Poznata hrvatska glumica Sanja Vejnović (60) dobila je, nepravomoćnom presudom zagrebačkog Općinskog građanskog suda, ukupno više od 140 tisuća kuna naknade štete i troškova koje joj je dužna isplatiti Poliklinika "Sinteza" d.o.o. Zagreb.

Glumica je dobila presudu jer je Poliklinika neovlašteno objavila njezine fotografije s iglom uperenom u lice, što, pak, po presudi, "implicira da se tužiteljica podvrgava estetskim zahvatima poput filera, botoksa i sl., a uzimajući u obzir da se isto kosi s njezinim osobnim stavovima i poslovnim angažmanima u kojima zagovara prirodan izgled, prirodnu kozmetiku i tretmane, doista je narušen njezin ugled, čast i privatnost osobnog i obiteljskog života jer ispada da tužiteljica laže".

Veći dio novca, 107 tisuća kuna, dobila je zbog izgubljene zarade, odnosno zato jer je sud utvrdio da joj je zbog objavljenih fotografija propao jedan već dogovoreni poslovni ugovor.

Vejnović je u tužbi podnesenoj u studenome 2019. godine navela da su je početkom ožujka 2016. kontaktirali iz Poliklinike s prijedlogom da bude njihovo zaštitno lice kampanje neinvazivnih tretmana, što je podrazumijevalo korištenje njezinih fotografija u promidžbene svrhe na internetskim portalima i u svim ostalim medijima. Glumica je zatražila da joj dostave prijedlog ugovora te ponudu honorara, no Poliklinika je inzistirala da je prije sklapanja ugovora fotografiraju kako bi odabrali fotografije koje će koristiti u reklamne svrhe.

Narušen ugled

Nakon fotografiranja, pak, umjesto honorara, ponudili su joj plaćanje u vidu besplatnih tretmana, što je ona odbila te je izričito zabranila korištenje njezinih fotografija u bilo koje svrhe. No, usprkos tome, Poliklinika je tijekom ožujka 2016. godine, stoji u tužbi, na svojim internetskim stranicama iskoristila njezine fotografije na kojima se vidi ona s iglom uperenom u lice te su uklonjene tek nakon nekoliko upozorenja. No, u srpnju 2018. godine Poliklinika opet, bez dozvole glumice, na svojim internetskim stranicama objavljuje njezine fotografije.

– Predmetne fotografije prikazuju kako tužiteljici ubrizgavaju injekciju u obraz, a što implicira da se tužiteljica podvrgava estetskim zahvatima poput filera i botoksa, a što joj je s obzirom na njezinu profesiju glumice prouzročilo znatne neugodnosti, te su iste utjecale na njezin ugled, kako privatno, tako i profesionalno.

Tužiteljica ukazuje kako je uslijed protupravnog korištenja njezinih fotografija stvorena kriva predodžba javnosti o njoj kao ženi koja koristi agresivne metode pomlađivanja, što je u izričitoj suprotnosti s njezinim osobnim stavovima, kao i poslovnim angažmanima u kojima zagovara prirodan izgled, kao i prirodnu kozmetiku i tretmane.

Obzirom da kontekst fotografije ostavlja dojam da se podvrgava invazivnim estetskim zahvatima, tužiteljici je narušen ugled prirodne ljepote, pa su stoga otkazane postojeće, te su izostale potencijalne buduće poslovne suradnje na kampanjama koje promoviraju prirodnu ljepotu i njegu. Budući da je po zanimanju glumica, ovime je javno osramoćena te je ozbiljno narušen njezin ugled kao javne osobe, pogotovo jer je uvijek isticala prirodnost svog izgleda – stajalo je u njezinoj tužbi protiv Poliklinike.

Lipoliza podbratka

Iz Poliklinike su tvrdili da nisu oni ponudili glumici suradnju, već PR agencija "Start design" d.o.o., te da je dogovoreno da će Vejnović kao naknadu za korištenje fotografija dobiti besplatne tretmane za uljepšavanje. Kada su fotografije rađene, glumica je, tvrdili su iz Poliklinike, postavila dodatni zahtjev za tretmanom laserske lipolize podbratka, koji je jako skup i koji se njima nije isplatio pa su to odbili. Kazali su i da su prvi put uklonili fotografije, a drugi put su ih objavili zabunom i "bez znanja i prepoznavanja tužiteljice na fotografiji".

– Navedena fotografija ne implicira da bi osoba na fotografiji bila podvrgnuta bilo kakvim invazivnim tretmanima. Tužiteljica je više puta, u razdoblju prije i poslije u odnosu na vrijeme kada je tuženik pogreškom stavio predmetnu fotografiju na internetsku stranicu, sudjelovala u raznim tretmanima kod drugih fizičkih i pravnih osoba, prilikom čega je objavljeno više fotografija te jedan video na kojima se vidi potpuna fotografija tužiteljice s iglom u neposrednoj blizini lica.

Našu internetsku stranicu, na mjestu gdje je pogreškom bila objavljena predmetna fotografija, u razdoblju od 1. siječnja 2018. godine do dana uklanjanja je posjetilo samo četvero ljudi, a fotografija igle blizu njenog lica objavljena u visokotiražnom časopisu u Hrvatskoj i u videu na YouTubeu imala je 482 pogleda, pa je nemoguće povjerovati da je postojalo bilo kakvo narušavanje ugleda – naveli su iz Poliklinike.

