Početkom srpnja prošle 20-godišnji mladić iz Irske Sean Brogan je pao s nezaštićenih gradskih bedema u Perivoju kraljice Jelene i poginuo. Deset mjeseci kasnije "Ledana” ne radi, gradska tvrtka Nasadi koja upravlja tim javnim prostorom gubi prihode, na Trgovačkom sudu u Zadru traje sudski spor između Nasada i vlasnika "Ledane” oko međusobnih potraživanja, stari ugovor o korištenju javne površine je istekao, a novi nije potpisan. Osim toga, unatoč tragičnoj smrti irskog mladića - zaštitne ograde nema. Zašto?

- Postavljanje zaštitne ograde na bedemima nije u nadležnosti Nasada. To je zahvat nadležnog Upravnog odjela Grada Zadra na spomeniku kulture u vlasništvu Grada Zadra, odgovorili su medijima iz komunalnog poduzeća.

Iz Ureda gradonačelnika tvrde da će ograda biti postavljena ubrzo nakon što – bude izglasan novi gradski proračun!

- Grad Zadar je koncem prošle godine izradio elaborat postavljanja znakova upozorenja na bedemima u Perivoju kraljice Jelene i Parku Vladimira Nazora. U iščekivanju smo usvajanja proračuna kojim bismo osigurali sredstva za njihovo postavljanje. Paralelno s tim u prijedlogu programa održavanja javnih zelenih površina predložen je iznos od 50 tisuća eura Nasadima u cilju podizanja razine sigurnosti na obje lokacije u skladu s konzervatorskim uvjetima. Nakon usvajanja proračuna promptno ćemo aktivirati sve radove, kažu iz gradske uprave bez osvrta na činjenicu da je od smrtnog pada prošlo deset mjeseci, a "kriza oko proračuna” traje četiri mjeseca.

I nitko pouzdano ne zna hoće li i kada biti okončana, što znači da nije isključeno da će na tom opasnom mjestu gradski bedemi biti bez ograde duže od godinu dana nakon smrti Seana Brogana. S druge strane, nema razloga za optimizam ni kada se radi o brzom "nastavku poslovne suradnje" između gradske tvrtke i "Ledane".

- Na Trgovačkom sudu u Zadru se vodi sudski spor između vlasnika "Ledane” i tvrtke Nasadi koji imaju više međusobnih potraživanja. Nasadi cijelo vrijeme ističu instalaciju u prostoru parka s više četvornih metara nego što je kvadratura s posljednjeg geodetskog snimka, kaže Tomislav Korona, pročelnik za gradsku imovinu i predsjednik Nadzornog odbora „Nasada”.

To znači da „Nasadi” misle da su im vlasnici "Ledane” ostali dužni, ali sud o tome još nije donio odluku. Na temelju čega je onda odbijen novi zahtjev vlasnika "Ledane” za produženje ugovora o zakupu javne površine?

- Dug je kreiran na temelju toga što je geodetskom izmjerom nepobitno utvrđeno da je korištena veća javna površina od one koja je bila upisana u ugovor o zakupu. Temeljem toga Nasadi su odlučili tako kako su odlučili. U kontaktima Nasada i vlasnika "Ledane” pojavio se i iznos duga kojeg su odredili financijski vještaci i kojeg su Nasadi tražili, ali, na žalost, mirenje i arbitraža u ovom slučaju nisu urodili plodom. Kad je trebalo isplatiti taj dug, došlo je do prekida razgovora i početka sudske parnice. Što se novog ugovora o zakupu tiče, to nije bilo moguće i zato što, koliko znam, ne postoje novi minimalni tehnički uvjeti bez kojih ugovor jednostavno nije moguće potpisati, zaključuje pročelnik Korona.

Postojeća pat situacija očito će potrajati dok spor na Trgovačkom sudu ne završi, a ogradu ne donese postizanje političkog dogovora oko gradskog proračuna. S obzirom na poslovičnu brzinu domaćeg pravosuđa i političkih struktura, to znači da bi, dok se konačna rješenja ne pronađu, s bedema mogao pasti još ponetko...

Početkom srpnja prošle 20-godišnji mladić iz Irske Sean Brogan je pao s nezaštićenih gradskih bedema u Perivoju kraljice Jelene i poginuo. Deset mjeseci kasnije "Ledana” ne radi, gradska tvrtka Nasadi koja upravlja tim javnim prostorom gubi prihode, na Trgovačkom sudu u Zadru traje sudski spor između Nasada i vlasnika "Ledane” oko međusobnih potraživanja, stari ugovor o korištenju javne površine je istekao, a novi nije potpisan. Osim toga, unatoč tragičnoj smrti irskog mladića - zaštitne ograde nema. Zašto?

- Postavljanje zaštitne ograde na bedemima nije u nadležnosti Nasada. To je zahvat nadležnog Upravnog odjela Grada Zadra na spomeniku kulture u vlasništvu Grada Zadra, odgovorili su medijima iz komunalnog poduzeća.

Iz Ureda gradonačelnika tvrde da će ograda biti postavljena ubrzo nakon što – bude izglasan novi gradski proračun!

