Zasigurno ću iskoristiti pravo da i pred institucijama iznesem svoju stranu priče. Naime, ja kroz cijeli mandat nisam prestala prebivati u svojoj općini, a to svakako mogu i dokazati - rekla je prije nekoliko mjeseci za Slobodnu Dalmaciju Anita Nosić, 30-godišnja, sada bivša HDZ-ova načelnica općine Lovreć, nakon izbijanja afere zbog koje je i ostala bez načelničke pozicije.
Podsjetimo, otkriveno je da je, kako bi mogla kupiti stan iz programa POS-a u Zagrebu, odjavila prebivalište u Lovreću i prijavila se u Zagrebu. Kad je dobila odluku da može kupiti stan u metropoli uz državni poticaj, opet se prijavila u Lovreć i nastavila obavljati dužnost načelnice.
Nosić se, dakle, nije pomirila s gubitkom pozicije, nego je krenula u pravnu bitku. Mandat joj je prestao kad je dobila rješenje Jedinstvenog upravnog odjela Općine Lovreć koje je potpisao pročelnik Mislav Karoglan.
Izdano je 19. veljače ove godine i u njemu je stajalo da joj je 7. veljače prestao mandat jer je temeljem uvjerenja o prebivalištu PP Imotski utvrđeno da je odjavila prebivalište s područja Lovreća 10. prosinca 2018. godine i da ga je ponovno prijavila 7. lipnja 2019. godine.
U njemu su se pozvali i na mišljenje Ministarstva uprave koje je Općini Lovreć odgovorilo da je odjava prebivališta pravna situacija koja je predviđena kao razlog prestanka mandata.
Nosić je, nezadovoljna ishodom, odlučila postupiti po uputi o pravnom lijeku. No, kako je greškom na rješenju bilo napisano da ima pravo žalbe Visokom upravnom sudu umjesto nadležnom Upravnom sudu u Splitu, tako se Nosić tužbom prvo obratila višoj instanci krajem veljače.
No, oni su se proglasili stvarno nenadležnima i tu je izgubila par mjeseci. Odluku o nenadležnosti donijeli su početkom ožujka, a tek su je krajem svibnja proslijedili splitskom Upravnom sudu koji tek treba zakazati ročište.
Nosić u tužbi navodi, među ostalim, da se trajno nastanila u Lovreću i da tamo živi cijeli život te da u prilog činjenici da je neprekidno prebivala u Lovreću ne govori samo to što je svakodnevno dolazila na posao, odlazila u lokalnu trgovinu, crkvu i druga mjesta, već i to što je za vrijeme prijave prebivališta u Zagrebu u općini Lovreć imala prijavljeno boravište.
Smatra kako nikad nije došlo do faktičnog prestanka prebivališta jer da ona nikad nije napustila svoje prebivalište u općini Lovreć.
- Smatram da nisu ostvarene sve zakonske pretpostavke za prestanak mog mandata, posebno zbog onih okolnosti koje se tiču prebivališta. Nisam rekla da nisam kriva jer očito nisam smjela promijeniti prebivalište, no ja uistinu nikad nisam otišla iz Lovreća i to je lako provjerljiva činjenica. Sve ostalo je pravni nesporazum.
U trenutku donošenja odluke o kupnji stana vodila sam se, naime, pravnim savjetima, a na nadležnim tijelima je da provjere pravnu stranu cijeloga slučaja i da na temelju uvida donesu odluku, a ja ću je poštovati - govorila je Nosić za Slobodnu Dalmaciju nakon izbijanja afere.
Da je to tako, potvrdila je potvrdom liječnice o neprekinutoj primarnoj zaštiti u Lovreću od 2013. godine, a kako bi još više prisnažila svoje argumente u borbi da dokaže da je neopravdano maknuta s načelničke pozicije, priložila je i izjavu Bogoslava Džaje, predsjednika Općinskog vijeća Lovreća, koji je naveo da je Nosić cijelo vrijeme svog mandata, pa tako i u spornom razdoblju od 10. prosinca 2018. do 7. lipnja 2019. godine, svakodnevno obnašala svoje dužnosti i dolazila na svoje radno mjesto u Općini Lovreć.
- Viđao sam je i s njom se družio i izvan radnog vremena u slobodno vrijeme u svojoj obiteljskoj kući i po našemu mjestu, a isto tako zajedno smo bili nedjeljom na svetim misama u župama naše općine - naveo je Džaja u svojoj izjavi.
Isto tako, Nosić se u tužbi pozvala i na presudu Visokog upravnog suda u jednom drugom predmetu iz 2016. godine, u kojoj, među ostalim, stoji i da je "protivno temeljnim odredbama ZUP-a (Zakona o općem upravnom postupku) stajalište da se prebivalište dokazuje isključivo uvjerenjem određene policijske postaje" jer se u upravnom postupku treba utvrđivati pravo stanje stvari i utvrditi sve činjenice.
Mora se priznati da se mlada HDZ-ovka dobro oboružala pravnim argumentima, no ipak treba pričekati presudu splitskog Upravnog suda, a onda i konačni pravorijek ako na tu odluku bude žalbi.