Poznata hrvatska glumica Sanja Vejnović (60) dobila je, nepravomoćnom presudom zagrebačkog Općinskog građanskog suda, ukupno više od 140 tisuća kuna naknade štete i troškova koje joj je dužna isplatiti Poliklinika "Sinteza" d.o.o. Zagreb.

Glumica je dobila presudu jer je Poliklinika neovlašteno objavila njezine fotografije s iglom uperenom u lice, što, pak, po presudi, "implicira da se tužiteljica podvrgava estetskim zahvatima poput filera, botoksa i sl., a uzimajući u obzir da se isto kosi s njezinim osobnim stavovima i poslovnim angažmanima u kojima zagovara prirodan izgled, prirodnu kozmetiku i tretmane, doista je narušen njezin ugled, čast i privatnost osobnog i obiteljskog života jer ispada da tužiteljica laže".

Veći dio novca, 107 tisuća kuna, dobila je zbog izgubljene zarade, odnosno zato jer je sud utvrdio da joj je zbog objavljenih fotografija propao jedan već dogovoreni poslovni ugovor.

Vejnović je u tužbi podnesenoj u studenome 2019. godine navela da su je početkom ožujka 2016. kontaktirali iz Poliklinike s prijedlogom da bude njihovo zaštitno lice kampanje neinvazivnih tretmana, što je podrazumijevalo korištenje njezinih fotografija u promidžbene svrhe na internetskim portalima i u svim ostalim medijima. Glumica je zatražila da joj dostave prijedlog ugovora te ponudu honorara, no Poliklinika je inzistirala da je prije sklapanja ugovora fotografiraju kako bi odabrali fotografije koje će koristiti u reklamne svrhe.

Narušen ugled

Nakon fotografiranja, pak, umjesto honorara, ponudili su joj plaćanje u vidu besplatnih tretmana, što je ona odbila te je izričito zabranila korištenje njezinih fotografija u bilo koje svrhe. No, usprkos tome, Poliklinika je tijekom ožujka 2016. godine, stoji u tužbi, na svojim internetskim stranicama iskoristila njezine fotografije na kojima se vidi ona s iglom uperenom u lice te su uklonjene tek nakon nekoliko upozorenja. No, u srpnju 2018. godine Poliklinika opet, bez dozvole glumice, na svojim internetskim stranicama objavljuje njezine fotografije.

– Predmetne fotografije prikazuju kako tužiteljici ubrizgavaju injekciju u obraz, a što implicira da se tužiteljica podvrgava estetskim zahvatima poput filera i botoksa, a što joj je s obzirom na njezinu profesiju glumice prouzročilo znatne neugodnosti, te su iste utjecale na njezin ugled, kako privatno, tako i profesionalno.

Tužiteljica ukazuje kako je uslijed protupravnog korištenja njezinih fotografija stvorena kriva predodžba javnosti o njoj kao ženi koja koristi agresivne metode pomlađivanja, što je u izričitoj suprotnosti s njezinim osobnim stavovima, kao i poslovnim angažmanima u kojima zagovara prirodan izgled, kao i prirodnu kozmetiku i tretmane.

Obzirom da kontekst fotografije ostavlja dojam da se podvrgava invazivnim estetskim zahvatima, tužiteljici je narušen ugled prirodne ljepote, pa su stoga otkazane postojeće, te su izostale potencijalne buduće poslovne suradnje na kampanjama koje promoviraju prirodnu ljepotu i njegu. Budući da je po zanimanju glumica, ovime je javno osramoćena te je ozbiljno narušen njezin ugled kao javne osobe, pogotovo jer je uvijek isticala prirodnost svog izgleda – stajalo je u njezinoj tužbi protiv Poliklinike.

Lipoliza podbratka

Iz Poliklinike su tvrdili da nisu oni ponudili glumici suradnju, već PR agencija "Start design" d.o.o., te da je dogovoreno da će Vejnović kao naknadu za korištenje fotografija dobiti besplatne tretmane za uljepšavanje. Kada su fotografije rađene, glumica je, tvrdili su iz Poliklinike, postavila dodatni zahtjev za tretmanom laserske lipolize podbratka, koji je jako skup i koji se njima nije isplatio pa su to odbili. Kazali su i da su prvi put uklonili fotografije, a drugi put su ih objavili zabunom i "bez znanja i prepoznavanja tužiteljice na fotografiji".

– Navedena fotografija ne implicira da bi osoba na fotografiji bila podvrgnuta bilo kakvim invazivnim tretmanima. Tužiteljica je više puta, u razdoblju prije i poslije u odnosu na vrijeme kada je tuženik pogreškom stavio predmetnu fotografiju na internetsku stranicu, sudjelovala u raznim tretmanima kod drugih fizičkih i pravnih osoba, prilikom čega je objavljeno više fotografija te jedan video na kojima se vidi potpuna fotografija tužiteljice s iglom u neposrednoj blizini lica.

Našu internetsku stranicu, na mjestu gdje je pogreškom bila objavljena predmetna fotografija, u razdoblju od 1. siječnja 2018. godine do dana uklanjanja je posjetilo samo četvero ljudi, a fotografija igle blizu njenog lica objavljena u visokotiražnom časopisu u Hrvatskoj i u videu na YouTubeu imala je 482 pogleda, pa je nemoguće povjerovati da je postojalo bilo kakvo narušavanje ugleda – naveli su iz Poliklinike.
