Europski sud za ljudska prava (ESLJP) proglasio je neosnovanim zahtjev (tužbu) Srpske pravoslavne crkve da joj je povrijeđeno pravo vlasništva zbog navodno premalenog iznosa dobivenog za povrat zemljišta koje joj je oduzeto u vrijeme SFRJ, a na kojem se danas nalazi hidroelektrana Peruća.

ESLJP je također je nedopuštenim proglasio i zahtjev SPC-a da joj je povrijeđeno pravo na pošteno suđenje zbog retroaktivne primjene domaćih propisa.

Kako je u četvrtak priopćeno iz Ureda zastupnika Republike Hrvatske pred Europskim sudom za ljudska prava, Srpska pravoslavna crkva smatrala se financijski oštećenom zbog iznosa naknade za to poljoprivredno zemljište.

Iznos se temeljio na odredbama Pravilnika o mjerilima za utvrđivanje vrijednosti oduzetoga poljoprivrednog zemljišta, šuma i šumskog zemljišta koji je bio više puta mijenjan tijekom postupka isplate naknade za to zemljište.

Europski sud je naveo da država ima široku slobodu procjene u pitanjima povrata imovine te da je propis temeljem kojeg je SPC obračunata naknada bio u skladu s općim interesom. Sud je primijetio da je SPC dodijeljen srednji iznos naknade za oduzeto zemljište koji nije nerazumno mali, posebice imajući u vidu da je isti gotovo tri puta premašio iznos koji je SPC mogla očekivati prema propisu koji je bio na snazi na početku postupka. Stoga je Sud utvrdio da je ovakvo miješanje države u pravo na mirno uživanje prava vlasništva SPC bilo u skladu s  Konvencijom za zaštitu ljudskih prava i temeljnih sloboda.

U kontekstu prava na pošteno suđenje Europski sud je prigovor SPC proglasio nedopuštenim jer su domaća upravna tijela imala pravo primijeniti posljednji propis koji je bio na snazi prije donošenja odluke o naknadi, a temeljem kojeg je SPC dodijeljena tri puta veća naknada od one koju bi ostvarila temeljem propisa koji je bio na snazi ranije, stoji u priopćenju za javnost Ureda zastupnika RH pred Europskim sudom za ljudska prava.

Ova odluka je konačna te je dostupna na web stranici Suda (www.echr.coe.int/hudoc) na engleskom jeziku, a nakon prijevoda na hrvatski jezik, bit će dostupan na web stranici Ureda zastupnika  Republike Hrvatske pred Europskim sudom za ljudska prava.

Europski sud za ljudska prava (ESLJP) proglasio je neosnovanim zahtjev (tužbu) Srpske pravoslavne crkve da joj je povrijeđeno pravo vlasništva zbog navodno premalenog iznosa dobivenog za povrat zemljišta koje joj je oduzeto u vrijeme SFRJ, a na kojem se danas nalazi hidroelektrana Peruća.

ESLJP je također je nedopuštenim proglasio i zahtjev SPC-a da joj je povrijeđeno pravo na pošteno suđenje zbog retroaktivne primjene domaćih propisa.

Kako je u četvrtak priopćeno iz Ureda zastupnika Republike Hrvatske pred Europskim sudom za ljudska prava, Srpska pravoslavna crkva smatrala se financijski oštećenom zbog iznosa naknade za to poljoprivredno zemljište.

Iznos se temeljio na odredbama Pravilnika o mjerilima za utvrđivanje vrijednosti oduzetoga poljoprivrednog zemljišta, šuma i šumskog zemljišta koji je bio više puta mijenjan tijekom postupka isplate naknade za to zemljište.

