Splitski Upravni sud u ponedjeljak je presudio u korist Anite Nosić (30), sada već bivše HDZ-ove načelnice općine Lovreć, koja je ostala bez te funkcije nakon izbijanja afere u kojoj je otkriveno da je, kako bi mogla kupiti stan iz programa POS-a u Zagrebu, odjavila prebivalište u Lovreću i prijavila se u Zagrebu.

Nosić se danas nije pojavila na izricanju presude sutkinje Mirande Gulišije Jurišić u kojoj stoji da se poništava rješenje pročelnika Jedinstvenog upravnog odjela općine Lovreć od 19. veljače ove godine i da se predmet vraća na ponovno odlučivanje. Presuda je pravomoćna tako da na nju nema prava žalbe. Općina se jedino, u roku od 15 dana, može žaliti na rješenje o dosuđenih 7500 kuna sudskih troškova, koliko moraju isplatiti bivšoj načelnici.

Sporno rješenje

Spornim rješenjem, podsjetimo, Nosić je ostala bez mandata načelnice. U njemu je stajalo da joj je mandat prestao 7. veljače jer je temeljem uvjerenja o prebivalištu PP Imotski utvrđeno da je odjavila prebivalište s područja Lovreća 10. prosinca 2018. godine i da ga je ponovno prijavila 7. lipnja 2019. godine.

U tom pobijanom rješenju, koje je bilo predmet njezine tužbe, iz Općine su se pozvali i na mišljenje Ministarstva uprave koje je Općini Lovreć odgovorilo da je odjava prebivališta pravna situacija koja je predviđena kao razlog prestanka mandata.

No očito je da Upravni sud nije tako zaključio. Sutkinja zaključuje kako "uporište za tumačenje da tužiteljici prestaje dužnost općinske načelnice prema danu saznanja Ministarstva uprave (a oni su od PP Imotski tog 7. veljače zaprimili uvjerenje o prebivalištu Anite Nosić – op.a.) ne proizlazi ni iz jedne zakonom propisane odredbe".

– Iz provedenog postupka Sud nalazi nesporno utvrđenim da je tužiteljica u spornom razdoblju stvarno prebivala na području općine Lovreć, a ovakav zaključak proizlazi iz njezina iskaza, ali i iz pisane izjave pročelnika koji je potpisao utuženo rješenje. Tuženik (Općina – op.a.), osim svojih paušalnih tvrdnji u kojima izjednačava formalno i faktično prebivalište, tijekom spora nije priložio niti predložio nikakve dokaze kojima bi osporio iskaz tužiteljice kojoj je, uostalom, kao načelnici isplaćivana plaća. Životno je nelogično i fizički nemoguće da tužiteljica istodobno prebiva u Zagrebu i svakodnevno obavlja poslove načelnice u Lovreću. Proizlazi da je ona, u namjeri korištenja subvencioniranja kredita, fiktivno prijavila prebivalište u Zagrebu kako bi ispunila traženi uvjet prijavljenog prebivališta – obrazložila je, među ostalim, u presudi sutkinja.

Eventualno prekršaj

No ističe kako ovakvo ponašanje bivše načelnice može imati eventualnu prekršajnu odgovornost. U presudi se napominje kako Općina u ponovljenom postupku, ako ne raspolaže dokazima da je Nosić u spornom razdoblju formalno i faktički prebivala izvan mjesta u kojem obavlja poslove načelnice, mora donijeti rješenje kojim obustavlja postupak pokrenut po službenoj dužnosti.

To u prijevodu znači da bi Nosić trebala ponovno obnašati dužnost načelnice Lovreća. Pa makar do predstojećih lokalnih izbora.

Splitski Upravni sud u ponedjeljak je presudio u korist Anite Nosić (30), sada već bivše HDZ-ove načelnice općine Lovreć, koja je ostala bez te funkcije nakon izbijanja afere u kojoj je otkriveno da je, kako bi mogla kupiti stan iz programa POS-a u Zagrebu, odjavila prebivalište u Lovreću i prijavila se u Zagrebu.

