Cijela zgrada u Ulici popa Frana Biničkog u Ličkom Osiku već mjesecima strahuje od susjede koja im u maniri "poltergeista" zagorčava život.

Uz to što je napala susjedu i oštetila joj vrata sjekirom, gotovo je i zapalila zgradu. Izazvala je požar u svom stanu, čime im je ugrozila zdravlje i imovinu, a nakon toga je uništila i zajedničko brojilo električne energije. Čitava priča kulminirala je njezinim kontinuiranim puštanjem vode u kupaonici petnaest dana i noći, uz izjavu da je to – smiruje!

– Računi su za taj mjesec bili dvostruko veći i snosili su ih svi stanari. Nakon što je zamoljena da prestane s puštanjem vode, uzrokovala je kvar u svojoj kupaonici, razbila je cijevi. Čulo se lupanje, zbog čega je voda tekla punim pritiskom, pri čemu su poplavljeni podrumi ispod njezina stana – naveli su stanari, koji su zbog toga bili prisiljeni zatvoriti taj dovod vode.

Zbog zatvaranja dovoda vode kako bi se uklonila šteta, ne samo podrumima već i samim temeljima zgrade, dva stana na istoj vertikali mjesecima nemaju sanitarne vode u kupaonicama.

– Sada žena koja ima 87 godina u svojoj kupaonici nema vode jer je na istom vodu. Ne može uključiti perilicu rublja, tuširati se, a za WC mora nositi kantu vode iz kuhinje na drugom kraju stana – naveli su stanari.

Iako su više puta preko upravitelja pokušali ukloniti taj kvar, stanarka im nije nikada dopustila ulazak u svoj stan, a time i uklanjanje kvara na instalacijama koji je napravila. Ustrašenim stanarima dosad nisu uspjele pomoći ni nadležne institucije kojima su se obraćali – gradonačelnik, ličko-senjski župan, policija, socijalna i komunalna služba – kojima su čak poslali peticiju kako bi zaustavili nepredvidivu stanarku.

Kada je Općinski sud u Gospiću 22. rujna prošle godine ipak donio Rješenje o osiguranju, "susjeda" ga je primila putem službenika PU ličko-senjske 11. listopada, no do danas nije po tome i postupila, odnosno nije dopustila ulazak stručnih, trećih osoba u svoj stan, veličine 46,58 m², koji se, kako navode stanari, sastoji od jedne sobe, kuhinje, izbe, kupaonice, predsoblja te balkona. Zbog toga stanari nisu uspjeli ukloniti začepljenje u kanalizacijskim cijevima.

Nije se moglo popraviti ni oštećenje vodovodnih cijevi, odnosno izvesti vodoinstalaterski i po potrebi drugi građevinski radovi kako bi se stanarima zgrade omogućilo neometano korištenje vode u stanovima, te spriječiti nastupanje materijalne štete u zajedničkim prostorijama, što je izravna posljedica poduzimanja nedopuštenih radnji njihove stanarke.

Sedam stanara je zbog toga protiv susjede iz pakla pokrenulo i novi sudski postupak. Nakon što su unajmili odvjetnicu, predali su tužbu na Općinski sud u Gospiću navodeći kako im susjeda svojim ponašanjem onemogućuje mirno korištenje stanova, pri čemu im uz kontinuirano ometanje redovnog života narušava kvalitetu života i ugrožava ne samo imovinu, već i živote i zdravlje.

Putem odvjetnice Marije Lulić iz Zagreba, od suda traže prestanak i zabranu njezina daljnjeg uznemiravanja uz dokaze, te mogući očevid na licu mjesta.

Kako je, međutim, nemirna susjeda nestala bez traga i glasa, sud je 25. ožujka donio odluku o toma kako će je ipak zaustaviti u daljnjem "rumbanju" po zgradi u Ličkom Osiku.

– Tuženoj je pokušana dostava sudskih pismena na adresu prebivališta u više navrata, koja nije uspjela. S obzirom na to da se ni ponovljena dostava nije uspjela obaviti, dostava za tuženu će se obaviti stavljanjem pismena na oglasnu ploču suda. Smatrat će se da je dostava obavljena istekom osmog dana od dana stavljanja pismena na oglasnu ploču suda u skladu s odredbom članka 143. stavka 2. ZPP-a. Sve daljnje dostave u postupku za tuženu obavit će se stavljanjem pismena na mrežnoj stranici e-Oglasna ploča sudova, uz istodobni pokušaj dostave na adresu prebivališta dok stranka ne obavijesti sud o adresi svog prebivališta ili boravišta – odlučila je sutkinja Općinskog suda u Gospiću Mirjana Kosanović.

U tužbi koju su podignuli protiv svoje sustanarke, stanari od suda traže da joj zabrani svako daljnje ili buduće uznemiravanje njihova vlasništva na posebnim i zajedničkim dijelovima nekretnine ukupne površine 2026 m², s korištenjem posebnog dijela predmetne nekretnine u njezinu vlasništvu, na bilo koji način kojim se uznemirava mirno uživanje vlasništva tužitelja ili uzrokuje šteta tužiteljima kao drugim suvlasnicima predmetne nekretnine na njihovim posebnim dijelovima predmetne nekretnine, kao i na zajedničkim dijelovima predmetne nekretnine. Također su od suda tražili i da im susjeda podmiri troškove sudskog postupka uz propisane kamate.

