Goran Aleksić, boraca za prava građana koji su uzeli kredit u ‘švicarcima‘, napisaO je zanimljiv status. Pa kaže:

Sisački sudac Vedran Medaković, jedan od najboljih hrvatskih sudaca, svojom prvostupanjskom presudom od 13.10.23. profesorski je objasnio sljedeće detalje:
1. Razloge zbog kojih potrošači i nakon konverzije imaju pravo na obeštećenje.
2. Nemogućnost da se negativne razlike anuiteta prebijaju s potraživanjima potrošača, a te razlike nastale su za vrijeme dok su anuiteti bili niži od početno ugovorenih.
3. Nemogućnost da se preplata iz konverzije prebija s potraživanjima potrošača.
Potrošača koji je već drugi put po istom predmetu na prvome stupnju pobijedio Privrednu banku Zagreb zastupali su odvjetnici iz Siska, Danko Kovač i Ivan Borić.
Na slikama (DOLJE) su izvaci iz presude, koje preporučujemo pročitati detaljno, jer je sudac Medaković vrlo jednostavno objasnio naša prava, tako da je to razumljivo i ljudima koji ne poznaju pravo, a kako onda ne bi bilo jasno sucima viših sudova.
Ukratko, radi se o sljedećem:
1. Potrošač ima pravo na obeštećenje, ako konverzijom nije dobio sve ono što mu pripada na temelju izuzeća ništetnih ugovornih odredaba. Vještačenjem je utvrđeno da konverzijom nisu vraćeni preplaćeni anuiteti, da nije plaćena niti pripadajuća zatezna kamata te da je preostala glavnica nakon konverzije veća za oko 10 % od glavnice na koju potrošač ima pravo izuzećem ništetnih odredaba.
2. Negativne razlike anuiteta koje su bile niže od početno ugovorenih, banke nemaju pravo prebijati s preplaćenim anuitetima jer su ti iznosi za banke u zastari.
3. Preplata iz konverzije izračunana je potpuno drugom metodologijom od metodologije za izračun preplaćenih anuiteta, i stoga se preplata iz konverzije ne može odbijati od preplaćenih iznosa anuiteta.
Mi bismo samo na to dodali, ako bi možda jednom Vrhovni sud ipak odlučio da se preplate iz konverzije moraju odbiti od preplaćenih anuiteta, onda je to odbijanje moguće samo od zateznih kamata, jer se dospjeli dugovi vraćaju tako da se najprije plaćaju zatezne kamate, pa tek potom vraća glavnica duga. U skladu s time, preplata iz konverzije može se odbiti samo od zateznih kamata dospjelih do dana konverzije.
Nadamo se da će ta presuda doprijeti i do sudaca Vrhovnog suda RH, kojima ona također može biti vrlo poučno štivo, budući da se suci općinskih sudova puno temeljitije bave tom temom od sudaca viših sudova.
Uostalom, i predsjednik VSRH svojevremeno je kao sudac trgovačkog suda sve detaljno i kvalitetno obrazložio u kolektivnoj presudi, dok je sucima viših sudova trebalo punih 5 godina da shvate ono što je njemu bilo jasno u roku od godinu dana.

Goran Aleksić, boraca za prava građana koji su uzeli kredit u ‘švicarcima‘, napisaO je zanimljiv status. Pa kaže:
OPĆINSKI SUDAC VEDRAN MEDAKOVIĆ IZ SISKA, SVOJOM MAESTRALNOM PRESUDOM RASTAVIO JE KONVERZIJU NA PROSTE FAKTORE!
Sisački sudac Vedran Medaković, jedan od najboljih hrvatskih sudaca, svojom prvostupanjskom presudom od 13.10.23. profesorski je objasnio sljedeće detalje:
1. Razloge zbog kojih potrošači i nakon konverzije imaju pravo na obeštećenje.
2. Nemogućnost da se negativne razlike anuiteta prebijaju s potraživanjima potrošača, a te razlike nastale su za vrijeme dok su anuiteti bili niži od početno ugovorenih.
3. Nemogućnost da se preplata iz konverzije prebija s potraživanjima potrošača.
Potrošača koji je već drugi put po istom predmetu na prvome stupnju pobijedio Privrednu banku Zagreb zastupali su odvjetnici iz Siska, Danko Kovač i Ivan Borić.
Na slikama (DOLJE) su izvaci iz presude, koje preporučujemo pročitati detaljno, jer je sudac Medaković vrlo jednostavno objasnio naša prava, tako da je to razumljivo i ljudima koji ne poznaju pravo, a kako onda ne bi bilo jasno sucima viših sudova.
Ukratko, radi se o sljedećem:
1. Potrošač ima pravo na obeštećenje, ako konverzijom nije dobio sve ono što mu pripada na temelju izuzeća ništetnih ugovornih odredaba. Vještačenjem je utvrđeno da konverzijom nisu vraćeni preplaćeni anuiteti, da nije plaćena niti pripadajuća zatezna kamata te da je preostala glavnica nakon konverzije veća za oko 10 % od glavnice na koju potrošač ima pravo izuzećem ništetnih odredaba.
2. Negativne razlike anuiteta koje su bile niže od početno ugovorenih, banke nemaju pravo prebijati s preplaćenim anuitetima jer su ti iznosi za banke u zastari.
3. Preplata iz konverzije izračunana je potpuno drugom metodologijom od metodologije za izračun preplaćenih anuiteta, i stoga se preplata iz konverzije ne može odbijati od preplaćenih iznosa anuiteta.
Mi bismo samo na to dodali, ako bi možda jednom Vrhovni sud ipak odlučio da se preplate iz konverzije moraju odbiti od preplaćenih anuiteta, onda je to odbijanje moguće samo od zateznih kamata, jer se dospjeli dugovi vraćaju tako da se najprije plaćaju zatezne kamate, pa tek potom vraća glavnica duga. U skladu s time, preplata iz konverzije može se odbiti samo od zateznih kamata dospjelih do dana konverzije.
Nadamo se da će ta presuda doprijeti i do sudaca Vrhovnog suda RH, kojima ona također može biti vrlo poučno štivo, budući da se suci općinskih sudova puno temeljitije bave tom temom od sudaca viših sudova.
Uostalom, i predsjednik VSRH svojevremeno je kao sudac trgovačkog suda sve detaljno i kvalitetno obrazložio u kolektivnoj presudi, dok je sucima viših sudova trebalo punih 5 godina da shvate ono što je njemu bilo jasno u roku od godinu dana.
