Ustavnopravni stručnjak i profesor Ustavnog prava na Pravnom fakultetu u Osijeku, Mato Palić, za Radio Sljeme komentirao je mjeru koji je zatražio zagrebački Stožer, a koja bi propisivala da se maske moraju nositi na otvorenom, prenosi N1. 

Prema Paliću, takvu odluku, ako bude donesena, najvjerojatnije bi ukinuo Ustavni sud. Naime, Palić tvrdi da se radi o ustavnopravno dvojbenoj odluci. 

“Ta odluka, po mom mišljenju, ne prolazi test razmjernosti. Dakle, ne može biti ista vrsta obveze, a to je obvezno nošenje maske, predviđena i u otvorenim i u zatvorenim prostorima ako ne postoji čvrst dokaz da se virus jednakom brzinom širi i u otvorenim i u zatvorenim prostorima. Dakle, ne može biti ista obveza za različite situacije”, kaže.

Palić dodaje kako bi ovakva odluka trebala imati čvrste temelje u istraživanjima, a da to ovdje nije slučaj.

“Mi nemamo objašnjenje zašto su maske obvezne i u otvorenom i u zatvorenom prostoru, a to je velika razlika. Dakle, nije isto kad u trgovačkom centru, u zatvorenom prostoru ljudi cirkuliraju i nije isto kada se isti broj ljudi kreće na puno većoj površini vani. Dakle, nije isto 500 ljudi u trgovini i 500 ljudi vani”, zaključio je Palić.

Za razliku od njega, profesorica ustavnog prava na Pravnom fakultetu u Rijeci Sanja Barić drži da eventualna odluka Stožera o obveznom nošenju maski u Zagrebu na otvorenom prostoru nije ustavnopravno problematična.

"U tome ne vidim neku specijalnu ustavnopravno dvojbu. Ima puno ozbiljnijih prava koja se krše (mjerama), na puno ozbiljniji način", kazala je ustavna stručnjakinja Barić za Hinu.

Ističe da je takva odluka već donesena i u nekim drugim državama, a da je takva obveza najmanje invazivna prema pitanjima prava i sloboda osoba.

Ustavnopravni stručnjak i profesor Ustavnog prava na Pravnom fakultetu u Osijeku, Mato Palić, za Radio Sljeme komentirao je mjeru koji je zatražio zagrebački Stožer, a koja bi propisivala da se maske moraju nositi na otvorenom, prenosi N1. 

Prema Paliću, takvu odluku, ako bude donesena, najvjerojatnije bi ukinuo Ustavni sud. Naime, Palić tvrdi da se radi o ustavnopravno dvojbenoj odluci. 

“Ta odluka, po mom mišljenju, ne prolazi test razmjernosti. Dakle, ne može biti ista vrsta obveze, a to je obvezno nošenje maske, predviđena i u otvorenim i u zatvorenim prostorima ako ne postoji čvrst dokaz da se virus jednakom brzinom širi i u otvorenim i u zatvorenim prostorima. Dakle, ne može biti ista obveza za različite situacije”, kaže.

Palić dodaje kako bi ovakva odluka trebala imati čvrste temelje u istraživanjima, a da to ovdje nije slučaj.

“Mi nemamo objašnjenje zašto su maske obvezne i u otvorenom i u zatvorenom prostoru, a to je velika razlika. Dakle, nije isto kad u trgovačkom centru, u zatvorenom prostoru ljudi cirkuliraju i nije isto kada se isti broj ljudi kreće na puno većoj površini vani. Dakle, nije isto 500 ljudi u trgovini i 500 ljudi vani”, zaključio je Palić.

Za razliku od njega, profesorica ustavnog prava na Pravnom fakultetu u Rijeci Sanja Barić drži da eventualna odluka Stožera o obveznom nošenju maski u Zagrebu na otvorenom prostoru nije ustavnopravno problematična.

"U tome ne vidim neku specijalnu ustavnopravno dvojbu. Ima puno ozbiljnijih prava koja se krše (mjerama), na puno ozbiljniji način", kazala je ustavna stručnjakinja Barić za Hinu.

Ističe da je takva odluka već donesena i u nekim drugim državama, a da je takva obveza najmanje invazivna prema pitanjima prava i sloboda osoba.

Mato Palić: Odluka o nošenju maski na otvorenom nema temelja; Sanja Barić: Ne vidim po čemu je ta mjera problematična

Ustavnopravni stručnjak i profesor Ustavnog prava na Pravnom fakultetu u Osijeku, Mato Palić, za Radio Sljeme komentirao je mjeru koji je zatražio zagrebački Stožer, a koja bi propisivala da se maske moraju nositi na otvorenom, prenosi N1. 

Prema Paliću, takvu odluku, ako bude donesena, najvjerojatnije bi ukinuo Ustavni sud. Naime, Palić tvrdi da se radi o ustavnopravno dvojbenoj odluci. 

“Ta odluka, po mom mišljenju, ne prolazi test razmjernosti. Dakle, ne može biti ista vrsta obveze, a to je obvezno nošenje maske, predviđena i u otvorenim i u zatvorenim prostorima ako ne postoji čvrst dokaz da se virus jednakom brzinom širi i u otvorenim i u zatvorenim prostorima. Dakle, ne može biti ista obveza za različite situacije”, kaže.

Palić dodaje kako bi ovakva odluka trebala imati čvrste temelje u istraživanjima, a da to ovdje nije slučaj.

“Mi nemamo objašnjenje zašto su maske obvezne i u otvorenom i u zatvorenom prostoru, a to je velika razlika. Dakle, nije isto kad u trgovačkom centru, u zatvorenom prostoru ljudi cirkuliraju i nije isto kada se isti broj ljudi kreće na puno većoj površini vani. Dakle, nije isto 500 ljudi u trgovini i 500 ljudi vani”, zaključio je Palić.

Za razliku od njega, profesorica ustavnog prava na Pravnom fakultetu u Rijeci Sanja Barić drži da eventualna odluka Stožera o obveznom nošenju maski u Zagrebu na otvorenom prostoru nije ustavnopravno problematična.

"U tome ne vidim neku specijalnu ustavnopravno dvojbu. Ima puno ozbiljnijih prava koja se krše (mjerama), na puno ozbiljniji način", kazala je ustavna stručnjakinja Barić za Hinu.

Ističe da je takva odluka već donesena i u nekim drugim državama, a da je takva obveza najmanje invazivna prema pitanjima prava i sloboda osoba.
