Gradonačelnik Obrovca Ante Župan (HDZ) stara je „mušterija” Povjerenika za informacije koji nadzire provođenje Zakona o pravu na pristup informacijama, ali je sada Jutarnji list otkrio i da je rekorder po iznosu kojim je kažnjen zbog kršenja prava građana na pristup informacijama. Prošle je godine Općinski sud u Zadru s 8.100 kuna kaznio Župana jer je ignorirao pitanje građana na temu trošenja proračunskog novca i oglušio se nakon naloga povjerenika za informiranje da na to pitanje odgovori.

Ta sudska odluka je još uvijek nepravomoćna, ali ima Župan i pravomoćnih presuda: 2018. godine mu je Visoki prekršajni sud odrezao kaznu od 5.000 kuna. Tada je župan odbio odgovoriti na pitanje oporbenog vijećnika o troškovima reprezentacije i službenih putovanja u gradskoj upravi Obrovca. Visoki trgovački sud je donio još jednu osuđujuću presudu protiv Župana, ali je ta otišla u zastaru.

Dosta su česte zastare sudskih postupaka kojima se određuju kazne čelnicima tijela javne vlasti, a statistika pokazuje da se te kazne uglavnom vrlo blage i da se kreću između 4.000 i 5.000 kuna iako je zakonski okvir od 2.000 do 10.000 za neprovođenje povjerenikovog naloga, te od 5.000 do 20.000 za neprovođenje rješenja. Sve to je natjeralo povjerenika za informiranje Zorana Pičuljana da predloži jačanje zakonskih ovlasti Povjerenstva i da mu se zakonski omogući samostalno izricanje kazni bez podnošenja prekršajnih prijava i čekanja na dugotrajne sudske postupke. Ali, tek treba vidjeti hoće li njegov zahtjev biti uvršten u najavljene izmjene Zakona.

Dakle, tek treba vidjeti hoće li doći do zakonskog pooštrenja mjera za „suzbijanje informacija” ili će sve ostati po starom pa će i Povjerenstvo biti goli ornament u sustavu kontrole javne vlasti, nešto poput Povjerenstva za sukob interesa. Malo ili ništa bi se dobilo kada bi Pičuljan i realizirao svoju namjeru da objavi popis svih koji krše Zakon o pravu na pristup informacijama – plaćanje poreza je kudikamo važnije svakoj vlasti, pa se pokazalo da je „lista srama” Ministarstva financija malo kome natjerala crvenilo u obraze.

Hoće li se makar promijeniti odnos obrovačkog gradonačelnika prema građanima i gradskim vijećnicima željnima informacija o trošenju njihovog novca?

-Pročitao sam natpis koji se pojavio u Jutarnjem listu i nemam tome ništa više dodati. Ako povjerenik za informiranje dobije ovlasti da samostalno određiva kazne čelnicima institucija, poštivati ću te ovlasti u okvirima kako ih zakonodavac propiše, izjavio nam je Ante Župan.

Gradonačelnik Obrovca Ante Župan (HDZ) stara je „mušterija” Povjerenika za informacije koji nadzire provođenje Zakona o pravu na pristup informacijama, ali je sada Jutarnji list otkrio i da je rekorder po iznosu kojim je kažnjen zbog kršenja prava građana na pristup informacijama. Prošle je godine Općinski sud u Zadru s 8.100 kuna kaznio Župana jer je ignorirao pitanje građana na temu trošenja proračunskog novca i oglušio se nakon naloga povjerenika za informiranje da na to pitanje odgovori.

Ta sudska odluka je još uvijek nepravomoćna, ali ima Župan i pravomoćnih presuda: 2018. godine mu je Visoki prekršajni sud odrezao kaznu od 5.000 kuna. Tada je župan odbio odgovoriti na pitanje oporbenog vijećnika o troškovima reprezentacije i službenih putovanja u gradskoj upravi Obrovca. Visoki trgovački sud je donio još jednu osuđujuću presudu protiv Župana, ali je ta otišla u zastaru.

Dosta su česte zastare sudskih postupaka kojima se određuju kazne čelnicima tijela javne vlasti, a statistika pokazuje da se te kazne uglavnom vrlo blage i da se kreću između 4.000 i 5.000 kuna iako je zakonski okvir od 2.000 do 10.000 za neprovođenje povjerenikovog naloga, te od 5.000 do 20.000 za neprovođenje rješenja. Sve to je natjeralo povjerenika za informiranje Zorana Pičuljana da predloži jačanje zakonskih ovlasti Povjerenstva i da mu se zakonski omogući samostalno izricanje kazni bez podnošenja prekršajnih prijava i čekanja na dugotrajne sudske postupke. Ali, tek treba vidjeti hoće li njegov zahtjev biti uvršten u najavljene izmjene Zakona.

