Odluka o smanjenju prireza s 15 na devet posto i o ukidanju poreza na potrošnju od 2024. godine, morat će se povući.

Zaključak koji je izglasan krajem listopada na sjednici Gradskog vijeća, nakon burne rasprave i pregovora između SDP-a i gradonačelnika Ivice Puljka - nije u skladu sa zakonom. Upozorili su na to iz Porezne uprave.

U posjedu smo obrazloženja u kojem djelatnica te državne službe upozorava kako se takva odluka može mijenjati najkasnije do 15. prosinca tekuće godine, s primjenom od 1. siječnja iduće godine. Ukratko, ne može se u ovoj godini donijeti odluka koja će se primjenjivati od prvog dana 2024., već se može odnositi isključivo na 2021. godinu. Ili, takvu odluku trebaju donijeti 2023. ako je planiraju primjenjivati od 2024.

Iznimno, predstavničko tijelo jedinice lokalne samouprave može tijekom godine donositi odluke o prirezu porezu na dohodak, koje stupaju na snagu prvoga dana u narednom mjesecu. No, u ovom slučaju nije učinjeno ni jedno ni drugo, već nešto sasvim treće. Zato se cijeli postupak izglasavanja mora ponoviti, a kada se za to odluče, pitanje je hoće li biti mogućnosti ili političke volje za provedbom smanjenja prireza i ukidanja poreza na potrošnju.

Takva informacija odmah je uzburkala strasti u redovima SDP-a odakle je stigao prijedlog za smanjenje prireza te ukidanje poreza na potrošnju već od iduće godine. Oni će na idućoj sjednici Gradskog vijeća tražiti izglasavanje primjene tih odluka od 2021.godine. Premda im takav prijedlog nije prošao u listopadu, pokušat će ponovo.

- Gradonačelnik je s rekordnim proračunom od 1.7 milijardi dao razloga za optimizam te opravdano smatramo da stanje gradskih financija i nije tako loše kao što se činilo - između ostalog je poručio Davor Matijević, vijećnik iz redova socijaldemokrata koji je podsjetio kako se u kampanji za smanjenje prireza zalagao gradonačelnik Puljak.

Osim toga, postavlja se pitanje je li se takva odluka moga provesti ako nije prošla javno savjetovanje. 

Uz to, spomenuta odluka sadrži još jednu stavku koja je upitna, a to je u dopisu istakla djelatnice Porezne uprave. Sporna je i odluka iz 2017. godine, a koja je donesena za vrijeme vladavine HDZ-ovog gradonačelnika Andre Krstulovića Opare.

Iz Porezne uprave su mišljenja da se trebaju brisati sve odredbe iz navedene odluke kojima se uređuju pitanja koja Grad Split nije ovlašten uređivati.

Konkretno, riječ je o plaćanju poreza na korištenje javnih površina koje treba biti propisano istom odlukom predstavničkog tijela jedinice lokalne samouprave kojom je i propisano plaćanje lokalnih poreza, a ne posebnom odlukom kako je provedeno u praksi.

Nakon svega navedenog, može se zaključiti da je pravna služba Grada paušalno pristupila izradi nezakonite odluke, a jednako u kojoj se još od 2017. nalazi i sporan članak o naplati poreza na korištenje javnih površina. Uz to, nejasno je i kako je Porezna uprava tek nakon četiri duge godine uočila takav članak. I to je do takve spoznaje došlo tek kad je im je predana u potpunosti nezakonita odluka.

Odluka o smanjenju prireza s 15 na devet posto i o ukidanju poreza na potrošnju od 2024. godine, morat će se povući.

Zaključak koji je izglasan krajem listopada na sjednici Gradskog vijeća, nakon burne rasprave i pregovora između SDP-a i gradonačelnika Ivice Puljka - nije u skladu sa zakonom. Upozorili su na to iz Porezne uprave.

U posjedu smo obrazloženja u kojem djelatnica te državne službe upozorava kako se takva odluka može mijenjati najkasnije do 15. prosinca tekuće godine, s primjenom od 1. siječnja iduće godine. Ukratko, ne može se u ovoj godini donijeti odluka koja će se primjenjivati od prvog dana 2024., već se može odnositi isključivo na 2021. godinu. Ili, takvu odluku trebaju donijeti 2023. ako je planiraju primjenjivati od 2024.

Iznimno, predstavničko tijelo jedinice lokalne samouprave može tijekom godine donositi odluke o prirezu porezu na dohodak, koje stupaju na snagu prvoga dana u narednom mjesecu. No, u ovom slučaju nije učinjeno ni jedno ni drugo, već nešto sasvim treće. Zato se cijeli postupak izglasavanja mora ponoviti, a kada se za to odluče, pitanje je hoće li biti mogućnosti ili političke volje za provedbom smanjenja prireza i ukidanja poreza na potrošnju.

Takva informacija odmah je uzburkala strasti u redovima SDP-a odakle je stigao prijedlog za smanjenje prireza te ukidanje poreza na potrošnju već od iduće godine. Oni će na idućoj sjednici Gradskog vijeća tražiti izglasavanje primjene tih odluka od 2021.godine. Premda im takav prijedlog nije prošao u listopadu, pokušat će ponovo.

- Gradonačelnik je s rekordnim proračunom od 1.7 milijardi dao razloga za optimizam te opravdano smatramo da stanje gradskih financija i nije tako loše kao što se činilo - između ostalog je poručio Davor Matijević, vijećnik iz redova socijaldemokrata koji je podsjetio kako se u kampanji za smanjenje prireza zalagao gradonačelnik Puljak.

Osim toga, postavlja se pitanje je li se takva odluka moga provesti ako nije prošla javno savjetovanje. 

Uz to, spomenuta odluka sadrži još jednu stavku koja je upitna, a to je u dopisu istakla djelatnice Porezne uprave. Sporna je i odluka iz 2017. godine, a koja je donesena za vrijeme vladavine HDZ-ovog gradonačelnika Andre Krstulovića Opare.

Iz Porezne uprave su mišljenja da se trebaju brisati sve odredbe iz navedene odluke kojima se uređuju pitanja koja Grad Split nije ovlašten uređivati.

Konkretno, riječ je o plaćanju poreza na korištenje javnih površina koje treba biti propisano istom odlukom predstavničkog tijela jedinice lokalne samouprave kojom je i propisano plaćanje lokalnih poreza, a ne posebnom odlukom kako je provedeno u praksi.

Nakon svega navedenog, može se zaključiti da je pravna služba Grada paušalno pristupila izradi nezakonite odluke, a jednako u kojoj se još od 2017. nalazi i sporan članak o naplati poreza na korištenje javnih površina. Uz to, nejasno je i kako je Porezna uprava tek nakon četiri duge godine uočila takav članak. I to je do takve spoznaje došlo tek kad je im je predana u potpunosti nezakonita odluka.
