Sukladno vašoj odluci broj i datum gornji po disciplinskoj prijavi protiv Mije Jeličića, odvjetnika u Splitu, koristeći pravo slobode govora nazvat ću vas vrapcem za kojeg je za pravosuđe najbolje da noseći na krilima odvjetnika Miju Jeličića bespovratno odleti. U prilogu se dostavlja presuda Županijskog suda u Varaždinu broj: 19 Kž-590/2022-4 od 13. prosinca 2022. U potpisu zamjenik općinskog državnog odvjetnika Nela Kustura."

U prvom trenutku pomislili bismo da je neslana šala, ali autentičnost dopisa koji je zamjenica splitskog općinskog državnog odvjetnika Nela Kustura uputila 14. ožujka ove godine na službenom memorandumu, s urudžbenim brojem, pečatom i potpisom na Marija Vrapca, zamjenika disciplinskog tužitelja Hrvatske odvjetničke komore, potvrdio nam je i osječki odvjetnik Alen Jakobović, disciplinski tužitelj.

Konsterniran

- Čim sam vidio dopis, ostao sam konsterniran i uvrijeđen. Naime, mi radimo na volonterskoj osnovi, pa je to tako bilo i u tom predmetu na koji se odnosi navedeni dopis. Zainteresirao sam se za predmet i ustanovio da je kolega uputio dopis o odbačaju prijave protiv kolege. Zbog ovakvog načina komuniciranja pripremam dopis općinskom državnom odvjetniku u Splitu i zatražit ću njegovo očitovanje jer se dosad nikad nismo susreli u praksi s tim da nam se na ovakav način obraćaju predstavnici državnih tijela i pravosudnih institucija.

Bilo je dopisa fizičkih osoba koje su bile nezadovoljne našim odbačajima prijava protiv kolega odvjetnika u kojima su se iznosile uvrede, ali nikad ovakvo što nismo dobili od tužitelja - kaže Jakobović. Ističe da disciplinske tužitelje bira Skupština odvjetnika Hrvatske i da su oni neovisni u svojim odlukama za koje ne odgovaraju predsjedniku HOK-a, nego isključivo Skupštini, i da su njihove odluke konačne.

O dopisu koji je splitska tužiteljica uputila HOK-u pitali smo i njezine nadređene. Dobili smo odgovor od Rene Laure, zamjenice ŽDO i glasnogovornice splitskog ŽDO-a.

"U odnosu na upit od 17. travnja 2023. iz sadržaja iz kojeg proizlazi da tražite obavijest o postupanju državnog odvjetništva u povodu dopisa zamjenice općinske državne odvjetnice u Splitu Nele Kustura od 14. ožujka 2023. upućenog Hrvatskoj odvjetničkoj komori u Zagrebu, ističem da Županijsko državno odvjetništvo u Splitu sukladno odredbama članka 87. Zakona o državnom odvjetništvu provodi postupak nadzora nad radom zamjenice u tom predmetu.

Po okončanju istog odlučit će se o daljnjem postupanju u odnosu na imenovanu zamjenicu", odgovorili su nam u ŽDO-u.

Apsurd za apsurdom

Kako smo doznali, do našeg upita nadređeni nisu ni znali za ovakav dopis koji je u pravosudnim krugovima izazvao čuđenje i konsternaciju. Nakon što je prošli tjedan u javnost izišao zapisnik o odgodi rasprave krčkog suca Antona Hlače koji je zbog "zlovolje" kad je dobio plaću za ožujak napisao da nije sposoban suditi, ovaj dopis splitske tužiteljice Nele Kustura još je jedan apsurd hrvatskog pravosuđa.

Splitski odvjetnik Mijo Jeličić na kojeg se odnosi navedeni dopis također je bio konsterniran kad je doznao za tužiteljičin dopis:

- Žalostan sam zbog činjenice što ljudi u državnom odvjetništvu, koji bi trebali štititi interese struke, tako postupaju i tako se odnose prema oštećenima i strankama u postupku - rekao nam je odvjetnik Jeličić. Ukratko, on je, kaže, samo na zakonit način štitio interese svoje stranke kojoj su bile nanesene teške tjelesne ozljede, a splitska tužiteljica optužila je dvojicu počinitelja za neizravnu namjeru i optuženici su potom pravomoćno kažnjeni uvjetnom osudom.

