Europski sud za ljudska prava dosudio je odštetu od 12.000 eura uhićeniku koji je Hrvatsku tužio za povredu prava na zabranu mučenja i nečovječnog postupanja nakon što je priveden zbog napada na policajca. Radi se o slučaju iz 2011. kada je dotičlni pijan na javnom mjestu nasrnuo na policajca. Nakon što je doveden u policijsku postaju, pregledao ga je liječnik koji je ustanovio da ima posjekotinu iznad oka.

Protiv njega je pokrenut prvo prekršajni postupak zbog remećenja javnog reda i mira, a nakon toga i kazneni postupak zbog napada na službenu osobu, prenosi N1.

Iako je uhićenik ustrajao na tome da su ga na putu do postaje pretukli policajci, policija je tvrdila da je vezan lisicama skočio iz "marice" i udario glavom u tlo. Sljedećeg dana je pušten te je otišao na liječnički pregled. Tamo je utvrđeno da je imao slomljeni nos i rebro te modrice ispod oba oka, na obje nadlaktice i lijevoj strani tijela.

U kaznenom postupku istaknuo je da ga je pretukla policija pa je sud naložio vještačenja. Vještak je utvrdio da je moguće da je podnositelj sve navedene ozljede zadobio prije prvog liječničkog pregleda u policijskoj postaji, ali da je moguće da ih je zadobio i kasnije. U svakom slučaju, rekao je, podnositelju nije moglo puknuti rebro na način na koji je to opisala policija.

Podnositelj je osuđen u kaznenom postupku, a Ustavni sud odbio mu je ustavnu tužbu ne osvrćući se na prigovore o zlostavljanju. ESLJP je utvrdio da Hrvatska nije pružila uvjerljive dokaze da je podnositelj ozlijeđen na drugi način nego kako je on opisao, pri čemu se oslonio i na nalaz vještaka. Također je utvrdio da nijedno hrvatsko tijelo nije utvrdilo uzrok ozljeda. Sud je podnositelju dao za pravo i da hrvatska tijela nisu provela učinkovitu istragu navoda o zlostavljanju.

Uz 12.000 eura odštete zbog povrede zajamčenih prava, konačnom presudom, podnositelju je dosuđena i naknada od 3.000 eura zbog troškova postupka.

Europski sud za ljudska prava dosudio je odštetu od 12.000 eura uhićeniku koji je Hrvatsku tužio za povredu prava na zabranu mučenja i nečovječnog postupanja nakon što je priveden zbog napada na policajca. Radi se o slučaju iz 2011. kada je dotičlni pijan na javnom mjestu nasrnuo na policajca. Nakon što je doveden u policijsku postaju, pregledao ga je liječnik koji je ustanovio da ima posjekotinu iznad oka.

Protiv njega je pokrenut prvo prekršajni postupak zbog remećenja javnog reda i mira, a nakon toga i kazneni postupak zbog napada na službenu osobu, prenosi N1.

Iako je uhićenik ustrajao na tome da su ga na putu do postaje pretukli policajci, policija je tvrdila da je vezan lisicama skočio iz "marice" i udario glavom u tlo. Sljedećeg dana je pušten te je otišao na liječnički pregled. Tamo je utvrđeno da je imao slomljeni nos i rebro te modrice ispod oba oka, na obje nadlaktice i lijevoj strani tijela.

U kaznenom postupku istaknuo je da ga je pretukla policija pa je sud naložio vještačenja. Vještak je utvrdio da je moguće da je podnositelj sve navedene ozljede zadobio prije prvog liječničkog pregleda u policijskoj postaji, ali da je moguće da ih je zadobio i kasnije. U svakom slučaju, rekao je, podnositelju nije moglo puknuti rebro na način na koji je to opisala policija.

Podnositelj je osuđen u kaznenom postupku, a Ustavni sud odbio mu je ustavnu tužbu ne osvrćući se na prigovore o zlostavljanju. ESLJP je utvrdio da Hrvatska nije pružila uvjerljive dokaze da je podnositelj ozlijeđen na drugi način nego kako je on opisao, pri čemu se oslonio i na nalaz vještaka. Također je utvrdio da nijedno hrvatsko tijelo nije utvrdilo uzrok ozljeda. Sud je podnositelju dao za pravo i da hrvatska tijela nisu provela učinkovitu istragu navoda o zlostavljanju.

Policajci ga prebili pa tvrdili da je skočio iz marice u lisicama. Tužio je Hrvatsku Strasbourgu i dobio 15.000 eura

Europski sud za ljudska prava dosudio je odštetu od 12.000 eura uhićeniku koji je Hrvatsku tužio za povredu prava na zabranu mučenja i nečovječnog postupanja nakon što je priveden zbog napada na policajca. Radi se o slučaju iz 2011. kada je dotičlni pijan na javnom mjestu nasrnuo na policajca. Nakon što je doveden u policijsku postaju, pregledao ga je liječnik koji je ustanovio da ima posjekotinu iznad oka.

Protiv njega je pokrenut prvo prekršajni postupak zbog remećenja javnog reda i mira, a nakon toga i kazneni postupak zbog napada na službenu osobu, prenosi N1.

Iako je uhićenik ustrajao na tome da su ga na putu do postaje pretukli policajci, policija je tvrdila da je vezan lisicama skočio iz "marice" i udario glavom u tlo. Sljedećeg dana je pušten te je otišao na liječnički pregled. Tamo je utvrđeno da je imao slomljeni nos i rebro te modrice ispod oba oka, na obje nadlaktice i lijevoj strani tijela.

U kaznenom postupku istaknuo je da ga je pretukla policija pa je sud naložio vještačenja. Vještak je utvrdio da je moguće da je podnositelj sve navedene ozljede zadobio prije prvog liječničkog pregleda u policijskoj postaji, ali da je moguće da ih je zadobio i kasnije. U svakom slučaju, rekao je, podnositelju nije moglo puknuti rebro na način na koji je to opisala policija.

Podnositelj je osuđen u kaznenom postupku, a Ustavni sud odbio mu je ustavnu tužbu ne osvrćući se na prigovore o zlostavljanju. ESLJP je utvrdio da Hrvatska nije pružila uvjerljive dokaze da je podnositelj ozlijeđen na drugi način nego kako je on opisao, pri čemu se oslonio i na nalaz vještaka. Također je utvrdio da nijedno hrvatsko tijelo nije utvrdilo uzrok ozljeda. Sud je podnositelju dao za pravo i da hrvatska tijela nisu provela učinkovitu istragu navoda o zlostavljanju.
