Grad Split usprotivio se zaustavljanju čuvenog mini kruzera "Seagull II" i njegovoj prodaji na javnoj dražbi. Time se pridružio stavu dvojice poznatih splitskih odvjetnika, s kojima predstavnica Grada sjedi u Odboru vjerovnika Banke splitsko-dalmatinske

"Seagul II" plovi pod zastavom Malte, a poznato je da pripada splitskom poduzetniku Juroslavu Buljubašiću, koji je držao 46 posto dionica Banke splitsko-dalmatinske.

Brod je izgrađen 1952. godine u pulskom "Uljaniku" i nosio je ime po Vladimiru Nazoru. Ima svoju internetsku stranicu na kojoj se navodi da su na njemu plovili Josip Broz Tito, Bono Vox i danski princ Frederik André Henrik Christian.

Na tom luksuzno opremljenom mini kruzeru prije šest godina snimljen je Ivo Sanader kako ljetuje s obitelji. Mediji su tada pisali da tjedan dana krstarenja košta 125 tisuća eura, da ga puni agencija iz Monte Carla i da na njemu ljetuju anonimni bogataši, arapski šeici...

"Seagull II" našao se u interesu Ivana Eterovića, stečajnog upravitelja Banke splitsko-dalmatinske, koja na tom brodu ima upisane hipoteke. Htio je pokrenuti ovrhu nad brodom kako bi ga prodao na javnoj dražbi. Od dobivenih sredstava namirila bi se milijunska potraživanja vjerovnika banke.

No među dokumentacijom te financijske institucije nema ugovora o zasnivanju založnih prava na tom brodu, a to su ključne isprave da bi se mogla aktivirati prisilna naplata.

Zbog toga je proteklih mjeseci stečajni upravitelj pokušavao doći do tih ugovora, o čemu je izvijestio sud i vjerovnike.

Obratio se javnim bilježnicima u Solinu koji su toj banci ovjeravali većinu dokumentacije u vrijeme dok je ona redovno poslovala. Od njih nije dobio nikakav odgovor.

Potom je stečajni upravitelj angažirao odvjetničko društvo na Malti, od kojih je dobio odgovor da se radi o ispravama privatne naravi koje nisu u njihovim registrima.

Stečajni upravitelj nije stao na tome, nego se za pomoć obratio Hrvatskoj narodnoj banci, koja je prije otvaranja stečaja češljala dokumentaciju Banke splitsko-dalmatinske. Od HNB-a je dobio dopis da ni oni nisu u posjedu ugovora o zasnivanju založnog prava na motornoj jahti "Seagull II", već su dostavili presliku dokumentacije koju je banka u stečaju već imala.

Kako je u lipnju ove godine mini kruzer bio lociran u hrvatskim vodama, stečajni upravitelj zatražio je suglasnost Odbora vjerovnika da pokrene ovrhu nad brodom na temelju dokumentacije koju posjeduje, a to je samo originalni izvadak iz registra brodova. Da je u tome uspio, to bi značilo moguće prisilno zaustavljanje broda i njegovu prodaju na javnoj dražbi.

No tome su se usprotivila tri člana Odbora vjerovnika Banke splitsko-dalmatinske, među kojima je i Grad Split.

– Poznato mi je da motorna jahta "Seagull II" nikada nije bila sredstvo osiguranja za povrat bilo kojeg kredita, već jedino i isključivo dodatno osiguranje vlasnika dionica Banke splitsko-dalmatinske prema HNB-u kojim se dodatno jamčila adekvatnost kapitala za uredno poslovanje banke.

Ovim putem izražavam stav da nema pravnog osnova za provođenje prisilnog zaustavljanja navedenog broda, niti za provođenje ovrhe na ovom brodu. Naime, adekvatnost kapitala više ne postoji nakon otvaranja stečaja nad bankom – očitovao se sudu i stečajnom upravitelju odvjetnik koji je član Odbora vjerovnika Banke splitsko-dalmatinske, te nastavio:

– Sve ovo ističem iz jednostavnog razloga jer bi se pokretanjem vrlo upitnih postupaka dovelo do umanjenja stečajne mase, jer svaka poduzeta radnja koštala bi 125.000 kuna. Tim prije što ne postoji jasna dokumentacija pa je time povećan i rizik za stečajnu masu. Slijedom toga predlažem da se ne poduzimaju nikakve radnje s ciljem provođenja ovrhe na motornoj jahti "Seagull II".

S time se složila predstavnica Grada Splita. Država, odnosno Hrvatska agencija za osiguranje depozita, izjasnila se kako nema dovoljno podataka da bi zauzela stav o tom slučaju.

