Državljanin Mađarske S. S. (44), koji je u Ulici Rikarda Katalinića Jeretova na zadarskom Poluotoku preko trgovine rabljene odjeće iz Mađarske kupovao softvere za igrice vrijedne više milijuna kuna, optužen je za utaju poreza.

Općinsko državno odvjetništvo u Zadru (ODO) optužilo ga je za utaju ukupno 769.267,89 kuna poreza u razdoblju od 1. lipnja 2015. do 20. siječnja 2016., kad je kao direktor trgovačkog društva "Tortuga" d.o.o. kupio softver za igrice vrijedan 2,7 milijuna kuna od mađarskog trgovačkog društva 2S Supply Services Kft. Za to je trebao obračunati i platiti porez u iznosu od 692.739,41 kune.

U listopadu, studenom i prosincu 2015. također nije prikazao primljenu isporuku dobara iz EU-a, i to od mađarskog trgovačkog društva Navimaster Informatika Ktf u vrijednosti 306.113,90 kuna, za što je trebao platiti PDV u iznosu od 76.528,48 kuna.

Iako je bio dužan više od pola milijuna kuna poreza, Mađar je za cijelo razdoblje prijavio samo iznos od ukupno 4772,98 kuna.

Iznoseći svoju obranu zamolbenim putem pred državnom Poreznom i Carinskom upravom, Sektora za gospodarski kriminalitet Područnog ureda Mađarska, 44-godišnjak je osporio počinjenje kaznenog djela navodeći da je uvoznik proizvoda za njegovu tvrtku bila jedino tvrtka 2S Supply Services Kft.

Gdje su računi?

Naveo je kako se radilo o transakciji između organizacija sa sjedištima u državama članicama EU-a koje na temelju Uredbe o PDV-u ne podliježu plaćanju PDV-a. Ta roba, kako je rekao, nije bila plasirana na tržište u vrijeme njegova mandata na mjestu direktora, pa smatra da nije nastala obaveza za PDV.

Objasnio je da je njegova tvrtka imala dugovanje prema tvrtki 2S Supply Services Kft, koja je istovremeno bila dužna tvrtki Navi master Kft, pa su se oni dogovorili da njegova tvrtka po toj osnovi uplati Navi masteru i tako zatvori svoje dugovanje prema 2S Supply Services Kft, o čemu je sklopljen pismeni sporazum.

Knjigovotkinja društva posvjedočila je da je ugovor o pružanju knjigovodstvenih usluga sklopila za društvo koje će u Zadru otvoriti trgovinu rabljenih odjevnih predmeta, a na traženje osoba mađarskog državljanstva. Rekla je kako su joj predali nekoliko računa o prodaji robe kupcima u trgovini, te jedan ulazni račun dobavljača za pet vreća robe, ali radilo se o vrijednostima od 3000 do 4000 kuna.

Nisu joj bili dostavljeni na knjiženje neki računi dobavljača iz Mađarske za isporuku softvera za igrice, niti su joj predani dolazni računi za plaćanje tvrtkama u Mađarskoj, ali je znala da na njihovu žiro-računu nije bilo novca. Poslije je k njima u poslovni prostor došao drugi mađarski državljanin, koji je preuzeo preostalu poslovnu dokumentaciju rekavši da će naći drugog knjigovođu u Zagrebu.

Odvjetništvo je na temelju dokaza nedvojbeno utvrdilo da su mađarska društva koja su isporučivala robu i usluge "Tortugi" to evidentirala u sustavu VIES-VAT (Information exchange system), zbog čega je obaveza obračuna PDV-a kod stjecanja dobara unutar EU-a nastala u trenutku izdavanja računa ili istekom roka 15. dana u mjesecu.

Državljanin Mađarske S. S. (44), koji je u Ulici Rikarda Katalinića Jeretova na zadarskom Poluotoku preko trgovine rabljene odjeće iz Mađarske kupovao softvere za igrice vrijedne više milijuna kuna, optužen je za utaju poreza.

Općinsko državno odvjetništvo u Zadru (ODO) optužilo ga je za utaju ukupno 769.267,89 kuna poreza u razdoblju od 1. lipnja 2015. do 20. siječnja 2016., kad je kao direktor trgovačkog društva "Tortuga" d.o.o. kupio softver za igrice vrijedan 2,7 milijuna kuna od mađarskog trgovačkog društva 2S Supply Services Kft. Za to je trebao obračunati i platiti porez u iznosu od 692.739,41 kune.

