Općinsko državno odvjetništvo podiglo je optužnicu protiv 32-godišnje majke iz Splita koja je prijetila smrću osobama iz Centra za socijalnu skrb nadležnima za odluke i nadzor nad njenim maloljetnim djetetom. Kako je dijete privremeno oduzeto od oba roditelja i predano na skrb članu obitelji, nezadovoljna majka je telefonskim pozivom i slanjem poruka dovela sebe do kaznenog postupka zbog prijetnji smrću.
Slučaj je pokrenut kada je 32- godišnjakinja krajem siječnja ove godine, nakon susreta sa svojim maloljetnim djetetom, odbila predati ga privremenoj skrbnici. Roditeljima je odlukom centra privremeno oduzeto pravo na stanovanje s djetetom te su lišeni prava na svakodnevnu skrb.
Dijete je privremeno povjereno na svakodnevnu brigu i skrb članu majčine obitelji kod kojeg treba i stanovati. Roditeljima je određeno održavanje osobnih odnosa dva sata tjedno uz nadzor stručne osobe tj. voditelja nadzora kojeg je imenovao centar.
Majka to nije mogla prihvatiti te je na dan susreta morala intervenirati policija kako bi predala dijete. Optužnica navodi kako je dva dana kasnije nazvala socijalnu radnicu koja je zadužena za predmet obiteljsko pravne zaštite njenog maloljetnog djeteta i rekla joj: "sve ću vas poubijat, majke mi moje, diteta mi moga".
Istog dana je u 22 sata voditelju mjere nadzora poslala poruku na mobitel: "ok prijavljen si policiji i Centru skupa sa kolegicom i cijelom prvom policijskom postajom i pripremite dokumentaciju za pogrebno poduzeće svi sa CZSS jer pucam, ujutro ćete svi dobiti otkaz".
U svojoj obrani 32-godišnjakinja je negirala da namjerava nauditi ikome iz Centra.
-Dovela sam dijete na dogovoreni susret u prodajni centar koji se trebao dogoditi uz prisustvo voditelja. Imam pravo dva puta tjedno viđati svoje dijete. Bila sam iznervirana protuzakonitim postupanjem Centra za socijalnu skrb zbog povjeravanja mog djeteta članu moje obitelji s obzirom na to da sada imam riješeno stambeno pitanje i da više nema razloga da dijete ne bude sa mnom.
Dan nakon susreta sam pokušala stupiti u kontakt s voditeljem nadzora te sam mu oko 18 sati poslala SMS poruku, koja nije bila prijetećeg sadržaja. Ako sam nešto krivo rekla voditelju susreta i socijalnoj radnici kajem se, ali se ne osjećam krivom jer sam bila iznervirana. Nemam namjeru bilo koga ubiti i oštetiti - izjavila je.
Tijekom istrage svjedočilo je i oboje djelatnika centra koji su izjavili kako nisu zainteresirani za njen kazneni progon. Međutim, kako je tužiteljstvo imalo izlist poziva i poruka, procijenili su kako se radi o kaznenim djelima prijetnje i to osobama zbog posla koji obavljaju što je kvalificirani oblik.
Traže stoga da se 32-godišnjakinja kazni s po pola godine zatvora za svaku prijetnju te da joj se izrekne jedinstvena kazna od deset mjeseci zatvora. Na njihovu procjenu je utjecalo što je 32-godišnjakinja već osuđena na splitskom sudu u srpnju prošle godine zbog prevare na uvjetnu kaznu zatvora od 10 mjeseci uz rok kušnje od tri godine.
To bi značilo da je prijetnje počinila dok je bila pod rokom kušnje. Nadalje je u kolovozu prošle godine osuđena na njemačkom sudu zbog krađe na novčanu kaznu. Uz to u dosjeu ima i presudu Prekršajnog suda u Splitu iz 2018. godine na novčanu kaznu zbog prekršaja Zakona o zaštiti od nasilja u obitelji.

