Deset godina od izgradnje dionice ceste koja spaja Bribirske Mostine i Krković, Hrvatske ceste d. o.o., Ispostava Split, presudom Trgovačkog suda u Zadru, u roku od osam dana moraju isplatiti 1.3 milijuna kuna odštete vlasniku OPG-a Neni Galiću.
Vlasnik OPG-a iz Galića ih je tužio kao izvođača radova navodeći kako su mu izgradnjom te dionice ceste D-59 uništene 44 masline, te mu je oduzeto oko 2200 metara četvornih zemljišta i onemogućen pristup na šest nekretnina.

Uz naknadu za uništeno poljoprivredno zemljište od 1.379.250,00 kuna, tražio je i odštetu od 330.000,00 kuna za uništena 44 stabla masline.
Iako su Hrvatske ceste d.o.o. na sudu osporile njegovu tužbu navodeći kako je 'promašio legitimaciju' jer je 'izgrađena cesta javno dobro za što je pasivno legitimirana Republika Hrvatska', u postupku je nesporno utvrđeno kako su kao izvođači radova ipak odgovorni za nastalu štetu za uništeno poljoprivredno zemljište. Novčanu odštetu za 44 masline, sud pak nije prihvatio jer vlasnik OPG-a na nije mogao dokazati da su u vrijeme kada je cesta građena uistinu - postojale.

- Potrebno je naglasiti da je tužitelj pored imovinske štete za naknadu uništenog poljoprivrednog zemljišta od suda zatražio i naknadu imovinske štete za uništenje 44 stabla masline. Međutim, kao tužitelj nije napravio osiguranje dokaza iz kojih bi proizlazilo da je prije gradnje ceste na toj trasi bilo zasađeno 44 stabla masline, a kako je protekom deset godina od izvođenja radova skoro pa nemoguće utvrditi jesu li tu zaista bile masline, u tom dijelu je ovaj sud ocijenio da tužitelj nije dokazao da su na nekretnini bile zasađene masline i da u iste izvođenjem radova uništene, pa je stoga u odnosu na potraživanje za uništene na 44 stabla masline u iznosu od 330.000,00 kuna valjalo odbiti tužbeni zahtjev tužitelja kao neosnovan – navodi se u obrazloženju presude sutkinje Trgovačkog suda u Zadru Terezije Gorete.

Hrvatske ceste d.o.o. su na početku postupka osporile navode da bi prilikom rekonstrukcije ceste uopće došlo do oduzimanja nekretnina ili onemogućavanja pristupa kao i uništenja maslina.
No, osim uviđaja na mjestu spora na sudu je izveden i dokaz po vještaku geodetske struke Anti Marinu koji je u svom nalazu i mišljenju te skicama točno utvrdio da je tužitelju izgradnjom ceste oduzeto ili uništeno ili onemogućen pristup na poljoprivredno zemljište. Nadalje je vještak je naveo da je do svih tih podataka došao mjerenjem geodetskim instrumentima. Utvrdio je da je nemoguće utvrditi među jer je preko nje izgrađena cesta. Tako je neposrednim opažanjem nedvojbeno utvrđenog izmijenjenog položaja novoizgrađene ceste u odnosu na raniju, i vještačenjem utvrđeno da je cesta izmještena.

- Tuženik nije ni tvrdio, pa niti predložio dokaze o ishodovanju građevne dozvole i provedenom postupku izvlaštenja nekretnina koje je oduzeo izvedenim radovima. Imajući u vidu da je tuženik nesporno izvodio radove na nekretninama koje su bile u posjedu a sada u vlasništvu tužitelja, da je istom onemogućeno pristup nekim nekretninama a na nekim nije moguće više obavljati poljoprivrednu djelatnost, ovaj sud je ocijenio djelomično osnovanim tužbeni zahtjev tužitelja za naknadu imovinske štete za poljoprivredno zemljište - navodi se u presudi Trgovačkog suda u Zadru koji je u cijelosti prihvatio nalaz vještaka.

Deset godina od izgradnje dionice ceste koja spaja Bribirske Mostine i Krković, Hrvatske ceste d. o.o., Ispostava Split, presudom Trgovačkog suda u Zadru, u roku od osam dana moraju isplatiti 1.3 milijuna kuna odštete vlasniku OPG-a Neni Galiću.
Vlasnik OPG-a iz Galića ih je tužio kao izvođača radova navodeći kako su mu izgradnjom te dionice ceste D-59 uništene 44 masline, te mu je oduzeto oko 2200 metara četvornih zemljišta i onemogućen pristup na šest nekretnina.

Uz naknadu za uništeno poljoprivredno zemljište od 1.379.250,00 kuna, tražio je i odštetu od 330.000,00 kuna za uništena 44 stabla masline.
Iako su Hrvatske ceste d.o.o. na sudu osporile njegovu tužbu navodeći kako je 'promašio legitimaciju' jer je 'izgrađena cesta javno dobro za što je pasivno legitimirana Republika Hrvatska', u postupku je nesporno utvrđeno kako su kao izvođači radova ipak odgovorni za nastalu štetu za uništeno poljoprivredno zemljište. Novčanu odštetu za 44 masline, sud pak nije prihvatio jer vlasnik OPG-a na nije mogao dokazati da su u vrijeme kada je cesta građena uistinu - postojale.

