U Splitu je najaktualnija tema najavljena ostavka gradonačelnika Ivice Puljka i njegovog zamjenika Bojana Ivoševića, kao i uloga dogradonačelnika Antonija Kuzmanića. Odnosno može li on nakon ostavke Puljka i Ivoševića ostati na čelu grada ili ne. 

Ministarstvo pravosuđa i uprave, potaknuto brojnim medijskim upitima oko potencijalne ostavke gradonačelnika Puljka i zamjenika Ivoševića, poslalo je priopćenje.

Ističu kako članak 40.d Zakona o lokalnoj i područnoj (regionalnoj) samoupravi jasno definira posljedice takvog prestanka mandata općinskog načelnika, gradonačelnika, odnosno župana. 

- Valja naglasiti kako Ministarstvo pravosuđa i uprave dosad nije zaprimilo najavljene ostavke gradonačelnika Grada Splita i zamjenika gradonačelnika Grada Splita. Podsjećamo isto tako da je zakonska obveza pročelnika upravnog tijela grada nadležnog za službeničke odnose da bez odgode obavijesti Ministarstvo o svim promjenama tijekom mandata gradonačelnika i njegovog zamjenika - objašnjavaju iz Ministarstva pravosuđa i uprave.

Dodaju da je to jasno naznačeno i u službenom odgovoru Ministarstva koji je nastavno na službeni upit, u ponedjeljak 4. travnja poslan u Grad Split.

- Ministarstvo je utvrdilo kako bi u hipotetskoj situaciji ostavke dvaju dužnosnika u Splitu bilo riječ o prestanku mandata gradonačelnika te njegovog zamjenika koji je na kandidaturi bio naveden prvi iza kandidata za gradonačelnika, prije isteka dvije godine mandata. Takva situacija regulirana je člankom 40.d (stavci 2, 3, 4 i 6), Zakona o lokalnoj i područnoj (regionalnoj) samoupravi te bi predviđala da do provedbe privremenih izbora dužnost obavlja povjerenik Vlade RH.

Važno je naglasiti da zakon ne propisuje mogućnost da tzv. drugi zamjenik počne obnašati dužnost gradonačelnika te bi se prijevremeni izbori u takvoj situaciji morali raspisati čak i nakon proteka dvije godine mandata.

Mišljenje Ministarstva pravosuđa i uprave, stručnih službi, navode, bazirano je isključivo na odredbama Zakona o lokalnoj i područnoj (regionalnoj) samoupravi koje uređuju pitanja vezana uz obavljanje dužnosti izvršnog tijela u jedinicama lokalne i područne (regionalne) samouprave.

Ističu da je pritom je riječ o cjelovitom pristupu, a ne paušalnom tumačenju dijela odredbi koja uređuju navedeno područje.

- Podsjećamo da bi u slučaju eventualnog prestanka mandata gradonačelnika Grada Splita, došlo do prestanka mandata gradonačelnika prije isteka dvije godine mandata, stoga bi se u tom slučaju raspisali prijevremeni izbori za gradonačelnika, ali i njegove zamjenike.

Imenovanje Povjerenika Vlade u jedinicama lokalne i područne (regionalne) samouprave je zakonom propisani postupak. Povjerenik Vlade RH ima ovlasti tek "tehničkog" upravljanja, osiguravajući funkcioniranje i izvršavanje redovnih službi grada. Riječ je o privremenoj funkciji, a zakon propisuje da potencijalni povjerenik mora imati visoku ili višu stručnu spremu, nije osuđivan te se protiv njega ne smije voditi kazneni postupak - za kraj su poručili iz Ministarstva pravosuđa i uprave.

Podsjetimo, na listi za lokalne izbore, prvi zamjenik je bio Bojan Ivošević, što znači da bi on, a ne Antonio Kuzmanić, po tumačenju Ministarstva mogao biti povjerenik.

U Splitu je najaktualnija tema najavljena ostavka gradonačelnika Ivice Puljka i njegovog zamjenika Bojana Ivoševića, kao i uloga dogradonačelnika Antonija Kuzmanića. Odnosno može li on nakon ostavke Puljka i Ivoševića ostati na čelu grada ili ne. 

Ministarstvo pravosuđa i uprave, potaknuto brojnim medijskim upitima oko potencijalne ostavke gradonačelnika Puljka i zamjenika Ivoševića, poslalo je priopćenje.

Ističu kako članak 40.d Zakona o lokalnoj i područnoj (regionalnoj) samoupravi jasno definira posljedice takvog prestanka mandata općinskog načelnika, gradonačelnika, odnosno župana. 

- Valja naglasiti kako Ministarstvo pravosuđa i uprave dosad nije zaprimilo najavljene ostavke gradonačelnika Grada Splita i zamjenika gradonačelnika Grada Splita. Podsjećamo isto tako da je zakonska obveza pročelnika upravnog tijela grada nadležnog za službeničke odnose da bez odgode obavijesti Ministarstvo o svim promjenama tijekom mandata gradonačelnika i njegovog zamjenika - objašnjavaju iz Ministarstva pravosuđa i uprave.

Dodaju da je to jasno naznačeno i u službenom odgovoru Ministarstva koji je nastavno na službeni upit, u ponedjeljak 4. travnja poslan u Grad Split.

- Ministarstvo je utvrdilo kako bi u hipotetskoj situaciji ostavke dvaju dužnosnika u Splitu bilo riječ o prestanku mandata gradonačelnika te njegovog zamjenika koji je na kandidaturi bio naveden prvi iza kandidata za gradonačelnika, prije isteka dvije godine mandata. Takva situacija regulirana je člankom 40.d (stavci 2, 3, 4 i 6), Zakona o lokalnoj i područnoj (regionalnoj) samoupravi te bi predviđala da do provedbe privremenih izbora dužnost obavlja povjerenik Vlade RH.

Važno je naglasiti da zakon ne propisuje mogućnost da tzv. drugi zamjenik počne obnašati dužnost gradonačelnika te bi se prijevremeni izbori u takvoj situaciji morali raspisati čak i nakon proteka dvije godine mandata.

Mišljenje Ministarstva pravosuđa i uprave, stručnih službi, navode, bazirano je isključivo na odredbama Zakona o lokalnoj i područnoj (regionalnoj) samoupravi koje uređuju pitanja vezana uz obavljanje dužnosti izvršnog tijela u jedinicama lokalne i područne (regionalne) samouprave.

Ističu da je pritom je riječ o cjelovitom pristupu, a ne paušalnom tumačenju dijela odredbi koja uređuju navedeno područje.

- Podsjećamo da bi u slučaju eventualnog prestanka mandata gradonačelnika Grada Splita, došlo do prestanka mandata gradonačelnika prije isteka dvije godine mandata, stoga bi se u tom slučaju raspisali prijevremeni izbori za gradonačelnika, ali i njegove zamjenike.

Imenovanje Povjerenika Vlade u jedinicama lokalne i područne (regionalne) samouprave je zakonom propisani postupak. Povjerenik Vlade RH ima ovlasti tek "tehničkog" upravljanja, osiguravajući funkcioniranje i izvršavanje redovnih službi grada. Riječ je o privremenoj funkciji, a zakon propisuje da potencijalni povjerenik mora imati visoku ili višu stručnu spremu, nije osuđivan te se protiv njega ne smije voditi kazneni postupak - za kraj su poručili iz Ministarstva pravosuđa i uprave.

Podsjetimo, na listi za lokalne izbore, prvi zamjenik je bio Bojan Ivošević, što znači da bi on, a ne Antonio Kuzmanić, po tumačenju Ministarstva mogao biti povjerenik.