Cijela zgrada u Ulici popa Frana Biničkog u Ličkom Osiku već mjesecima strahuje od susjede koja im u maniri "poltergeista" zagorčava život.

Uz to što je napala susjedu i oštetila joj vrata sjekirom, gotovo je i zapalila zgradu. Izazvala je požar u svom stanu, čime im je ugrozila zdravlje i imovinu, a nakon toga je uništila i zajedničko brojilo električne energije. Čitava priča kulminirala je njezinim kontinuiranim puštanjem vode u kupaonici petnaest dana i noći, uz izjavu da je to – smiruje!

– Računi su za taj mjesec bili dvostruko veći i snosili su ih svi stanari. Nakon što je zamoljena da prestane s puštanjem vode, uzrokovala je kvar u svojoj kupaonici, razbila je cijevi. Čulo se lupanje, zbog čega je voda tekla punim pritiskom, pri čemu su poplavljeni podrumi ispod njezina stana – naveli su stanari, koji su zbog toga bili prisiljeni zatvoriti taj dovod vode.

Zbog zatvaranja dovoda vode kako bi se uklonila šteta, ne samo podrumima već i samim temeljima zgrade, dva stana na istoj vertikali mjesecima nemaju sanitarne vode u kupaonicama.

– Sada žena koja ima 87 godina u svojoj kupaonici nema vode jer je na istom vodu. Ne može uključiti perilicu rublja, tuširati se, a za WC mora nositi kantu vode iz kuhinje na drugom kraju stana – naveli su stanari.

Iako su više puta preko upravitelja pokušali ukloniti taj kvar, stanarka im nije nikada dopustila ulazak u svoj stan, a time i uklanjanje kvara na instalacijama koji je napravila. Ustrašenim stanarima dosad nisu uspjele pomoći ni nadležne institucije kojima su se obraćali – gradonačelnik, ličko-senjski župan, policija, socijalna i komunalna služba – kojima su čak poslali peticiju kako bi zaustavili nepredvidivu stanarku.

Kada je Općinski sud u Gospiću 22. rujna prošle godine ipak donio Rješenje o osiguranju, "susjeda" ga je primila putem službenika PU ličko-senjske 11. listopada, no do danas nije po tome i postupila, odnosno nije dopustila ulazak stručnih, trećih osoba u svoj stan, veličine 46,58 m², koji se, kako navode stanari, sastoji od jedne sobe, kuhinje, izbe, kupaonice, predsoblja te balkona. Zbog toga stanari nisu uspjeli ukloniti začepljenje u kanalizacijskim cijevima.

Nije se moglo popraviti ni oštećenje vodovodnih cijevi, odnosno izvesti vodoinstalaterski i po potrebi drugi građevinski radovi kako bi se stanarima zgrade omogućilo neometano korištenje vode u stanovima, te spriječiti nastupanje materijalne štete u zajedničkim prostorijama, što je izravna posljedica poduzimanja nedopuštenih radnji njihove stanarke.

Sedam stanara je zbog toga protiv susjede iz pakla pokrenulo i novi sudski postupak. Nakon što su unajmili odvjetnicu, predali su tužbu na Općinski sud u Gospiću navodeći kako im susjeda svojim ponašanjem onemogućuje mirno korištenje stanova, pri čemu im uz kontinuirano ometanje redovnog života narušava kvalitetu života i ugrožava ne samo imovinu, već i živote i zdravlje.

Putem odvjetnice Marije Lulić iz Zagreba, od suda traže prestanak i zabranu njezina daljnjeg uznemiravanja uz dokaze, te mogući očevid na licu mjesta.

Kako je, međutim, nemirna susjeda nestala bez traga i glasa, sud je 25. ožujka donio odluku o toma kako će je ipak zaustaviti u daljnjem "rumbanju" po zgradi u Ličkom Osiku.

– Tuženoj je pokušana dostava sudskih pismena na adresu prebivališta u više navrata, koja nije uspjela. S obzirom na to da se ni ponovljena dostava nije uspjela obaviti, dostava za tuženu će se obaviti stavljanjem pismena na oglasnu ploču suda. Smatrat će se da je dostava obavljena istekom osmog dana od dana stavljanja pismena na oglasnu ploču suda u skladu s odredbom članka 143. stavka 2. ZPP-a. Sve daljnje dostave u postupku za tuženu obavit će se stavljanjem pismena na mrežnoj stranici e-Oglasna ploča sudova, uz istodobni pokušaj dostave na adresu prebivališta dok stranka ne obavijesti sud o adresi svog prebivališta ili boravišta – odlučila je sutkinja Općinskog suda u Gospiću Mirjana Kosanović.

U tužbi koju su podignuli protiv svoje sustanarke, stanari od suda traže da joj zabrani svako daljnje ili buduće uznemiravanje njihova vlasništva na posebnim i zajedničkim dijelovima nekretnine ukupne površine 2026 m², s korištenjem posebnog dijela predmetne nekretnine u njezinu vlasništvu, na bilo koji način kojim se uznemirava mirno uživanje vlasništva tužitelja ili uzrokuje šteta tužiteljima kao drugim suvlasnicima predmetne nekretnine na njihovim posebnim dijelovima predmetne nekretnine, kao i na zajedničkim dijelovima predmetne nekretnine. Također su od suda tražili i da im susjeda podmiri troškove sudskog postupka uz propisane kamate.