- Potrebno je naglasiti da je tužitelj pored imovinske štete za naknadu uništenog poljoprivrednog zemljišta od suda zatražio i naknadu imovinske štete za uništenje 44 stabla masline. Međutim, kao tužitelj nije napravio osiguranje dokaza iz kojih bi proizlazilo da je prije gradnje ceste na toj trasi bilo zasađeno 44 stabla masline, a kako je protekom deset godina od izvođenja radova skoro pa nemoguće utvrditi jesu li tu zaista bile masline, u tom dijelu je ovaj sud ocijenio da tužitelj nije dokazao da su na nekretnini bile zasađene masline i da u iste izvođenjem radova uništene, pa je stoga u odnosu na potraživanje za uništene na 44 stabla masline u iznosu od 330.000,00 kuna valjalo odbiti tužbeni zahtjev tužitelja kao neosnovan – navodi se u obrazloženju presude sutkinje Trgovačkog suda u Zadru Terezije Gorete.

Hrvatske ceste d.o.o. su na početku postupka osporile navode da bi prilikom rekonstrukcije ceste uopće došlo do oduzimanja nekretnina ili onemogućavanja pristupa kao i uništenja maslina.
No, osim uviđaja na mjestu spora na sudu je izveden i dokaz po vještaku geodetske struke Anti Marinu koji je u svom nalazu i mišljenju te skicama točno utvrdio da je tužitelju izgradnjom ceste oduzeto ili uništeno ili onemogućen pristup na poljoprivredno zemljište. Nadalje je vještak je naveo da je do svih tih podataka došao mjerenjem geodetskim instrumentima. Utvrdio je da je nemoguće utvrditi među jer je preko nje izgrađena cesta. Tako je neposrednim opažanjem nedvojbeno utvrđenog izmijenjenog položaja novoizgrađene ceste u odnosu na raniju, i vještačenjem utvrđeno da je cesta izmještena.

- Tuženik nije ni tvrdio, pa niti predložio dokaze o ishodovanju građevne dozvole i provedenom postupku izvlaštenja nekretnina koje je oduzeo izvedenim radovima. Imajući u vidu da je tuženik nesporno izvodio radove na nekretninama koje su bile u posjedu a sada u vlasništvu tužitelja, da je istom onemogućeno pristup nekim nekretninama a na nekim nije moguće više obavljati poljoprivrednu djelatnost, ovaj sud je ocijenio djelomično osnovanim tužbeni zahtjev tužitelja za naknadu imovinske štete za poljoprivredno zemljište - navodi se u presudi Trgovačkog suda u Zadru koji je u cijelosti prihvatio nalaz vještaka.

Hrvatske ceste moraju isplatiti 1.3 milijuna kuna odštete vlasniku OPG-a: izgradnjom ceste uništili su mu zemljište i 44 masline!

Deset godina od izgradnje dionice ceste koja spaja Bribirske Mostine i Krković, Hrvatske ceste d. o.o., Ispostava Split, presudom Trgovačkog suda u Zadru, u roku od osam dana moraju isplatiti 1.3 milijuna kuna odštete vlasniku OPG-a Neni Galiću.
Vlasnik OPG-a iz Galića ih je tužio kao izvođača radova navodeći kako su mu izgradnjom te dionice ceste D-59 uništene 44 masline, te mu je oduzeto oko 2200 metara četvornih zemljišta i onemogućen pristup na šest nekretnina.

Uz naknadu za uništeno poljoprivredno zemljište od 1.379.250,00 kuna, tražio je i odštetu od 330.000,00 kuna za uništena 44 stabla masline.
Iako su Hrvatske ceste d.o.o. na sudu osporile njegovu tužbu navodeći kako je 'promašio legitimaciju' jer je 'izgrađena cesta javno dobro za što je pasivno legitimirana Republika Hrvatska', u postupku je nesporno utvrđeno kako su kao izvođači radova ipak odgovorni za nastalu štetu za uništeno poljoprivredno zemljište. Novčanu odštetu za 44 masline, sud pak nije prihvatio jer vlasnik OPG-a na nije mogao dokazati da su u vrijeme kada je cesta građena uistinu - postojale.

- Potrebno je naglasiti da je tužitelj pored imovinske štete za naknadu uništenog poljoprivrednog zemljišta od suda zatražio i naknadu imovinske štete za uništenje 44 stabla masline. Međutim, kao tužitelj nije napravio osiguranje dokaza iz kojih bi proizlazilo da je prije gradnje ceste na toj trasi bilo zasađeno 44 stabla masline, a kako je protekom deset godina od izvođenja radova skoro pa nemoguće utvrditi jesu li tu zaista bile masline, u tom dijelu je ovaj sud ocijenio da tužitelj nije dokazao da su na nekretnini bile zasađene masline i da u iste izvođenjem radova uništene, pa je stoga u odnosu na potraživanje za uništene na 44 stabla masline u iznosu od 330.000,00 kuna valjalo odbiti tužbeni zahtjev tužitelja kao neosnovan – navodi se u obrazloženju presude sutkinje Trgovačkog suda u Zadru Terezije Gorete.

Hrvatske ceste d.o.o. su na početku postupka osporile navode da bi prilikom rekonstrukcije ceste uopće došlo do oduzimanja nekretnina ili onemogućavanja pristupa kao i uništenja maslina.
