- Još jedan CHF ugovor proglašen je ništetnim, ovaj put je to 13. srpnja 2020. presudila sutkinja Općinskog suda u Zadru, službe u Pagu, Vilka Škunca. Potrošača su zastupali zadarski odvjetnici Božo Vrkić i Ivan Šalina - objavili su u utorak iz udruge Franak dodajući kako Zagrebačka banka (Zaba) mora vratiti ukupno 1.165.000 kuna uz pripadajuće zatezne kamate te mora platiti 290.000 kuna sudskih troškova.
Kako navode iz udruge Franak, uslijed ništetnosti odredaba o kamatnoj stopi, o valutnoj klauzuli CHF te o općim uvjetima koji se mijenjaju odlukom banke, sutkinja je dosudila ništetnost cijeloga ugovora s valutnom klauzulom CHF.
- Veseli nas svaka pojedinačna odluka koja ide u smjeru ništetnosti CHF ugovora, i vjerujemo da ćemo imati pravomoćno utvrđeno pravno shvaćanje Vrhovnog suda Republike Hrvatske (VSRH) kako ugovori s ništetnim predmetom (valutnom klauzulom CHF) i ništetnom cijenom (promjenjivom kamatnom stopom) ne mogu opstati! Uostalom, to je već utvrđeno na Sudu EU, i nema niti jednog razloga da se to ne utvrdi i na našem Vrhovnom sudu - poručuju iz ove udruge koja štiti prava potrošača korisnika usluga kreditnih i financijskih institucija.
Ujedno su iz udruge Franak reagirali na komentar Hrvatske udruge banaka od 10. srpnja 2020. kojim su bankari ustvrdili kako donesena presuda Europskog suda C-425/18 nije primjenjiva na sudske postupke u Hrvatskoj, budući da su sporazumi o konverziji u Republici Hrvatskoj sklopljeni temeljem zakona i na osnovi jasno propisanih i zakonom utvrđenih uvjeta i parametara.
Iz udruge Franak ističu kako su "iz HUB-a pokušali demantirati činjenicu da je presuda C-452/18 uz presudu C-118/17 krucijalna za pitanje prava na obeštećenje unatoč konverziji CHF kredita".
- Iz HUB-a tvrde kako se presuda C-452/18 ne odnosi na hrvatske konverzije. Takva tvrdnja jest pokušaj HUB-a da utječe na pravosuđe, što konstantno nastoje činiti, pokušavajući na taj način izlobirati za banke povoljne sudske odluke.
Naime, neupitno je da nam presude C-118/17 i C-452/18 zajednički omogućuju potraživati obeštećenje na temelju nepoštenih ugovornih odredaba. U svim našim tužbama upravo se postavlja pitanje vraćanja preplaćenih anuiteta, dakle obeštećenja, a na našim sudovima je da primjene stoga presudu C-118/17 uz dodatna utvrđenja iz presude C-452/18 ili da primjene utvrđenja iz presude C-452/18 ukoliko se javlja pitanje valjanosti aneksa koje uglavnom sudovi uopće ne preispituju, jer se to tužbenim zahtjevima uopće i ne traži.
Uostalom, doneseno je na desetke ukidnih rješenja kojima su županijski sudovi ogledni postupak proglasili irelevantnim za naše tužbe. Potrošač ima pravo utvrđivati visinu obeštećenja, s obzirom da konverzijom nije obeštećen, što je upravo u skladu s presudama Suda EU C-118/17 i C-452/18. - ističu iz udruge Franak.
Naglašavaju također kako su "uvjereni da su upravo HUB i njegove članice uspjeli izlobirati da se provede ogledni postupak Gos-1/19 kojim je privremeno došlo do nedoumica na hrvatskim sudovima, ali je na sreću Sud EU vrlo brzo odlukom po predmetu C-452/18 sve te nedoumice razjasnio".
- Sada čekamo konačno odluke po revizijama kojima će se utvrditi: pravo na obeštećenje za konvertirane kredite i ništetnost temeljnih CHF ugovora. Krenuli smo putem s kojega više nema povratka unazad, a HUB-ovi pamfleti uzaludni su pokušaji hvatanja za slamku spasa! U Hrvatskoj se banke brane konverzijom, a u Washingtonu zbog konverzije te iste banke traže novac - ističu iz ove udruge uz poslovicu "Pravda je stalna i trajna volja svakome dati pravo koje mu pripada".

