Ne jedan, već nekoliko sudskih sporova od 2013. godine pokrenuo je Grad Split kako bi pokušao naplatiti 9,4 milijuna kuna kamata, koje je obračunao na 47,3 milijuna kuna komunalnog doprinosa koje je tvrtka "Mejaši prvi" platila za trgovački centar Mall of Split. Grad je sve sporove izgubio.
Kaže nam to Kristijan Gelo, direktor trgovačkog centra i "Mejaša prvih", nakon izjave gradonačelnika Ivice Puljka da je presudom Visokog upravnog suda pravomoćno odbijen tužbeni zahtjev Grada protiv tvrtke "Mejaši prvi", radi naplate 9,4 milijuna kuna na ime kamata na zakašnjelo plaćanje komunalnog doprinosa.
Gelo se prisjeća da se spor oko kamata prvo vodio na Općinskom sudu u Splitu. Zatim na Trgovačkom sudu. Nakon toga pred Splitsko-dalmatinskom županijom, te na Upravnom i Visokom upravnom sudu. Baš svi su, kaže, presudili u korist "Mejaša prvih".
- Predmeti Grada Splita su kao taksimetri jer nevezano jesu li dobili ili izgubili spor, privatna odvjetnička društva koja zastupaju Banovinu naplate svoju tarifu, a odvjetnicima je u interesu da iznos tužbe bude što veći kako bi i njihova naknada bila što veća – kaže Kristijan Gelo.

Naglašava da su u zadnjim predmetima koji su se vodili protiv "Mejaša prvih", Grad Split zastupali upravo odvjetnici, a ne pravnici iz Banovine.
Uz to, napominje Kristijan Gelo, za svaki od tih sporova koje je Grad Split izgubio, Banovina je i njegovom odvjetniku morala platiti troškove u iznosu koji su se već popeli na nekoliko stotina tisuća kuna.
- To govorim jer me je Grad ponovo tužio u mandatu gradonačelnika Andre Krstulovića Opare i vjerujem da će ponovo izgubiti spor. Od "Mejaša prvih" traže naknadu štete koja Gradu uopće nije nastala, a radi neispunjenja ugovora koji nikad nije stupio na snagu iz jednostavnog razloga što nije konzumiran s niti jedne strane.
- U svakom slučaju tu se radi o nečemu što je otišlo u apsolutnu zastaru i znaju da to ne mogu dobiti. Mislim da se radi o osvetničkom pohodu zbog izgubljenih parnica, a kako je vrijednost spora preko 20 milijuna kuna, tako će ponovo biti dobra odvjetnička naknada – rekao nam je Kristijan Gelo.

Ističe da je pisao gradonačelniku Ivici Puljku i njegovom zamjeniku Bojanu Ivoševiću kako bi im skrenuo pozornost na dosadašnju praksu trošenja novca iz gradske blagajne.
- Nisam još dobio odgovor. Zamolio sam ih za sastanak.
Gelo nastavlja da mu nije jasan stav ranijih gradskih vlasti koje se nisu htjele dogovoriti sa strankama, već bez pokušaja mirnog rješenja spora pokreću sudske postupke koji Gradu stvaraju nove troškove.
-Ti dogovori se mogu održati uz prisustvo državnog odvjetnika kako bi nagodba bila potpuno transparentna. S duge strane, ako Grad već podnosi tužbe, neka se onda zna tko je iz gradskih službi donio takvu odluku i neka za to odgovara, kao što sam ja odgovoran svojim investitorima. Kad bi radio kao što radi Grad i potom izgubio takve sporove, momentalno bih dobio otkaz, jer to nije profesionalno i tako se ne posluje.
- Nadam se da ova gradska vlast ima više sluha za dogovorna rješenja - dodaje.

Ostaje nejasno kako je Grad za jedan te isti slučaj uspio pokrenuti više različitih sporova, posebno ako je prethodno drugi sud okončao postupak, pa smo o tome upitali Gelu:
- To ne znam. Samo znam da je mjesec dana nakon što su "Mejaši prvi" platili komunalni doprinos, Grad poslao rješenje da platimo oko 33 tisuće kuna kamata, što sam odbio. Onda sam od Grada dobio drugo rješenje za kamate na oko 110.000 kuna, pa sam i to odbio. Na kraju sam dobio rješenje po kojem moram platiti 9,4 milijun kuna i na svim sudskim instancama Grad je izgubio spor protiv "Mejaša prvih" koje zastupa odvjetnik Mladen Parčina.
Gradonačelnik Puljak je, podsjetimo, najavio da će u slučaju s kamatama podnijet ustavnu tužbu.
- Isto tako ćemo preispitati sve dionike tog procesa i ako bude naznaka da postoje neke stvari koje nisu bile u skladu sa zakonom, o tome ćemo obavijestiti institucije – rekao je Puljak.
- Nemam ništa protiv toga da se taj slučaj još jednom preispita, ali neka se pri tome preispita i rad djelatnika gradskih službi koji svojim nezakonitim radom nanose štetu investitoru i Gradu, a koji trošak plaćaju građani Splita. Što se tiče ustavne tužbe, činjenica je da je Grad Split u ovakvim predmetima prema drugim investitorima postupao drugačije i ako su kome povrijeđena ustavna prava to su upravo "Mejašima prvim" - za kraj će Gelo.