Zasigurno ću iskoristiti pravo da i pred institucijama iznesem svoju stranu priče. Naime, ja kroz cijeli mandat nisam prestala prebivati u svojoj općini, a to svakako mogu i dokazati - rekla je prije nekoliko mjeseci za Slobodnu Dalmaciju Anita Nosić, 30-godišnja, sada bivša HDZ-ova načelnica općine Lovreć, nakon izbijanja afere zbog koje je i ostala bez načelničke pozicije.
Podsjetimo, otkriveno je da je, kako bi mogla kupiti stan iz programa POS-a u Zagrebu, odjavila prebivalište u Lovreću i prijavila se u Zagrebu. Kad je dobila odluku da može kupiti stan u metropoli uz državni poticaj, opet se prijavila u Lovreć i nastavila obavljati dužnost načelnice.
Nosić se, dakle, nije pomirila s gubitkom pozicije, nego je krenula u pravnu bitku. Mandat joj je prestao kad je dobila rješenje Jedinstvenog upravnog odjela Općine Lovreć koje je potpisao pročelnik Mislav Karoglan.
Izdano je 19. veljače ove godine i u njemu je stajalo da joj je 7. veljače prestao mandat jer je temeljem uvjerenja o prebivalištu PP Imotski utvrđeno da je odjavila prebivalište s područja Lovreća 10. prosinca 2018. godine i da ga je ponovno prijavila 7. lipnja 2019. godine.
U njemu su se pozvali i na mišljenje Ministarstva uprave koje je Općini Lovreć odgovorilo da je odjava prebivališta pravna situacija koja je predviđena kao razlog prestanka mandata.
Nosić je, nezadovoljna ishodom, odlučila postupiti po uputi o pravnom lijeku. No, kako je greškom na rješenju bilo napisano da ima pravo žalbe Visokom upravnom sudu umjesto nadležnom Upravnom sudu u Splitu, tako se Nosić tužbom prvo obratila višoj instanci krajem veljače.
No, oni su se proglasili stvarno nenadležnima i tu je izgubila par mjeseci. Odluku o nenadležnosti donijeli su početkom ožujka, a tek su je krajem svibnja proslijedili splitskom Upravnom sudu koji tek treba zakazati ročište.
Nosić u tužbi navodi, među ostalim, da se trajno nastanila u Lovreću i da tamo živi cijeli život te da u prilog činjenici da je neprekidno prebivala u Lovreću ne govori samo to što je svakodnevno dolazila na posao, odlazila u lokalnu trgovinu, crkvu i druga mjesta, već i to što je za vrijeme prijave prebivališta u Zagrebu u općini Lovreć imala prijavljeno boravište.
Smatra kako nikad nije došlo do faktičnog prestanka prebivališta jer da ona nikad nije napustila svoje prebivalište u općini Lovreć.
- Smatram da nisu ostvarene sve zakonske pretpostavke za prestanak mog mandata, posebno zbog onih okolnosti koje se tiču prebivališta. Nisam rekla da nisam kriva jer očito nisam smjela promijeniti prebivalište, no ja uistinu nikad nisam otišla iz Lovreća i to je lako provjerljiva činjenica. Sve ostalo je pravni nesporazum.
U trenutku donošenja odluke o kupnji stana vodila sam se, naime, pravnim savjetima, a na nadležnim tijelima je da provjere pravnu stranu cijeloga slučaja i da na temelju uvida donesu odluku, a ja ću je poštovati - govorila je Nosić za Slobodnu Dalmaciju nakon izbijanja afere.
Da je to tako, potvrdila je potvrdom liječnice o neprekinutoj primarnoj zaštiti u Lovreću od 2013. godine, a kako bi još više prisnažila svoje argumente u borbi da dokaže da je neopravdano maknuta s načelničke pozicije, priložila je i izjavu Bogoslava Džaje, predsjednika Općinskog vijeća Lovreća, koji je naveo da je Nosić cijelo vrijeme svog mandata, pa tako i u spornom razdoblju od 10. prosinca 2018. do 7. lipnja 2019. godine, svakodnevno obnašala svoje dužnosti i dolazila na svoje radno mjesto u Općini Lovreć.
- Viđao sam je i s njom se družio i izvan radnog vremena u slobodno vrijeme u svojoj obiteljskoj kući i po našemu mjestu, a isto tako zajedno smo bili nedjeljom na svetim misama u župama naše općine - naveo je Džaja u svojoj izjavi.
Isto tako, Nosić se u tužbi pozvala i na presudu Visokog upravnog suda u jednom drugom predmetu iz 2016. godine, u kojoj, među ostalim, stoji i da je "protivno temeljnim odredbama ZUP-a (Zakona o općem upravnom postupku) stajalište da se prebivalište dokazuje isključivo uvjerenjem određene policijske postaje" jer se u upravnom postupku treba utvrđivati pravo stanje stvari i utvrditi sve činjenice.
Mora se priznati da se mlada HDZ-ovka dobro oboružala pravnim argumentima, no ipak treba pričekati presudu splitskog Upravnog suda, a onda i konačni pravorijek ako na tu odluku bude žalbi.