Grad Split usprotivio se zaustavljanju čuvenog mini kruzera "Seagull II" i njegovoj prodaji na javnoj dražbi. Time se pridružio stavu dvojice poznatih splitskih odvjetnika, s kojima predstavnica Grada sjedi u Odboru vjerovnika Banke splitsko-dalmatinske

"Seagul II" plovi pod zastavom Malte, a poznato je da pripada splitskom poduzetniku Juroslavu Buljubašiću, koji je držao 46 posto dionica Banke splitsko-dalmatinske.

Brod je izgrađen 1952. godine u pulskom "Uljaniku" i nosio je ime po Vladimiru Nazoru. Ima svoju internetsku stranicu na kojoj se navodi da su na njemu plovili Josip Broz Tito, Bono Vox i danski princ Frederik André Henrik Christian.

Na tom luksuzno opremljenom mini kruzeru prije šest godina snimljen je Ivo Sanader kako ljetuje s obitelji. Mediji su tada pisali da tjedan dana krstarenja košta 125 tisuća eura, da ga puni agencija iz Monte Carla i da na njemu ljetuju anonimni bogataši, arapski šeici...

"Seagull II" našao se u interesu Ivana Eterovića, stečajnog upravitelja Banke splitsko-dalmatinske, koja na tom brodu ima upisane hipoteke. Htio je pokrenuti ovrhu nad brodom kako bi ga prodao na javnoj dražbi. Od dobivenih sredstava namirila bi se milijunska potraživanja vjerovnika banke.

No među dokumentacijom te financijske institucije nema ugovora o zasnivanju založnih prava na tom brodu, a to su ključne isprave da bi se mogla aktivirati prisilna naplata.

Zbog toga je proteklih mjeseci stečajni upravitelj pokušavao doći do tih ugovora, o čemu je izvijestio sud i vjerovnike.

Obratio se javnim bilježnicima u Solinu koji su toj banci ovjeravali većinu dokumentacije u vrijeme dok je ona redovno poslovala. Od njih nije dobio nikakav odgovor.

Potom je stečajni upravitelj angažirao odvjetničko društvo na Malti, od kojih je dobio odgovor da se radi o ispravama privatne naravi koje nisu u njihovim registrima.

Stečajni upravitelj nije stao na tome, nego se za pomoć obratio Hrvatskoj narodnoj banci, koja je prije otvaranja stečaja češljala dokumentaciju Banke splitsko-dalmatinske. Od HNB-a je dobio dopis da ni oni nisu u posjedu ugovora o zasnivanju založnog prava na motornoj jahti "Seagull II", već su dostavili presliku dokumentacije koju je banka u stečaju već imala.

Kako je u lipnju ove godine mini kruzer bio lociran u hrvatskim vodama, stečajni upravitelj zatražio je suglasnost Odbora vjerovnika da pokrene ovrhu nad brodom na temelju dokumentacije koju posjeduje, a to je samo originalni izvadak iz registra brodova. Da je u tome uspio, to bi značilo moguće prisilno zaustavljanje broda i njegovu prodaju na javnoj dražbi.

No tome su se usprotivila tri člana Odbora vjerovnika Banke splitsko-dalmatinske, među kojima je i Grad Split.

– Poznato mi je da motorna jahta "Seagull II" nikada nije bila sredstvo osiguranja za povrat bilo kojeg kredita, već jedino i isključivo dodatno osiguranje vlasnika dionica Banke splitsko-dalmatinske prema HNB-u kojim se dodatno jamčila adekvatnost kapitala za uredno poslovanje banke.

Ovim putem izražavam stav da nema pravnog osnova za provođenje prisilnog zaustavljanja navedenog broda, niti za provođenje ovrhe na ovom brodu. Naime, adekvatnost kapitala više ne postoji nakon otvaranja stečaja nad bankom – očitovao se sudu i stečajnom upravitelju odvjetnik koji je član Odbora vjerovnika Banke splitsko-dalmatinske, te nastavio:

– Sve ovo ističem iz jednostavnog razloga jer bi se pokretanjem vrlo upitnih postupaka dovelo do umanjenja stečajne mase, jer svaka poduzeta radnja koštala bi 125.000 kuna. Tim prije što ne postoji jasna dokumentacija pa je time povećan i rizik za stečajnu masu. Slijedom toga predlažem da se ne poduzimaju nikakve radnje s ciljem provođenja ovrhe na motornoj jahti "Seagull II".

S time se složila predstavnica Grada Splita. Država, odnosno Hrvatska agencija za osiguranje depozita, izjasnila se kako nema dovoljno podataka da bi zauzela stav o tom slučaju.