U listopadu, studenom i prosincu 2015. također nije prikazao primljenu isporuku dobara iz EU-a, i to od mađarskog trgovačkog društva Navimaster Informatika Ktf u vrijednosti 306.113,90 kuna, za što je trebao platiti PDV u iznosu od 76.528,48 kuna.

Iako je bio dužan više od pola milijuna kuna poreza, Mađar je za cijelo razdoblje prijavio samo iznos od ukupno 4772,98 kuna.

Iznoseći svoju obranu zamolbenim putem pred državnom Poreznom i Carinskom upravom, Sektora za gospodarski kriminalitet Područnog ureda Mađarska, 44-godišnjak je osporio počinjenje kaznenog djela navodeći da je uvoznik proizvoda za njegovu tvrtku bila jedino tvrtka 2S Supply Services Kft.

Gdje su računi?

Naveo je kako se radilo o transakciji između organizacija sa sjedištima u državama članicama EU-a koje na temelju Uredbe o PDV-u ne podliježu plaćanju PDV-a. Ta roba, kako je rekao, nije bila plasirana na tržište u vrijeme njegova mandata na mjestu direktora, pa smatra da nije nastala obaveza za PDV.

Objasnio je da je njegova tvrtka imala dugovanje prema tvrtki 2S Supply Services Kft, koja je istovremeno bila dužna tvrtki Navi master Kft, pa su se oni dogovorili da njegova tvrtka po toj osnovi uplati Navi masteru i tako zatvori svoje dugovanje prema 2S Supply Services Kft, o čemu je sklopljen pismeni sporazum.

Knjigovotkinja društva posvjedočila je da je ugovor o pružanju knjigovodstvenih usluga sklopila za društvo koje će u Zadru otvoriti trgovinu rabljenih odjevnih predmeta, a na traženje osoba mađarskog državljanstva. Rekla je kako su joj predali nekoliko računa o prodaji robe kupcima u trgovini, te jedan ulazni račun dobavljača za pet vreća robe, ali radilo se o vrijednostima od 3000 do 4000 kuna.

Nisu joj bili dostavljeni na knjiženje neki računi dobavljača iz Mađarske za isporuku softvera za igrice, niti su joj predani dolazni računi za plaćanje tvrtkama u Mađarskoj, ali je znala da na njihovu žiro-računu nije bilo novca. Poslije je k njima u poslovni prostor došao drugi mađarski državljanin, koji je preuzeo preostalu poslovnu dokumentaciju rekavši da će naći drugog knjigovođu u Zagrebu.

Odvjetništvo je na temelju dokaza nedvojbeno utvrdilo da su mađarska društva koja su isporučivala robu i usluge "Tortugi" to evidentirala u sustavu VIES-VAT (Information exchange system), zbog čega je obaveza obračuna PDV-a kod stjecanja dobara unutar EU-a nastala u trenutku izdavanja računa ili istekom roka 15. dana u mjesecu.

Trgovac rabljenom odjećom utajio 769 tisuća kuna poreza? Preko trgovine kupovao softvere za igrice vrijedne više milijuna kuna

Državljanin Mađarske S. S. (44), koji je u Ulici Rikarda Katalinića Jeretova na zadarskom Poluotoku preko trgovine rabljene odjeće iz Mađarske kupovao softvere za igrice vrijedne više milijuna kuna, optužen je za utaju poreza.

Općinsko državno odvjetništvo u Zadru (ODO) optužilo ga je za utaju ukupno 769.267,89 kuna poreza u razdoblju od 1. lipnja 2015. do 20. siječnja 2016., kad je kao direktor trgovačkog društva "Tortuga" d.o.o. kupio softver za igrice vrijedan 2,7 milijuna kuna od mađarskog trgovačkog društva 2S Supply Services Kft. Za to je trebao obračunati i platiti porez u iznosu od 692.739,41 kune.

U listopadu, studenom i prosincu 2015. također nije prikazao primljenu isporuku dobara iz EU-a, i to od mađarskog trgovačkog društva Navimaster Informatika Ktf u...