Dakle, tek treba vidjeti hoće li doći do zakonskog pooštrenja mjera za „suzbijanje informacija” ili će sve ostati po starom pa će i Povjerenstvo biti goli ornament u sustavu kontrole javne vlasti, nešto poput Povjerenstva za sukob interesa. Malo ili ništa bi se dobilo kada bi Pičuljan i realizirao svoju namjeru da objavi popis svih koji krše Zakon o pravu na pristup informacijama – plaćanje poreza je kudikamo važnije svakoj vlasti, pa se pokazalo da je „lista srama” Ministarstva financija malo kome natjerala crvenilo u obraze.

Hoće li se makar promijeniti odnos obrovačkog gradonačelnika prema građanima i gradskim vijećnicima željnima informacija o trošenju njihovog novca?

-Pročitao sam natpis koji se pojavio u Jutarnjem listu i nemam tome ništa više dodati. Ako povjerenik za informiranje dobije ovlasti da samostalno određiva kazne čelnicima institucija, poštivati ću te ovlasti u okvirima kako ih zakonodavac propiše, izjavio nam je Ante Župan.

Koga briga za pristup informacijama? Najveća kazna izrečena je gradonačelniku Obrovca Anti Županu, a on najavljuje da će - poštivati zakon

Gradonačelnik Obrovca Ante Župan (HDZ) stara je „mušterija” Povjerenika za informacije koji nadzire provođenje Zakona o pravu na pristup informacijama, ali je sada Jutarnji list otkrio i da je rekorder po iznosu kojim je kažnjen zbog kršenja prava građana na pristup informacijama. Prošle je godine Općinski sud u Zadru s 8.100 kuna kaznio Župana jer je ignorirao pitanje građana na temu trošenja proračunskog novca i oglušio se nakon naloga povjerenika za informiranje da na to pitanje odgovori.

Ta sudska odluka je još uvijek nepravomoćna, ali ima Župan i pravomoćnih presuda: 2018. godine mu je Visoki prekršajni sud odrezao kaznu od 5.000 kuna. Tada je župan odbio odgovoriti na pitanje oporbenog vijećnika o troškovima reprezentacije i službenih putovanja u gradskoj upravi Obrovca. Visoki trgovački sud je donio još jednu osuđujuću presudu protiv Župana, ali je ta otišla u zastaru.

Dosta su česte zastare sudskih postupaka kojima se određuju kazne čelnicima tijela javne vlasti, a statistika pokazuje da se te kazne uglavnom vrlo blage i da se kreću između 4.000 i 5.000 kuna iako je zakonski okvir od 2.000 do 10.000 za neprovođenje povjerenikovog naloga, te od 5.000 do 20.000 za neprovođenje rješenja. Sve to je natjeralo povjerenika za informiranje Zorana Pičuljana da predloži jačanje zakonskih ovlasti Povjerenstva i da mu se zakonski omogući samostalno izricanje kazni bez podnošenja prekršajnih prijava i čekanja na dugotrajne sudske postupke. Ali, tek treba vidjeti hoće li njegov zahtjev biti uvršten u najavljene izmjene Zakona.

Dakle, tek treba vidjeti hoće li doći do zakonskog pooštrenja mjera za „suzbijanje informacija” ili će sve ostati po starom pa će i Povjerenstvo biti goli ornament u sustavu kontrole javne vlasti, nešto poput Povjerenstva za sukob interesa. Malo ili ništa bi se dobilo kada bi Pičuljan i realizirao svoju namjeru da objavi popis svih koji krše Zakon o pravu na pristup informacijama – plaćanje poreza je kudikamo važnije svakoj vlasti, pa se pokazalo da je „lista srama” Ministarstva financija malo kome natjerala crvenilo u obraze.

Hoće li se makar promijeniti odnos obrovačkog gradonačelnika prema građanima i gradskim vijećnicima željnima informacija o trošenju njihovog novca?

-Pročitao sam natpis koji se pojavio u Jutarnjem listu i nemam tome ništa više dodati. Ako povjerenik za informiranje dobije ovlasti da samostalno određiva kazne čelnicima institucija, poštivati ću te ovlasti u okvirima kako ih zakonodavac propiše, izjavio nam je Ante Župan.