Općinsko državno odvjetništvo podiglo je optužnicu protiv 32-godišnje majke iz Splita koja je prijetila smrću osobama iz Centra za socijalnu skrb nadležnima za odluke i nadzor nad njenim maloljetnim djetetom. Kako je dijete privremeno oduzeto od oba roditelja i predano na skrb članu obitelji, nezadovoljna majka je telefonskim pozivom i slanjem poruka dovela sebe do kaznenog postupka zbog prijetnji smrću.
Slučaj je pokrenut kada je 32- godišnjakinja krajem siječnja ove godine, nakon susreta sa svojim maloljetnim djetetom, odbila predati ga privremenoj skrbnici. Roditeljima je odlukom centra privremeno oduzeto pravo na stanovanje s djetetom te su lišeni prava na svakodnevnu skrb.
Dijete je privremeno povjereno na svakodnevnu brigu i skrb članu majčine obitelji kod kojeg treba i stanovati. Roditeljima je određeno održavanje osobnih odnosa dva sata tjedno uz nadzor stručne osobe tj. voditelja nadzora kojeg je imenovao centar.
Majka to nije mogla prihvatiti te je na dan susreta morala intervenirati policija kako bi predala dijete. Optužnica navodi kako je dva dana kasnije nazvala socijalnu radnicu koja je zadužena za predmet obiteljsko pravne zaštite njenog maloljetnog djeteta i rekla joj: "sve ću vas poubijat, majke mi moje, diteta mi moga".
Istog dana je u 22 sata voditelju mjere nadzora poslala poruku na mobitel: "ok prijavljen si policiji i Centru skupa sa kolegicom i cijelom prvom policijskom postajom i pripremite dokumentaciju za pogrebno poduzeće svi sa CZSS jer pucam, ujutro ćete svi dobiti otkaz".
U svojoj obrani 32-godišnjakinja je negirala da namjerava nauditi ikome iz Centra.
-Dovela sam dijete na dogovoreni susret u prodajni centar koji se trebao dogoditi uz prisustvo voditelja. Imam pravo dva puta tjedno viđati svoje dijete. Bila sam iznervirana protuzakonitim postupanjem Centra za socijalnu skrb zbog povjeravanja mog djeteta članu moje obitelji s obzirom na to da sada imam riješeno stambeno pitanje i da više nema razloga da dijete ne bude sa mnom.
Dan nakon susreta sam pokušala stupiti u kontakt s voditeljem nadzora te sam mu oko 18 sati poslala SMS poruku, koja nije bila prijetećeg sadržaja. Ako sam nešto krivo rekla voditelju susreta i socijalnoj radnici kajem se, ali se ne osjećam krivom jer sam bila iznervirana. Nemam namjeru bilo koga ubiti i oštetiti - izjavila je.
Tijekom istrage svjedočilo je i oboje djelatnika centra koji su izjavili kako nisu zainteresirani za njen kazneni progon. Međutim, kako je tužiteljstvo imalo izlist poziva i poruka, procijenili su kako se radi o kaznenim djelima prijetnje i to osobama zbog posla koji obavljaju što je kvalificirani oblik.
Traže stoga da se 32-godišnjakinja kazni s po pola godine zatvora za svaku prijetnju te da joj se izrekne jedinstvena kazna od deset mjeseci zatvora. Na njihovu procjenu je utjecalo što je 32-godišnjakinja već osuđena na splitskom sudu u srpnju prošle godine zbog prevare na uvjetnu kaznu zatvora od 10 mjeseci uz rok kušnje od tri godine.
To bi značilo da je prijetnje počinila dok je bila pod rokom kušnje. Nadalje je u kolovozu prošle godine osuđena na njemačkom sudu zbog krađe na novčanu kaznu. Uz to u dosjeu ima i presudu Prekršajnog suda u Splitu iz 2018. godine na novčanu kaznu zbog prekršaja Zakona o zaštiti od nasilja u obitelji.
