Imate vikendicu i jednu skrovitu plažu na koju idete godinama i sebično mislite da je to samo vaša privatna uvalica u koju nemaju pristup druge osobe? Čak i tjerate nepoželjne. E, to je zabranjeno.
Naime, Zakon kaže da je gotovo nemoguće imati tu privilegiju, jer niti jedna vikendica ne može imati plažu za sebe. No, ipak postoje izuzeci. Naime, u jako rijetkim slučajevima može se ograničiti korištenje pomorskog dobra, i to sve temeljem detaljno obrazložene koncesije.
Nemali broj puta smo čitali ili vidjeli kako se za neke kuće, vile, vikendice (o hotelima da ni ne govorimo) pa čak i višestambene zgrade osigurava maksimalna privatnost za pristup moru, bilo da se radi za njihove goste ili za same vlasnike. Jasno je da bi svatko od nas povremeno htio uživati u 'privatnom mjestu za kupanje' no nije baš to tako lako zakonski osigurati, piše portal Zgradonačelnik.
Većina se susrela s pričama i natpisima poput 'Ovoj plaži zabranjen je pristup svima osim stanarima!', 'Zabranjen pristup – privatna plaža', 'Privatna plaža isključivo za goste' kao i podizanjem ograda i postavljanjem zaštitara na plaže. No da krenemo redom i razjasnimo što je to pomorsko dobro, kao i koja je razlika između koncesije i koncesijskog odobrenja i malo se pozovemo na, ne uvijek svima potpuno jasan, Zakon o pomorskom dobru i morskim lukama i Zakon o koncesijama. Inače, Zakon o koncesijama uređuje kako se daju koncesije, a Zakon o pomorskom dobru govori što se smije. No ne zaboravimo da postoji i Uredba o postupku davanja koncesije na pomorskom dobru.
Pomorsko dobro
Kako piše u Zakonu o pomorskom dobru, pomorsko dobro 'čine unutarnje morske vode i teritorijalno more, njihovo dno i podzemlje te dio kopna koji je po svojoj prirodi namijenjen općoj upotrebi ili je proglašen takvim, kao i sve što je s tim dijelom kopna trajno spojeno na površini ili ispod nje. Dijelom kopna smatra se i morska obala, luke, nasipi, hridi, grebeni, plaže, sprudovi i tako dalje. Na pomorskom dobru ne može se stjecati pravo vlasništva ni druga stvarna prava po bilo kakvoj osnovi. Republika Hrvatska upravlja pomorskim dobrom neposredno ili putem jedinica područne (regionalne)/lokalne samouprave.
Također, Zakon navodi da morska obala obuhvaća pojas kopna širokog najmanje šest metara od crte koja je vodoravno udaljena od crte srednjih viših visokih voda, tj. šest metara od crte mora prema kopnu je opće (pomorsko) dobro. Znači, tu nema vlasništva.
Koncesija
Koncesija je 'pravo kojim se dio pomorskog dobra djelomično ili potpuno isključuje iz opće upotrebe i daje na posebnu upotrebu ili gospodarsko korištenje fizičkim i pravnim osobama, sukladno prostornim planovima', stoji u članku 2. navedenog Zakona.
Zapravo, Zakon o pomorskom dobru kaže da netko ima pravo koristiti dio ili cijelu plažu, odnosno pristup moru, no nju i nije baš tako lako dobiti jer da bi je dobio mora ispuniti cijeli niz kompliciranih pravnih zahtjeva. Koncesija se daje na rok od 5 do 99 godina.
Koncesijsko odobrenje
Za razliku od koncesije, spomenuti članak 2. Zakona kaže da je koncesijsko odobrenje pak 'akt na temelju kojeg se fizičkim i pravnim osobama daje na korištenje pomorsko dobro za obavljanje djelatnosti koje ne isključuju niti ograničavaju opću upotrebu pomorskog dobra'. A koncesijsko odobrenje daje se na zahtjev na rok do najviše pet godina.
U biti, koncesijsko odobrenje daje nekome mogućnost da nešto privređuje od tog komada pomorskog dobra (npr. da ima ležaljke, štand sa sladoledima, naplati vam korištenje infrastrukture koju je napravio) ali ne smije one koji nešto ne konzumiraju otjerati kao niti ograničiti nekome pristup tom dijelu.

