođenje vještačenja.
