Udruga je uspoređivala potpuno jednake kredite, bez obzira na valutnu klauzulu, i došla do zaključka da takozvana francuska formula, ili prikazivanje kamate na dnevnoj bazi dijeljenjem godišnje kamate na 360 dijelova i kasnije zaračunavanje tako izražene kamate za 365, odnosno 366 dana, banci iznos naplaćenih kamata u slučaju prijestupne godine povećava za 1,67 posto.

“Franak” priopćava da tako Splitska banka na “nepošten način zarađuje ekstra profit i dodatno direktno osiromašuje građane”, te se pitaju štiti li možda Hrvatska narodna banka (HNB) profit banaka ili pravnu državu.

Sve po zakonu

Prepiska te udruge sa središnjom bankom trajala je tri mjeseca, a jasnog odgovora na svoja pitanja nisu dobili. Splitska banka nije im uopće odgovorila na upit, a središnja im je banka tek nakon požurnice kazala da banka posluje zakonito i po propisima HNB-a u vezi s načinom izračunavanja efektivne kamatne stope. To u ovoj udruzi drže nebitnim jer su se oni bavili računanjem anuiteta na temelju redovne kamate.

Splitska banka odbacuje sve “Frankove” zaključke kao proizvoljne, neutemeljene i netočne. Ističu da metodologija izračuna kamate i broj kalendarskih dana, 360 ili 365, bira svaka banka za sebe i to nije u nesuglasju s bilo kojom zakonskom odredbom.

– Činjenica da banka koristi izračun na bazi 360 dana je uzeta u obzir i sadržana je u izračunatoj efektivnoj kamatnoj stopi koju na doista transparentan način predstavlja potrošačima kod promotivnih aktivnosti i u fazi ugovaranja kreditnog proizvoda. Tako je sasvim moguće, primjerice, da dvije institucije za sličan proizvod koriste istu nominalnu kamatu, ali da iskazuju različitu efektivnu, među ostalim i zbog različite metodologije obračuna kao samo jednog od elemenata izračuna. Isto tako, moguće je da dvije institucije imaju različitu nominalnu kamatu, ali da zbog različite visine naknade, ročnosti i slično naposljetku izračun rezultira identičnom efektivnom kamatom – kažu u Splitskoj banci.

Poručuju da potrošač usporedbom efektivnih kamata u bankama može uspoređivati ukupnu cijenu proizvoda, čime se postiže maksimalna transparentnost prema kupcima kreditnih proizvoda.

Ukupni troškovi

HNB je obvezao banke na objavu efektivnih kamata, propisao je način izračuna te kamate koja pokazuje ukupne troškove kredita i uključuje nominalnu ili redovnu kamatu po kojoj se otplaćuje kredit, kao i sve ostale troškove: naknade, osiguranja, depozit...

Udruga je uspoređivala potpuno jednake kredite, bez obzira na valutnu klauzulu, i došla do zaključka da takozvana francuska formula, ili prikazivanje kamate na dnevnoj bazi dijeljenjem godišnje kamate na 360 dijelova i kasnije zaračunavanje tako izražene kamate za 365, odnosno 366 dana, banci iznos naplaćenih kamata u slučaju prijestupne godine povećava za 1,67 posto.

“Franak” priopćava da tako Splitska banka na “nepošten način zarađuje ekstra profit i dodatno direktno osiromašuje građane”, te se pitaju štiti li možda Hrvatska narodna banka (HNB) profit banaka ili pravnu državu.

Sve po zakonu

Prepiska te udruge sa središnjom bankom trajala je tri mjeseca, a jasnog odgovora na svoja pitanja nisu dobili. Splitska banka nije im uopće odgovorila na upit, a središnja im je banka tek nakon požurnice kazala da banka posluje zakonito i po propisima HNB-a u vezi s načinom izračunavanja efektivne kamatne stope. To u ovoj udruzi drže nebitnim jer su se oni bavili računanjem anuiteta na temelju redovne kamate.

Splitska banka odbacuje sve “Frankove” zaključke kao proizvoljne, neutemeljene i netočne. Ističu da metodologija izračuna kamate i broj kalendarskih dana, 360 ili 365, bira svaka banka za sebe i to nije u nesuglasju s bilo kojom zakonskom odredbom.

– Činjenica da banka koristi izračun na bazi 360 dana je uzeta u obzir i sadržana je u izračunatoj efektivnoj kamatnoj stopi koju na doista transparentan način predstavlja potrošačima kod promotivnih aktivnosti i u fazi ugovaranja kreditnog proizvoda. Tako je sasvim moguće, primjerice, da dvije institucije za sličan proizvod koriste istu nominalnu kamatu, ali da iskazuju različitu efektivnu, među ostalim i zbog različite metodologije obračuna kao samo jednog od elemenata izračuna. Isto tako, moguće je da dvije institucije imaju različitu nominalnu kamatu, ali da zbog različite visine naknade, ročnosti i slično naposljetku izračun rezultira identičnom efektivnom kamatom – kažu u Splitskoj banci.

Poručuju da potrošač usporedbom efektivnih kamata u bankama može uspoređivati ukupnu cijenu proizvoda, čime se postiže maksimalna transparentnost prema kupcima kreditnih proizvoda.

Ukupni troškovi

HNB je obvezao banke na objavu efektivnih kamata, propisao je način izračuna te kamate koja pokazuje ukupne troškove kredita i uključuje nominalnu ili redovnu kamatu po kojoj se otplaćuje kredit, kao i sve ostale troškove: naknade, osiguranja, depozit...