- Još jedan CHF ugovor proglašen je ništetnim, ovaj put je to 13. srpnja 2020. presudila sutkinja Općinskog suda u Zadru, službe u Pagu, Vilka Škunca. Potrošača su zastupali zadarski odvjetnici Božo Vrkić i Ivan Šalina - objavili su u utorak iz udruge Franak dodajući kako Zagrebačka banka (Zaba) mora vratiti ukupno 1.165.000 kuna uz pripadajuće zatezne kamate te mora platiti 290.000 kuna sudskih troškova.
Kako navode iz udruge Franak, uslijed ništetnosti odredaba o kamatnoj stopi, o valutnoj klauzuli CHF te o općim uvjetima koji se mijenjaju odlukom banke, sutkinja je dosudila ništetnost cijeloga ugovora s valutnom klauzulom CHF.
- Veseli nas svaka pojedinačna odluka koja ide u smjeru ništetnosti CHF ugovora, i vjerujemo da ćemo imati pravomoćno utvrđeno pravno shvaćanje Vrhovnog suda Republike Hrvatske (VSRH) kako ugovori s ništetnim predmetom (valutnom klauzulom CHF) i ništetnom cijenom (promjenjivom kamatnom stopom) ne mogu opstati! Uostalom, to je već utvrđeno na Sudu EU, i nema niti jednog razloga da se to ne utvrdi i na našem Vrhovnom sudu - poručuju iz ove udruge koja štiti prava potrošača korisnika usluga kreditnih i financijskih institucija.
Ujedno su iz udruge Franak reagirali na komentar Hrvatske udruge banaka od 10. srpnja 2020. kojim su bankari ustvrdili kako donesena presuda Europskog suda C-425/18 nije primjenjiva na sudske postupke u Hrvatskoj, budući da su sporazumi o konverziji u Republici Hrvatskoj sklopljeni temeljem zakona i na osnovi jasno propisanih i zakonom utvrđenih uvjeta i parametara.
Iz udruge Franak ističu kako su "iz HUB-a pokušali demantirati činjenicu da je presuda C-452/18 uz presudu C-118/17 krucijalna za pitanje prava na obeštećenje unatoč konverziji CHF kredita".
- Iz HUB-a tvrde kako se presuda C-452/18 ne odnosi na hrvatske konverzije. Takva tvrdnja jest pokušaj HUB-a da utječe na pravosuđe, što konstantno nastoje činiti, pokušavajući na taj način izlobirati za banke povoljne sudske odluke.
Naime, neupitno je da nam presude C-118/17 i C-452/18 zajednički omogućuju potraživati obeštećenje na temelju nepoštenih ugovornih odredaba. U svim našim tužbama upravo se postavlja pitanje vraćanja preplaćenih anuiteta, dakle obeštećenja, a na našim sudovima je da primjene stoga presudu C-118/17 uz dodatna utvrđenja iz presude C-452/18 ili da primjene utvrđenja iz presude C-452/18 ukoliko se javlja pitanje valjanosti aneksa koje uglavnom sudovi uopće ne preispituju, jer se to tužbenim zahtjevima uopće i ne traži.
Uostalom, doneseno je na desetke ukidnih rješenja kojima su županijski sudovi ogledni postupak proglasili irelevantnim za naše tužbe. Potrošač ima pravo utvrđivati visinu obeštećenja, s obzirom da konverzijom nije obeštećen, što je upravo u skladu s presudama Suda EU C-118/17 i C-452/18. - ističu iz udruge Franak.
Naglašavaju također kako su "uvjereni da su upravo HUB i njegove članice uspjeli izlobirati da se provede ogledni postupak Gos-1/19 kojim je privremeno došlo do nedoumica na hrvatskim sudovima, ali je na sreću Sud EU vrlo brzo odlukom po predmetu C-452/18 sve te nedoumice razjasnio".
- Sada čekamo konačno odluke po revizijama kojima će se utvrditi: pravo na obeštećenje za konvertirane kredite i ništetnost temeljnih CHF ugovora. Krenuli smo putem s kojega više nema povratka unazad, a HUB-ovi pamfleti uzaludni su pokušaji hvatanja za slamku spasa! U Hrvatskoj se banke brane konverzijom, a u Washingtonu zbog konverzije te iste banke traže novac - ističu iz ove udruge uz poslovicu "Pravda je stalna i trajna volja svakome dati pravo koje mu pripada".
