Zanimljiv slučaj pokrenuo je početkom prošle godine Državni inspektorat, koji je nekoliko dana nakon uvođenja eura u jednom objektu brze prehrane u splitskom trgovačkom centru ‘City Center One‘ utvrdio povećanje cijena i do 46 posto. Radi se o objektu u vlasništvu tvrtke ‘Brilliant Wok‘ vlasnika Yun Honga, koja je zbog svega završila na Općinskom prekršajnom sudu u Splitu.
Tijekom inspekcijskog nadzora, provedenog 7. siječnja 2023. godine u restoranu Chinese Food, utvrđeno je značajno poskupljenje nekih proizvoda. Najviše je poskupjela salata od piletine, čija je cijena sa 17 kuna uvođenjem eura skočila na 3,30 eura, odnosno 24,86 kune. Bami zapečeni rezanci s jajima skočili su tako sa 4,78 na 5,30 eura, happy wok menu sa 9,29 na 12 eura, piletina s curryjem sa 7,43 na 8 eura...

No, sud je u ovom slučaju donio oslobađajuću presudu jer, kako navode u presudi, u okolnostima konkretnog predmeta smatraju da povećanje cijena samo po sebi ne predstavlja nedopušten utjecaj na potrošača za koji je vjerojatno da će ga navesti da donese odluku o kupnji koju inače ne bi donio.

- Drugačije rečeno, prema shvaćanju suda, ne može se tvrditi da potrošač odluku o kupnji vjerojatno ne bi donio da nije bilo sporne poslovne prakse, tj. da ga je upravo povećanje cijena navelo da donese odluku o kupnji, što bi bilo jedno od razlikovnih obilježja agresivne poslovne prakse, u odnosu na onu dopuštenu, sve u smislu definicije iz članka 38. Zakona o zaštiti potrošača - stoji u presudi.

Kažu i da, prema shvaćanju suda, uvođenje eura nije ona ‘nesretna ili druga okolnost’ kakvu u vidu ima odredba članka 39. točke 3. Zakona o zaštiti potrošača, koja bi bila tolikog značenja da je mogla umanjiti sposobnost potrošača da razumno rasuđuje.
- Naime, promjena službene valute, pored pripremnih radnji koje su obavljene prije uvođenja eura i na samom početku njegove uporabe, nije takva okolnost koja bi mogla umanjiti sposobnost prosječnog potrošača da razumno rasuđuje i da primijeti povećanje cijena, pogotovo kod obveze dvojnog iskazivanja cijena prije i nakon 1. siječnja 2023. - obrazlažu.
- Neopravdano povećanje cijena i dovođenje potrošača u nepovoljniji financijski položaj predstavlja kršenje načela iz članka 7. stavka 2. i članka 8. Zakona o uvođenju eura kao službene valute u Republici Hrvatskoj, ali to nisu bitna obilježja nepoštene poslovne prakse u smislu članaka 34. do 40. Zakona o zaštiti potrošača - zaključili su na splitskom Općinskom prekršajnom sudu.

Zanimljiv slučaj pokrenuo je početkom prošle godine Državni inspektorat, koji je nekoliko dana nakon uvođenja eura u jednom objektu brze prehrane u splitskom trgovačkom centru ‘City Center One‘ utvrdio povećanje cijena i do 46 posto. Radi se o objektu u vlasništvu tvrtke ‘Brilliant Wok‘ vlasnika Yun Honga, koja je zbog svega završila na Općinskom prekršajnom sudu u Splitu.
Tijekom inspekcijskog nadzora, provedenog 7. siječnja 2023. godine u restoranu Chinese Food, utvrđeno je značajno poskupljenje nekih proizvoda. Najviše je poskupjela salata od piletine, čija je cijena sa 17 kuna uvođenjem eura skočila na 3,30 eura, odnosno 24,86 kune. Bami zapečeni rezanci s jajima skočili su tako sa 4,78 na 5,30 eura, happy wok menu sa 9,29 na 12 eura, piletina s curryjem sa 7,43 na 8 eura...

No, sud je u ovom slučaju donio oslobađajuću presudu jer, kako navode u presudi, u okolnostima konkretnog predmeta smatraju da povećanje cijena samo po sebi ne predstavlja nedopušten utjecaj na potrošača za koji je vjerojatno da će ga navesti da donese odluku o kupnji koju inače ne bi donio.

- Drugačije rečeno, prema shvaćanju suda, ne može se tvrditi da potrošač odluku o kupnji vjerojatno ne bi donio da nije bilo sporne poslovne prakse, tj. da ga je upravo povećanje cijena navelo da donese odluku o kupnji, što bi bilo jedno od razlikovnih obilježja agresivne poslovne prakse, u odnosu na onu dopuštenu, sve u smislu definicije iz članka 38. Zakona o zaštiti potrošača - stoji u presudi.

Kažu i da, prema shvaćanju suda, uvođenje eura nije ona ‘nesretna ili druga okolnost’ kakvu u vidu ima odredba članka 39. točke 3. Zakona o zaštiti potrošača, koja bi bila tolikog značenja da je mogla umanjiti sposobnost potrošača da razumno rasuđuje.
- Naime, promjena službene valute, pored pripremnih radnji koje su obavljene prije uvođenja eura i na samom početku njegove uporabe, nije takva okolnost koja bi mogla umanjiti sposobnost prosječnog potrošača da razumno rasuđuje i da primijeti povećanje cijena, pogotovo kod obveze dvojnog iskazivanja cijena prije i nakon 1. siječnja 2023. - obrazlažu.
- Neopravdano povećanje cijena i dovođenje potrošača u nepovoljniji financijski položaj predstavlja kršenje načela iz članka 7. stavka 2. i članka 8. Zakona o uvođenju eura kao službene valute u Republici Hrvatskoj, ali to nisu bitna obilježja nepoštene poslovne prakse u smislu članaka 34. do 40. Zakona o zaštiti potrošača - zaključili su na splitskom Općinskom prekršajnom sudu.