Europski sud je naveo da država ima široku slobodu procjene u pitanjima povrata imovine te da je propis temeljem kojeg je SPC obračunata naknada bio u skladu s općim interesom. Sud je primijetio da je SPC dodijeljen srednji iznos naknade za oduzeto zemljište koji nije nerazumno mali, posebice imajući u vidu da je isti gotovo tri puta premašio iznos koji je SPC mogla očekivati prema propisu koji je bio na snazi na početku postupka. Stoga je Sud utvrdio da je ovakvo miješanje države u pravo na mirno uživanje prava vlasništva SPC bilo u skladu s  Konvencijom za zaštitu ljudskih prava i temeljnih sloboda.

U kontekstu prava na pošteno suđenje Europski sud je prigovor SPC proglasio nedopuštenim jer su domaća upravna tijela imala pravo primijeniti posljednji propis koji je bio na snazi prije donošenja odluke o naknadi, a temeljem kojeg je SPC dodijeljena tri puta veća naknada od one koju bi ostvarila temeljem propisa koji je bio na snazi ranije, stoji u priopćenju za javnost Ureda zastupnika RH pred Europskim sudom za ljudska prava.

Ova odluka je konačna te je dostupna na web stranici Suda (www.echr.coe.int/hudoc) na engleskom jeziku, a nakon prijevoda na hrvatski jezik, bit će dostupan na web stranici Ureda zastupnika  Republike Hrvatske pred Europskim sudom za ljudska prava.

Odbijena tužba Srpske pravoslavne crkve, nemaju pravo na dodatnu naknadu za zemljište kod Peruće

Europski sud za ljudska prava (ESLJP) proglasio je neosnovanim zahtjev (tužbu) Srpske pravoslavne crkve da joj je povrijeđeno pravo vlasništva zbog navodno premalenog iznosa dobivenog za povrat zemljišta koje joj je oduzeto u vrijeme SFRJ, a na kojem se danas nalazi hidroelektrana Peruća.

ESLJP je također je nedopuštenim proglasio i zahtjev SPC-a da joj je povrijeđeno pravo na pošteno suđenje zbog retroaktivne primjene domaćih propisa.

Kako je u četvrtak priopćeno iz Ureda zastupnika Republike Hrvatske pred Europskim sudom za ljudska prava, Srpska pravoslavna crkva smatrala se financijski oštećenom zbog iznosa naknade za to poljoprivredno zemljište.

Iznos se temeljio na odredbama Pravilnika o mjerilima za utvrđivanje vrijednosti oduzetoga poljoprivrednog zemljišta, šuma i šumskog zemljišta koji je bio više puta mijenjan tijekom postupka isplate naknade za to zemljište.

Europski sud je naveo da država ima široku slobodu procjene u pitanjima povrata imovine te da je propis temeljem kojeg je SPC obračunata naknada bio u skladu s općim interesom. Sud je primijetio da je SPC dodijeljen srednji iznos naknade za oduzeto zemljište koji nije nerazumno mali, posebice imajući u vidu da je isti gotovo tri puta premašio iznos koji je SPC mogla očekivati prema propisu koji je bio na snazi na početku postupka. Stoga je Sud utvrdio da je ovakvo miješanje države u pravo na mirno uživanje prava vlasništva SPC bilo u skladu s  Konvencijom za zaštitu ljudskih prava i temeljnih sloboda.

U kontekstu prava na pošteno suđenje Europski sud je prigovor SPC proglasio nedopuštenim jer su domaća upravna tijela imala pravo primijeniti posljednji propis koji je bio na snazi prije donošenja odluke o naknadi, a temeljem kojeg je SPC dodijeljena tri puta veća naknada od one koju bi ostvarila temeljem propisa koji je bio na snazi ranije, stoji u priopćenju za javnost Ureda zastupnika RH pred Europskim sudom za ljudska prava.

Ova odluka je konačna te je dostupna na web stranici Suda (www.echr.coe.int/hudoc) na engleskom jeziku, a nakon prijevoda na hrvatski jezik, bit će dostupan na web stranici Ureda zastupnika  Republike Hrvatske pred Europskim sudom za ljudska prava.
