Podignuta je optužnica protiv splitskog dogradonačelnika Bojana Ivoševića (32) zbog prijetnji urednici Gradske rubrike Slobodne Dalmacije. Kako je navedeno u priopćenju Općinskog državnog odvjetništva u Splitu, nakon provedenog istraživanja podignuli su optužnicu zbog počinjenog kaznenog djela prijetnje iz članka 139. stavak 3. Kaznenog zakona.

Bojanu Ivoševiću stavlja se na teret da je 6. veljače 2022. godine, oko 19.30, u Splitu putem mobilnog telefona nazvao urednicu gradske rubrike te joj je, u cilju da izazove osjećaj straha i uznemirenosti, uputio prijeteće riječi. U optužnici stoji kako je bio nezadovoljan sadržajem članaka objavljenih na portalu i u tom dnevnom listu koji su se odnosili na njega i njegov rad na dužnosti dogradonačelnika, kao i u odnosu na članove njegove obitelji. Osnovano se sumnja da je novinarka njegove riječi prenijela svojoj kolegici (novinarki), a zatim glavnoj urednici tog dnevnog lista, kao i izvršnoj urednici portala, koje su kod svih njih izazvale osjećaj straha i uznemirenosti, navodi se u optužnici.

Ivošević je našoj urednici kazao kako će se redakciji "napiti krvi" zbog navoda objavljenih u tekstovima u Slobodnoj Dalmaciji, a kojima nije bio zadovoljan. Nazvao ju je u nedjelju navečer, odmah nakon objavljivanja tekstova o sadnji stabala na Marjanu tog dana. Tijekom istražne faze postupka, na Općinskom državnom odvjetništvu u Splitu saslušan je dogradonačelnik Ivošević, zatim urednica Gradske rubrike te ostale kolegice koje su imale direktna saznanja o zbivanjima te nedjelje.

Radi se o kaznenom djelu kad su prijetnje upućene osobi zbog posla koji obavlja, između ostalog i prema novinaru. Progoni se po službenoj dužnosti, za razliku od tzv. običnih prijetnji, kad osoba mora podnijeti prijedlog za kazneni progon. Osim novinara, takvo nedjelo može se počiniti i prema odvjetnicima ili bilo kojoj osobi u tijelima službene i javne vlasti. Procesuira se svaka osoba koja prijeti kakvim zlom da bi ustrašila ili uznemirila osobe u obavljanju njihova posla. Za navedeno kazneno djelo zapriječena je zatvorska kazna od šest mjeseci do tri godine zatvora.

Nakon što se u javnosti doznalo za njegovo ponašanje i riječi, Ivošević se javno ispričao i kazao kako će ići na radionice radi poboljšanja komunikacije.

U međuvremenu je policija pokrenula izvide i o svemu je obaviješteno Državno odvjetništvo, koje je krenulo u istražne radnje. To je bila faza kad se tek utvrđivalo je li počinjeno kazneno djelo te se u javnosti uglavnom govorilo o neprimjerenoj komunikaciji. Sada je situacija ozbiljnija jer se radi o kaznenom postupku. Podignuta optužnica znači kako tužiteljstvo smatra da postoje dokazi da je osoba počinila kazneno djelo i da je nužno provesti suđenje kako bi se utvrdila krivnja i odredila kazna.

Optužnica je nepravomoćna, na nju Ivošević ima pravo žalbe, o kojoj onda odlučuje tročlano vijeće Općinskog suda u Splitu. Optužnicu vijeće može potvrditi, što znači da spis ide raspravnom sucu koji će provesti suđenje. Vijeće isto tako može donijeti odluku da se optužni akt vrati na doradu Državnom odvjetništvu ili se može potpuno odbaciti kao neosnovan.

U sva tri slučaja odluka se mora obrazložiti. Same prijetnje osudilo je i Hrvatsko novinarsko društvo, koje je upozorilo na to da su novinari stalno izloženi pritiscima od strane političara.

Podignuta je optužnica protiv splitskog dogradonačelnika Bojana Ivoševića (32) zbog prijetnji urednici Gradske rubrike Slobodne Dalmacije. Kako je navedeno u priopćenju Općinskog državnog odvjetništva u Splitu, nakon provedenog istraživanja podignuli su optužnicu zbog počinjenog kaznenog djela prijetnje iz članka 139. stavak 3. Kaznenog zakona.