Sukladno vašoj odluci broj i datum gornji po disciplinskoj prijavi protiv Mije Jeličića, odvjetnika u Splitu, koristeći pravo slobode govora nazvat ću vas vrapcem za kojeg je za pravosuđe najbolje da noseći na krilima odvjetnika Miju Jeličića bespovratno odleti. U prilogu se dostavlja presuda Županijskog suda u Varaždinu broj: 19 Kž-590/2022-4 od 13. prosinca 2022. U potpisu zamjenik općinskog državnog odvjetnika Nela Kustura."

U prvom trenutku pomislili bismo da je neslana šala, ali autentičnost dopisa koji je zamjenica splitskog općinskog državnog odvjetnika Nela Kustura uputila 14. ožujka ove godine na službenom memorandumu, s urudžbenim brojem, pečatom i potpisom na Marija Vrapca, zamjenika disciplinskog tužitelja Hrvatske odvjetničke komore, potvrdio nam je i osječki odvjetnik Alen Jakobović, disciplinski tužitelj.

Konsterniran

- Čim sam vidio dopis, ostao sam konsterniran i uvrijeđen. Naime, mi radimo na volonterskoj osnovi, pa je to tako bilo i u tom predmetu na koji se odnosi navedeni dopis. Zainteresirao sam se za predmet i ustanovio da je kolega uputio dopis o odbačaju prijave protiv kolege. Zbog ovakvog načina komuniciranja pripremam dopis općinskom državnom odvjetniku u Splitu i zatražit ću njegovo očitovanje jer se dosad nikad nismo susreli u praksi s tim da nam se na ovakav način obraćaju predstavnici državnih tijela i pravosudnih institucija.

Bilo je dopisa fizičkih osoba koje su bile nezadovoljne našim odbačajima prijava protiv kolega odvjetnika u kojima su se iznosile uvrede, ali nikad ovakvo što nismo dobili od tužitelja - kaže Jakobović. Ističe da disciplinske tužitelje bira Skupština odvjetnika Hrvatske i da su oni neovisni u svojim odlukama za koje ne odgovaraju predsjedniku HOK-a, nego isključivo Skupštini, i da su njihove odluke konačne.

O dopisu koji je splitska tužiteljica uputila HOK-u pitali smo i njezine nadređene. Dobili smo odgovor od Rene Laure, zamjenice ŽDO i glasnogovornice splitskog ŽDO-a.

"U odnosu na upit od 17. travnja 2023. iz sadržaja iz kojeg proizlazi da tražite obavijest o postupanju državnog odvjetništva u povodu dopisa zamjenice općinske državne odvjetnice u Splitu Nele Kustura od 14. ožujka 2023. upućenog Hrvatskoj odvjetničkoj komori u Zagrebu, ističem da Županijsko državno odvjetništvo u Splitu sukladno odredbama članka 87. Zakona o državnom odvjetništvu provodi postupak nadzora nad radom zamjenice u tom predmetu.

Po okončanju istog odlučit će se o daljnjem postupanju u odnosu na imenovanu zamjenicu", odgovorili su nam u ŽDO-u.

Apsurd za apsurdom

Kako smo doznali, do našeg upita nadređeni nisu ni znali za ovakav dopis koji je u pravosudnim krugovima izazvao čuđenje i konsternaciju. Nakon što je prošli tjedan u javnost izišao zapisnik o odgodi rasprave krčkog suca Antona Hlače koji je zbog "zlovolje" kad je dobio plaću za ožujak napisao da nije sposoban suditi, ovaj dopis splitske tužiteljice Nele Kustura još je jedan apsurd hrvatskog pravosuđa.

Splitski odvjetnik Mijo Jeličić na kojeg se odnosi navedeni dopis također je bio konsterniran kad je doznao za tužiteljičin dopis:

- Žalostan sam zbog činjenice što ljudi u državnom odvjetništvu, koji bi trebali štititi interese struke, tako postupaju i tako se odnose prema oštećenima i strankama u postupku - rekao nam je odvjetnik Jeličić. Ukratko, on je, kaže, samo na zakonit način štitio interese svoje stranke kojoj su bile nanesene teške tjelesne ozljede, a splitska tužiteljica optužila je dvojicu počinitelja za neizravnu namjeru i optuženici su potom pravomoćno kažnjeni uvjetnom osudom.