Ne jedan, već nekoliko sudskih sporova od 2013. godine pokrenuo je Grad Split kako bi pokušao naplatiti 9,4 milijuna kuna kamata, koje je obračunao na 47,3 milijuna kuna komunalnog doprinosa koje je tvrtka "Mejaši prvi" platila za trgovački centar Mall of Split. Grad je sve sporove izgubio.
Kaže nam to Kristijan Gelo, direktor trgovačkog centra i "Mejaša prvih", nakon izjave gradonačelnika Ivice Puljka da je presudom Visokog upravnog suda pravomoćno odbijen tužbeni zahtjev Grada protiv tvrtke "Mejaši prvi", radi naplate 9,4 milijuna kuna na ime kamata na zakašnjelo plaćanje komunalnog doprinosa.
Gelo se prisjeća da se spor oko kamata prvo vodio na Općinskom sudu u Splitu. Zatim na Trgovačkom sudu. Nakon toga pred Splitsko-dalmatinskom županijom, te na Upravnom i Visokom upravnom sudu. Baš svi su, kaže, presudili u korist "Mejaša prvih".
- Predmeti Grada Splita su kao taksimetri jer nevezano jesu li dobili ili izgubili spor, privatna odvjetnička društva koja zastupaju Banovinu naplate svoju tarifu, a odvjetnicima je u interesu da iznos tužbe bude što veći kako bi i njihova naknada bila što veća – kaže Kristijan Gelo.

Naglašava da su u zadnjim predmetima koji su se vodili protiv "Mejaša prvih", Grad Split zastupali upravo odvjetnici, a ne pravnici iz Banovine.
Uz to, napominje Kristijan Gelo, za svaki od tih sporova koje je Grad Split izgubio, Banovina je i njegovom odvjetniku morala platiti troškove u iznosu koji su se već popeli na nekoliko stotina tisuća kuna.
- To govorim jer me je Grad ponovo tužio u mandatu gradonačelnika Andre Krstulovića Opare i vjerujem da će ponovo izgubiti spor. Od "Mejaša prvih" traže naknadu štete koja Gradu uopće nije nastala, a radi neispunjenja ugovora koji nikad nije stupio na snagu iz jednostavnog razloga što nije konzumiran s niti jedne strane.
- U svakom slučaju tu se radi o nečemu što je otišlo u apsolutnu zastaru i znaju da to ne mogu dobiti. Mislim da se radi o osvetničkom pohodu zbog izgubljenih parnica, a kako je vrijednost spora preko 20 milijuna kuna, tako će ponovo biti dobra odvjetnička naknada – rekao nam je Kristijan Gelo.

Ističe da je pisao gradonačelniku Ivici Puljku i njegovom zamjeniku Bojanu Ivoševiću kako bi im skrenuo pozornost na dosadašnju praksu trošenja novca iz gradske blagajne.
- Nisam još dobio odgovor. Zamolio sam ih za sastanak.
Gelo nastavlja da mu nije jasan stav ranijih gradskih vlasti koje se nisu htjele dogovoriti sa strankama, već bez pokušaja mirnog rješenja spora pokreću sudske postupke koji Gradu stvaraju nove troškove.
-Ti dogovori se mogu održati uz prisustvo državnog odvjetnika kako bi nagodba bila potpuno transparentna. S duge strane, ako Grad već podnosi tužbe, neka se onda zna tko je iz gradskih službi donio takvu odluku i neka za to odgovara, kao što sam ja odgovoran svojim investitorima. Kad bi radio kao što radi Grad i potom izgubio takve sporove, momentalno bih dobio otkaz, jer to nije profesionalno i tako se ne posluje.
- Nadam se da ova gradska vlast ima više sluha za dogovorna rješenja - dodaje.

Ostaje nejasno kako je Grad za jedan te isti slučaj uspio pokrenuti više različitih sporova, posebno ako je prethodno drugi sud okončao postupak, pa smo o tome upitali Gelu:
- To ne znam. Samo znam da je mjesec dana nakon što su "Mejaši prvi" platili komunalni doprinos, Grad poslao rješenje da platimo oko 33 tisuće kuna kamata, što sam odbio. Onda sam od Grada dobio drugo rješenje za kamate na oko 110.000 kuna, pa sam i to odbio. Na kraju sam dobio rješenje po kojem moram platiti 9,4 milijun kuna i na svim sudskim instancama Grad je izgubio spor protiv "Mejaša prvih" koje zastupa odvjetnik Mladen Parčina.
Gradonačelnik Puljak je, podsjetimo, najavio da će u slučaju s kamatama podnijet ustavnu tužbu.
- Isto tako ćemo preispitati sve dionike tog procesa i ako bude naznaka da postoje neke stvari koje nisu bile u skladu sa zakonom, o tome ćemo obavijestiti institucije – rekao je Puljak.
- Nemam ništa protiv toga da se taj slučaj još jednom preispita, ali neka se pri tome preispita i rad djelatnika gradskih službi koji svojim nezakonitim radom nanose štetu investitoru i Gradu, a koji trošak plaćaju građani Splita. Što se tiče ustavne tužbe, činjenica je da je Grad Split u ovakvim predmetima prema drugim investitorima postupao drugačije i ako su kome povrijeđena ustavna prava to su upravo "Mejašima prvim" - za kraj će Gelo.