Bojanu Ivoševiću stavlja se na teret da je 6. veljače 2022. godine, oko 19.30, u Splitu putem mobilnog telefona nazvao urednicu gradske rubrike te joj je, u cilju da izazove osjećaj straha i uznemirenosti, uputio prijeteće riječi. U optužnici stoji kako je bio nezadovoljan sadržajem članaka objavljenih na portalu i u tom dnevnom listu koji su se odnosili na njega i njegov rad na dužnosti dogradonačelnika, kao i u odnosu na članove njegove obitelji. Osnovano se sumnja da je novinarka njegove riječi prenijela svojoj kolegici (novinarki), a zatim glavnoj urednici tog dnevnog lista, kao i izvršnoj urednici portala, koje su kod svih njih izazvale osjećaj straha i uznemirenosti, navodi se u optužnici.

Ivošević je našoj urednici kazao kako će se redakciji "napiti krvi" zbog navoda objavljenih u tekstovima u Slobodnoj Dalmaciji, a kojima nije bio zadovoljan. Nazvao ju je u nedjelju navečer, odmah nakon objavljivanja tekstova o sadnji stabala na Marjanu tog dana. Tijekom istražne faze postupka, na Općinskom državnom odvjetništvu u Splitu saslušan je dogradonačelnik Ivošević, zatim urednica Gradske rubrike te ostale kolegice koje su imale direktna saznanja o zbivanjima te nedjelje.

Radi se o kaznenom djelu kad su prijetnje upućene osobi zbog posla koji obavlja, između ostalog i prema novinaru. Progoni se po službenoj dužnosti, za razliku od tzv. običnih prijetnji, kad osoba mora podnijeti prijedlog za kazneni progon. Osim novinara, takvo nedjelo može se počiniti i prema odvjetnicima ili bilo kojoj osobi u tijelima službene i javne vlasti. Procesuira se svaka osoba koja prijeti kakvim zlom da bi ustrašila ili uznemirila osobe u obavljanju njihova posla. Za navedeno kazneno djelo zapriječena je zatvorska kazna od šest mjeseci do tri godine zatvora.

Nakon što se u javnosti doznalo za njegovo ponašanje i riječi, Ivošević se javno ispričao i kazao kako će ići na radionice radi poboljšanja komunikacije.

U međuvremenu je policija pokrenula izvide i o svemu je obaviješteno Državno odvjetništvo, koje je krenulo u istražne radnje. To je bila faza kad se tek utvrđivalo je li počinjeno kazneno djelo te se u javnosti uglavnom govorilo o neprimjerenoj komunikaciji. Sada je situacija ozbiljnija jer se radi o kaznenom postupku. Podignuta optužnica znači kako tužiteljstvo smatra da postoje dokazi da je osoba počinila kazneno djelo i da je nužno provesti suđenje kako bi se utvrdila krivnja i odredila kazna.

Optužnica je nepravomoćna, na nju Ivošević ima pravo žalbe, o kojoj onda odlučuje tročlano vijeće Općinskog suda u Splitu. Optužnicu vijeće može potvrditi, što znači da spis ide raspravnom sucu koji će provesti suđenje. Vijeće isto tako može donijeti odluku da se optužni akt vrati na doradu Državnom odvjetništvu ili se može potpuno odbaciti kao neosnovan.

U sva tri slučaja odluka se mora obrazložiti. Same prijetnje osudilo je i Hrvatsko novinarsko društvo, koje je upozorilo na to da su novinari stalno izloženi pritiscima od strane političara.

Ivoševićeva situacija postaje znatno ozbiljnija: optužen je za kazneno djelo za koje prijeti do pet godina zatvora, a goni se po službenoj dužnosti

Podignuta je optužnica protiv splitskog dogradonačelnika Bojana Ivoševića (32) zbog prijetnji urednici Gradske rubrike Slobodne Dalmacije. Kako je navedeno u priopćenju Općinskog državnog odvjetništva u Splitu, nakon provedenog istraživanja podignuli su optužnicu zbog počinjenog kaznenog djela prijetnje iz članka 139. stavak 3. Kaznenog zakona.

Bojanu Ivoševiću stavlja se na teret da je 6. veljače 2022. godine, oko 19.30, u Splitu putem mobilnog telefona nazvao urednicu gradske rubrike te joj je, u cilju da izazove osjećaj straha i uznemirenosti, uputio prijeteće riječi. U optužnici stoji kako je bio nezadovoljan sadržajem članaka objavljenih na portalu i u tom dnevnom listu koji su se odnosili na njega i njegov rad na dužnosti dogradonačelnika, kao i u odnosu na članove njeg...
