Odvjetničko društvo “Lubina i Čutura” ne smije ovršiti javnog gradskog prijevoznika “Promet” za glavnicu od 2.590.650 kuna (što bi po nekim procjenama s kamatama moglo dosezati 11,25 milijuna kuna, op.a.), iako posjeduje rješenje o ovrsi Općinskog suda iz 2017. godine!

Odlučio je tako u petak sudac Željko Borić s tog istog suda, donijevši nepravomoćnu presudu kojom je tu ovrhu proglasio – nedopuštenom!

Nastavak je to priče koja je krenula još 1993. godine, kada je tadašnji Nadzorni odbor “Prometa” odlučio da nakon isteka ugovora o najmu devet zglobnih autobusa marke Man, proizvedenih 1989. godine, njih neće otkupiti za 500 njemačkih maraka svaki, već da će ih nastaviti koristiti, a da za to slovenskoj tvrtki “A-Cosmos” neće plaćati najam.

“A-Cosmosu” je presudom Visokog trgovačkog suda iz prosinca 2015. godine za period od 1993. do 1998. godine pripalo 8.635.500 kuna, što je s kamatama naraslo na 37,5 milijuna kuna, a taj dug je od “Prometa” potom preuzeo Grad Split i u ratama ga isplatio Slovencima. Slovensku tvrtku je na u parnici na Trgovačkom sudu uspješno zastupao odvjetnik Željko Lubina, kojemu je po dogovoru s klijentom pripalo 30 posto dosuđenog višemilijunskog iznosa.

Odvjetničko društvo “Lubina i Čutura” je ovrhu zatražilo temeljem navedene presude Visokog trgovačkog suda, ugovora o zastupanju iz 1998. godine između Željka Lubine i “A-Cosmosa”, te ugovora iz 2016. kojim odvjetnik Lubina tu tražbinu ustupa odvjetničkom društvu kojem je suosnivač.

No, Općinski sud je u parnici koja je nepravomoćno okončana u petak utvrdio da je “A-Cosmos” već namiren za cijeli iznos od 37,5 milijuna kuna, o čemu je svjedočila Ljiljana Vučetić, koja je bila dugogodišnja šefica gradskih financija, pa je sud zaključio da Lubina prema “Prometu” nema tražbinu koju bi prenio na svoj odvjetnički ured.

Miroslav Delić, direktor gradskog prijevoznika, kaže da se ne zna koliki je ukupan iznos kojeg bi odvjetničko društvo skinulo s njihova računa da je uspjelo u sporu na Općinskom sudu, jer se nisu slagali od kada bi kamate trebalo obračunavati, te dodaje da odvjetnik Lubina tijekom dugogodišnje parnice na Trgovačkom sudu nije stalno zastupao “A-Cosmos” (kao suprotnu stranu koja je u prosincu 2015. godine pravomoćno dobila spor protiv gradskog prijevoznika zbog višegodišnjeg neosnovanog korištenje devet zglobnih autobusa marke MAN op.a).

No, sigurno je da bi taj iznos bio najmanje oko 5,5 milijuna kuna, jer upravo toliko novca je Fina ranije skinula s “Prometova” računa, ali ga nije proslijedila odvjetničkom društvu “Lubina i Čutura”, već ga je stavila na poseban račun do pravomoćnog okončanja parnice u kojoj prijevoznik traži da se ta ovrha proglasi nedopuštenom.

Dnevni penali - 2250 kuna

Delić kaže da je tih 5,5 milijuna kuna bio novac za plaće. “Promet” je sada na korak do toga da taj iznos dobije nazad.
Odvjetnik Lubina, osim što je zastupao “A-Cosmos”, od te slovenske tvrtke je 1998. godine preuzeo vlasništvo nad autobusima.
Iako prije nekoliko godina na Trgovačkom sudu nije uspio dokazati koliku bi mu “Promet” morao isplatiti naknadu za korištenje njegovih autobusa od 1998. godine, te u tom dijelu nije uspio u sporu, presuđeno je da mu gradski prijevoznik mora vratiti njegova vozila koja moraju biti u tehnički ispravnom stanju. Budući da gradski prijevoznik to ne može ispuniti jer je nemoguće naći zamjenske dijelove da bi se autobusi s točno određenim brojem šasije doveli u zadovoljavajuće stanje, svaki dan Željku Lubini plaća 2250 kuna penala.

- Pokrenuli smo postupak da se presuda Trgovačkog suda o povratu tehnički ispravnih autobusa s određenim brojem šasije proglasi neizvršivom, da se plaćanje penala ukine i da se taj problem riješi na neki drugi način – rekao nam je Delić.

Odvjetničko društvo “Lubina i Čutura” ne smije ovršiti javnog gradskog prijevoznika “Promet” za glavnicu od 2.590.650 kuna (što bi po nekim procjenama s kamatama moglo dosezati 11,25 milijuna kuna, op.a.), iako posjeduje rješenje o ovrsi Općinskog suda iz 2017. godine!

Odlučio je tako u petak sudac Željko Borić s tog istog suda, donijevši nepravomoćnu presudu kojom je tu ovrhu proglasio – nedopuštenom!