Imate vikendicu i jednu skrovitu plažu na koju idete godinama i sebično mislite da je to samo vaša privatna uvalica u koju nemaju pristup druge osobe? Čak i tjerate nepoželjne. E, to je zabranjeno.
Naime, Zakon kaže da je gotovo nemoguće imati tu privilegiju, jer niti jedna vikendica ne može imati plažu za sebe. No, ipak postoje izuzeci. Naime, u jako rijetkim slučajevima može se ograničiti korištenje pomorskog dobra, i to sve temeljem detaljno obrazložene koncesije.
Nemali broj puta smo čitali ili vidjeli kako se za neke kuće, vile, vikendice (o hotelima da ni ne govorimo) pa čak i višestambene zgrade osigurava maksimalna privatnost za pristup moru, bilo da se radi za njihove goste ili za same vlasnike. Jasno je da bi svatko od nas povremeno htio uživati u 'privatnom mjestu za kupanje' no nije baš to tako lako zakonski osigurati, piše portal Zgradonačelnik.
Većina se susrela s pričama i natpisima poput 'Ovoj plaži zabranjen je pristup svima osim stanarima!', 'Zabranjen pristup – privatna plaža', 'Privatna plaža isključivo za goste' kao i podizanjem ograda i postavljanjem zaštitara na plaže. No da krenemo redom i razjasnimo što je to pomorsko dobro, kao i koja je razlika između koncesije i koncesijskog odobrenja i malo se pozovemo na, ne uvijek svima potpuno jasan, Zakon o pomorskom dobru i morskim lukama i Zakon o koncesijama. Inače, Zakon o koncesijama uređuje kako se daju koncesije, a Zakon o pomorskom dobru govori što se smije. No ne zaboravimo da postoji i Uredba o postupku davanja koncesije na pomorskom dobru.
Pomorsko dobro
Kako piše u Zakonu o pomorskom dobru, pomorsko dobro 'čine unutarnje morske vode i teritorijalno more, njihovo dno i podzemlje te dio kopna koji je po svojoj prirodi namijenjen općoj upotrebi ili je proglašen takvim, kao i sve što je s tim dijelom kopna trajno spojeno na površini ili ispod nje. Dijelom kopna smatra se i morska obala, luke, nasipi, hridi, grebeni, plaže, sprudovi i tako dalje. Na pomorskom dobru ne može se stjecati pravo vlasništva ni druga stvarna prava po bilo kakvoj osnovi. Republika Hrvatska upravlja pomorskim dobrom neposredno ili putem jedinica područne (regionalne)/lokalne samouprave.
Također, Zakon navodi da morska obala obuhvaća pojas kopna širokog najmanje šest metara od crte koja je vodoravno udaljena od crte srednjih viših visokih voda, tj. šest metara od crte mora prema kopnu je opće (pomorsko) dobro. Znači, tu nema vlasništva.
Koncesija
Koncesija je 'pravo kojim se dio pomorskog dobra djelomično ili potpuno isključuje iz opće upotrebe i daje na posebnu upotrebu ili gospodarsko korištenje fizičkim i pravnim osobama, sukladno prostornim planovima', stoji u članku 2. navedenog Zakona.
Zapravo, Zakon o pomorskom dobru kaže da netko ima pravo koristiti dio ili cijelu plažu, odnosno pristup moru, no nju i nije baš tako lako dobiti jer da bi je dobio mora ispuniti cijeli niz kompliciranih pravnih zahtjeva. Koncesija se daje na rok od 5 do 99 godina.
Koncesijsko odobrenje
Za razliku od koncesije, spomenuti članak 2. Zakona kaže da je koncesijsko odobrenje pak 'akt na temelju kojeg se fizičkim i pravnim osobama daje na korištenje pomorsko dobro za obavljanje djelatnosti koje ne isključuju niti ograničavaju opću upotrebu pomorskog dobra'. A koncesijsko odobrenje daje se na zahtjev na rok do najviše pet godina.
U biti, koncesijsko odobrenje daje nekome mogućnost da nešto privređuje od tog komada pomorskog dobra (npr. da ima ležaljke, štand sa sladoledima, naplati vam korištenje infrastrukture koju je napravio) ali ne smije one koji nešto ne konzumiraju otjerati kao niti ograničiti nekome pristup tom dijelu.