Nosić se danas nije pojavila na izricanju presude sutkinje Mirande Gulišije Jurišić u kojoj stoji da se poništava rješenje pročelnika Jedinstvenog upravnog odjela općine Lovreć od 19. veljače ove godine i da se predmet vraća na ponovno odlučivanje. Presuda je pravomoćna tako da na nju nema prava žalbe. Općina se jedino, u roku od 15 dana, može žaliti na rješenje o dosuđenih 7500 kuna sudskih troškova, koliko moraju isplatiti bivšoj načelnici.

Sporno rješenje

Spornim rješenjem, podsjetimo, Nosić je ostala bez mandata načelnice. U njemu je stajalo da joj je mandat prestao 7. veljače jer je temeljem uvjerenja o prebivalištu PP Imotski utvrđeno da je odjavila prebivalište s područja Lovreća 10. prosinca 2018. godine i da ga je ponovno prijavila 7. lipnja 2019. godine.

U tom pobijanom rješenju, koje je bilo predmet njezine tužbe, iz Općine su se pozvali i na mišljenje Ministarstva uprave koje je Općini Lovreć odgovorilo da je odjava prebivališta pravna situacija koja je predviđena kao razlog prestanka mandata.

No očito je da Upravni sud nije tako zaključio. Sutkinja zaključuje kako "uporište za tumačenje da tužiteljici prestaje dužnost općinske načelnice prema danu saznanja Ministarstva uprave (a oni su od PP Imotski tog 7. veljače zaprimili uvjerenje o prebivalištu Anite Nosić – op.a.) ne proizlazi ni iz jedne zakonom propisane odredbe".

– Iz provedenog postupka Sud nalazi nesporno utvrđenim da je tužiteljica u spornom razdoblju stvarno prebivala na području općine Lovreć, a ovakav zaključak proizlazi iz njezina iskaza, ali i iz pisane izjave pročelnika koji je potpisao utuženo rješenje. Tuženik (Općina – op.a.), osim svojih paušalnih tvrdnji u kojima izjednačava formalno i faktično prebivalište, tijekom spora nije priložio niti predložio nikakve dokaze kojima bi osporio iskaz tužiteljice kojoj je, uostalom, kao načelnici isplaćivana plaća. Životno je nelogično i fizički nemoguće da tužiteljica istodobno prebiva u Zagrebu i svakodnevno obavlja poslove načelnice u Lovreću. Proizlazi da je ona, u namjeri korištenja subvencioniranja kredita, fiktivno prijavila prebivalište u Zagrebu kako bi ispunila traženi uvjet prijavljenog prebivališta – obrazložila je, među ostalim, u presudi sutkinja.

Eventualno prekršaj

No ističe kako ovakvo ponašanje bivše načelnice može imati eventualnu prekršajnu odgovornost. U presudi se napominje kako Općina u ponovljenom postupku, ako ne raspolaže dokazima da je Nosić u spornom razdoblju formalno i faktički prebivala izvan mjesta u kojem obavlja poslove načelnice, mora donijeti rješenje kojim obustavlja postupak pokrenut po službenoj dužnosti.

To u prijevodu znači da bi Nosić trebala ponovno obnašati dužnost načelnice Lovreća. Pa makar do predstojećih lokalnih izbora.

Nosić ponovno zasjeda na čelo općine Lovreć? Upravni sud u Splitu stao na stranu bivše HDZ-ove načelnice, presuđeno da nije smjela ostati bez funkcije

Splitski Upravni sud u ponedjeljak je presudio u korist Anite Nosić (30), sada već bivše HDZ-ove načelnice općine Lovreć, koja je ostala bez te funkcije nakon izbijanja afere u kojoj je otkriveno da je, kako bi mogla kupiti stan iz programa POS-a u Zagrebu, odjavila prebivalište u Lovreću i prijavila se u Zagrebu.

Nosić se danas nije pojavila na izricanju presude sutkinje Mirande Gulišije Jurišić u kojoj stoji da se poništava rješenje pročelnika Jedinstvenog upravnog odjela općine Lovreć od 19. veljače ove godine i da se predmet vraća na ponovno odlučivanje. Presuda je pravomoćna tako da na nju nema prava žalbe. Općina se jedino, u roku od 15 dana, može žaliti na rješenje o dosuđenih 7500 kuna sudskih troškova, koliko moraju isplatiti bivšoj načelnici.