- Grad Zadar je koncem prošle godine izradio elaborat postavljanja znakova upozorenja na bedemima u Perivoju kraljice Jelene i Parku Vladimira Nazora. U iščekivanju smo usvajanja proračuna kojim bismo osigurali sredstva za njihovo postavljanje. Paralelno s tim u prijedlogu programa održavanja javnih zelenih površina predložen je iznos od 50 tisuća eura Nasadima u cilju podizanja razine sigurnosti na obje lokacije u skladu s konzervatorskim uvjetima. Nakon usvajanja proračuna promptno ćemo aktivirati sve radove, kažu iz gradske uprave bez osvrta na činjenicu da je od smrtnog pada prošlo deset mjeseci, a "kriza oko proračuna” traje četiri mjeseca.

I nitko pouzdano ne zna hoće li i kada biti okončana, što znači da nije isključeno da će na tom opasnom mjestu gradski bedemi biti bez ograde duže od godinu dana nakon smrti Seana Brogana. S druge strane, nema razloga za optimizam ni kada se radi o brzom "nastavku poslovne suradnje" između gradske tvrtke i "Ledane".

- Na Trgovačkom sudu u Zadru se vodi sudski spor između vlasnika "Ledane” i tvrtke Nasadi koji imaju više međusobnih potraživanja. Nasadi cijelo vrijeme ističu instalaciju u prostoru parka s više četvornih metara nego što je kvadratura s posljednjeg geodetskog snimka, kaže Tomislav Korona, pročelnik za gradsku imovinu i predsjednik Nadzornog odbora „Nasada”.

To znači da „Nasadi” misle da su im vlasnici "Ledane” ostali dužni, ali sud o tome još nije donio odluku. Na temelju čega je onda odbijen novi zahtjev vlasnika "Ledane” za produženje ugovora o zakupu javne površine?

- Dug je kreiran na temelju toga što je geodetskom izmjerom nepobitno utvrđeno da je korištena veća javna površina od one koja je bila upisana u ugovor o zakupu. Temeljem toga Nasadi su odlučili tako kako su odlučili. U kontaktima Nasada i vlasnika "Ledane” pojavio se i iznos duga kojeg su odredili financijski vještaci i kojeg su Nasadi tražili, ali, na žalost, mirenje i arbitraža u ovom slučaju nisu urodili plodom. Kad je trebalo isplatiti taj dug, došlo je do prekida razgovora i početka sudske parnice. Što se novog ugovora o zakupu tiče, to nije bilo moguće i zato što, koliko znam, ne postoje novi minimalni tehnički uvjeti bez kojih ugovor jednostavno nije moguće potpisati, zaključuje pročelnik Korona.

Postojeća pat situacija očito će potrajati dok spor na Trgovačkom sudu ne završi, a ogradu ne donese postizanje političkog dogovora oko gradskog proračuna. S obzirom na poslovičnu brzinu domaćeg pravosuđa i političkih struktura, to znači da bi, dok se konačna rješenja ne pronađu, s bedema mogao pasti još ponetko...

Deset mjeseci od pada mladog Irca: ‘Ledana‘ ne radi, Nasadi gube prihode, traje suđenje, a zaštitne ograde nema. Zašto?

Početkom srpnja prošle 20-godišnji mladić iz Irske Sean Brogan je pao s nezaštićenih gradskih bedema u Perivoju kraljice Jelene i poginuo. Deset mjeseci kasnije "Ledana” ne radi, gradska tvrtka Nasadi koja upravlja tim javnim prostorom gubi prihode, na Trgovačkom sudu u Zadru traje sudski spor između Nasada i vlasnika "Ledane” oko međusobnih potraživanja, stari ugovor o korištenju javne površine je istekao, a novi nije potpisan. Osim toga, unatoč tragičnoj smrti irskog mladića - zaštitne ograde nema. Zašto?

- Postavljanje zaštitne ograde na bedemima nije u nadležnosti Nasada. To je zahvat nadležnog Upravnog odjela Grada Zadra na spomeniku kulture u vlasništvu Grada Zadra, odgovorili su medijima iz komunalnog poduzeća.

Iz Ureda gradonačelnika tvrde da će ograda biti postavljena ubrzo nakon što – bude izglasan novi gradski proračun!

- Grad Zadar je koncem prošle godine izradio elaborat postavljanja znakova upozorenja na bedemima u Perivoju kraljice Jelene i Parku Vladimira Nazora. U iščekivanju smo usvajanja proračuna kojim bismo osigurali sredstva za njihovo postavljanje. Paralelno s tim u prijedlogu programa održavanja javnih zelenih površina predložen je iznos od 50 tisuća eura Nasadima u cilju podizanja razine sigurnosti na obje lokacije u skladu s konzervatorskim uvjetima. Nakon usvajanja proračuna promptno ćemo aktivirati sve radove, kažu iz gradske uprave bez osvrta na činjenicu da je od smrtnog pada prošlo deset mjeseci, a "kriza oko proračuna” traje četiri mjeseca.