Nastavak je to priče koja je krenula još 1993. godine, kada je tadašnji Nadzorni odbor “Prometa” odlučio da nakon isteka ugovora o najmu devet zglobnih autobusa marke Man, proizvedenih 1989. godine, njih neće otkupiti za 500 njemačkih maraka svaki, već da će ih nastaviti koristiti, a da za to slovenskoj tvrtki “A-Cosmos” neće plaćati najam.

“A-Cosmosu” je presudom Visokog trgovačkog suda iz prosinca 2015. godine za period od 1993. do 1998. godine pripalo 8.635.500 kuna, što je s kamatama naraslo na 37,5 milijuna kuna, a taj dug je od “Prometa” potom preuzeo Grad Split i u ratama ga isplatio Slovencima. Slovensku tvrtku je na u parnici na Trgovačkom sudu uspješno zastupao odvjetnik Željko Lubina, kojemu je po dogovoru s klijentom pripalo 30 posto dosuđenog višemilijunskog iznosa.

Odvjetničko društvo “Lubina i Čutura” je ovrhu zatražilo temeljem navedene presude Visokog trgovačkog suda, ugovora o zastupanju iz 1998. godine između Željka Lubine i “A-Cosmosa”, te ugovora iz 2016. kojim odvjetnik Lubina tu tražbinu ustupa odvjetničkom društvu kojem je suosnivač.

No, Općinski sud je u parnici koja je nepravomoćno okončana u petak utvrdio da je “A-Cosmos” već namiren za cijeli iznos od 37,5 milijuna kuna, o čemu je svjedočila Ljiljana Vučetić, koja je bila dugogodišnja šefica gradskih financija, pa je sud zaključio da Lubina prema “Prometu” nema tražbinu koju bi prenio na svoj odvjetnički ured.

Miroslav Delić, direktor gradskog prijevoznika, kaže da se ne zna koliki je ukupan iznos kojeg bi odvjetničko društvo skinulo s njihova računa da je uspjelo u sporu na Općinskom sudu, jer se nisu slagali od kada bi kamate trebalo obračunavati, te dodaje da odvjetnik Lubina tijekom dugogodišnje parnice na Trgovačkom sudu nije stalno zastupao “A-Cosmos” (kao suprotnu stranu koja je u prosincu 2015. godine pravomoćno dobila spor protiv gradskog prijevoznika zbog višegodišnjeg neosnovanog korištenje devet zglobnih autobusa marke MAN op.a).

No, sigurno je da bi taj iznos bio najmanje oko 5,5 milijuna kuna, jer upravo toliko novca je Fina ranije skinula s “Prometova” računa, ali ga nije proslijedila odvjetničkom društvu “Lubina i Čutura”, već ga je stavila na poseban račun do pravomoćnog okončanja parnice u kojoj prijevoznik traži da se ta ovrha proglasi nedopuštenom.

Dnevni penali - 2250 kuna

Delić kaže da je tih 5,5 milijuna kuna bio novac za plaće. “Promet” je sada na korak do toga da taj iznos dobije nazad.
Odvjetnik Lubina, osim što je zastupao “A-Cosmos”, od te slovenske tvrtke je 1998. godine preuzeo vlasništvo nad autobusima.
Iako prije nekoliko godina na Trgovačkom sudu nije uspio dokazati koliku bi mu “Promet” morao isplatiti naknadu za korištenje njegovih autobusa od 1998. godine, te u tom dijelu nije uspio u sporu, presuđeno je da mu gradski prijevoznik mora vratiti njegova vozila koja moraju biti u tehnički ispravnom stanju. Budući da gradski prijevoznik to ne može ispuniti jer je nemoguće naći zamjenske dijelove da bi se autobusi s točno određenim brojem šasije doveli u zadovoljavajuće stanje, svaki dan Željku Lubini plaća 2250 kuna penala.

- Pokrenuli smo postupak da se presuda Trgovačkog suda o povratu tehnički ispravnih autobusa s određenim brojem šasije proglasi neizvršivom, da se plaćanje penala ukine i da se taj problem riješi na neki drugi način – rekao nam je Delić.

Presuđeno da je ovrha nad javnim prijevoznikom - nedopuštena: odvjetnik Lubina nije smio s ‘Prometovog’ računa ‘pomesti’ čak 5,5 milijuna kuna!

Odvjetničko društvo “Lubina i Čutura” ne smije ovršiti javnog gradskog prijevoznika “Promet” za glavnicu od 2.590.650 kuna (što bi po nekim procjenama s kamatama moglo dosezati 11,25 milijuna kuna, op.a.), iako posjeduje rješenje o ovrsi Općinskog suda iz 2017. godine!

Odlučio je tako u petak sudac Željko Borić s tog istog suda, donijevši nepravomoćnu presudu kojom je tu ovrhu proglasio – nedopuštenom!

Nastavak je to priče koja je krenula još 1993. godine, kada je tadašnji Nadzorni odbor “Prometa” odlučio da nakon isteka ugovora o najmu devet zglobnih autobusa marke Man, proizvedenih 1989. godine, njih neće otkupiti za 500 njemačkih maraka svaki, već da će ih nastaviti koristiti, a da za to slovenskoj tvrtki “A-Cosmos” neće plaćati najam.
