Osam godina (a pravosudna bitka još nije gotova) bori se po sudovima Tomislav Rukavina, navijač zagrebačkog Dinama, za naknadu štete od svoga kluba zbog toga jer mu zaštitari nisu dopustili da u listopadu 2013. godine uđe na utakmicu Dinamo – Rijeka iako je imao uredno kupljenu ulaznicu.

A razlog je bio što je ispod jakne i majice dugih rukava na sebi imao i majicu kratkih rukava na kojoj je u crvenom krugu bio otisnut lik tadašnjega gazde hrvatskog nogometa Zdravka Mamića prekrižen crvenom crtom te su zaštitari smatrali da bi sporna majica mogla poticati na nasilje i izazivanje nereda na utakmici.

Navijač Rukavina tužio je klub i dobio je 2014. godine presudu Općinskog građanskog suda u Zagrebu po kojoj mu je klub morao isplatiti nešto manje od dvije i pol tisuće kuna neimovinske i imovinske štete. Sud je procijenio da znak na spornoj majici nije takve naravi da bi pozivao na mržnju ili nasilje, već da predstavlja svojevrsnu kritiku načina na koji Zdravko Mamić vodi nogometni klub Dinamo.

Presuda na presudu

Naravno, Dinamo se žalio pa je presuda početkom prosinca 2018. godine ukinuta odlukom Županijskog suda u Slavonskom Brodu odbijanjem njegova zahtjeva za naknadu. No navijač "plavih" nije želio odustati od svoje borbe, pa krajem siječnja 2019. godine podnosi ustavnu tužbu, a istodobno i na Vrhovnom sudu i tzv. izvanrednu reviziju koja je, naravno, odbačena kao nedopuštena u travnju 2019. godine. I napokon, prije mjesec dana Ustavni sud donosi presudu kojom poništava presudu suda u Slavonskom Brodu i vraća je na ponovno odlučivanje.

Dinamo je tijekom postupka pokušao dokazati da su morali tako postupiti. Dostavili su podatke o UEFA-inim kaznama, i to onoj kojom je klub kažnjen s 25 tisuća eura i zatvaranjem istočne tribine jer se na utakmici Dinamo i CS Fola Esch, odigranoj 23. srpnja 2013. godine, više puta pjevalo "Mamiću, cigane, odlazi iz svetinje". UEFA-ino disciplinsko tijelo ocijenilo je da je navedeno pjevanje imalo za cilj "ocrniti određenu etničku skupinu".

– Sporna majica podnositelja, koju je, uz to, nosio kao potkošulju pa stoga nije bila izložena pogledima drugih, ne potiče na mržnju ili nasilje na temelju bilo koje pripadnosti, već se isključivo odnosi na kritiku rada potpredsjednika kluba Dinama, a njezino nošenje nije moglo potaknuti nasilje između navijača. Javna osoba poput tadašnjeg dopredsjednika GNK Dinamo podložnija je kritici javnosti od ostalih privatnih osoba te zbog toga može biti izloženija i većem broju kritika od prosječne privatne osobe, sve dok se izražavanjem stava o toj javnoj osobi ne potiče na nasilje, mržnju ili kazneno djelo – navodi, među ostalim, Ustavni sud u svojoj odluci.

– Ustavni sud utvrđuje da miješanje u podnositeljevo pravo na slobodu izražavanja, u okolnostima konkretnog slučaja, nije bilo nužno u demokratskom društvu, a donošenjem osporene presude kojom je odbijen tužbeni zahtjev podnositelja radi naknade štete zbog povrede prava osobnosti država je propustila ispuniti svoje pozitivne obveze vezane uz zaštitu prava na slobodu izražavanja – stoji u odluci Ustavnog suda. Ipak, ustavni suci smatraju da nije bilo povrede navijačeva prava na slobodu kretanja.

Osam godina (a pravosudna bitka još nije gotova) bori se po sudovima Tomislav Rukavina, navijač zagrebačkog Dinama, za naknadu štete od svoga kluba zbog toga jer mu zaštitari nisu dopustili da u listopadu 2013. godine uđe na utakmicu Dinamo – Rijeka iako je imao uredno kupljenu ulaznicu.

A razlog je bio što je ispod jakne i majice dugih rukava na sebi imao i majicu kratkih rukava na kojoj je u crvenom krugu bio otisnut lik tadašnjega gazde hrvatskog nogometa Zdravka Mamića prekrižen crvenom crtom te su zaštitari smatrali da bi sporna majica mogla poticati na nasilje i izazivanje nereda na utakmici.

Navijač Rukavina tužio je klub i dobio je 2014. godine presudu Općinskog građanskog suda u Zagrebu po kojoj mu je klub morao isplatiti nešto manje od dvije i pol tisuće kuna neimovinske i imovinske štete. Sud je procijenio da znak na spornoj majici nije takve naravi da bi pozivao na mržnju ili nasilje, već da predstavlja svojevrsnu kritiku načina na koji Zdravko Mamić vodi nogometni klub Dinamo.

Presuda na presudu

Naravno, Dinamo se žalio pa je presuda početkom prosinca 2018. godine ukinuta odlukom Županijskog suda u Slavonskom Brodu odbijanjem njegova zahtjeva za naknadu. No navijač "plavih" nije želio odustati od svoje borbe, pa krajem siječnja 2019. godine podnosi ustavnu tužbu, a istodobno i na Vrhovnom sudu i tzv. izvanrednu reviziju koja je, naravno, odbačena kao nedopuštena u travnju 2019. godine. I napokon, prije mjesec dana Ustavni sud donosi presudu kojom poništava presudu suda u Slavonskom Brodu i vraća je na ponovno odlučivanje.

Dinamo je tijekom postupka pokušao dokazati da su morali tako postupiti. Dostavili su podatke o UEFA-inim kaznama, i to onoj kojom je klub kažnjen s 25 tisuća eura i zatvaranjem istočne tribine jer se na utakmici Dinamo i CS Fola Esch, odigranoj 23. srpnja 2013. godine, više puta pjevalo "Mamiću, cigane, odlazi iz svetinje". UEFA-ino disciplinsko tijelo ocijenilo je da je navedeno pjevanje imalo za cilj "ocrniti određenu etničku skupinu".

– Sporna majica podnositelja, koju je, uz to, nosio kao potkošulju pa stoga nije bila izložena pogledima drugih, ne potiče na mržnju ili nasilje na temelju bilo koje pripadnosti, već se isključivo odnosi na kritiku rada potpredsjednika kluba Dinama, a njezino nošenje nije moglo potaknuti nasilje između navijača. Javna osoba poput tadašnjeg dopredsjednika GNK Dinamo podložnija je kritici javnosti od ostalih privatnih osoba te zbog toga može biti izloženija i većem broju kritika od prosječne privatne osobe, sve dok se izražavanjem stava o toj javnoj osobi ne potiče na nasilje, mržnju ili kazneno djelo – navodi, među ostalim, Ustavni sud u svojoj odluci.

– Ustavni sud utvrđuje da miješanje u podnositeljevo pravo na slobodu izražavanja, u okolnostima konkretnog slučaja, nije bilo nužno u demokratskom društvu, a donošenjem osporene presude kojom je odbijen tužbeni zahtjev podnositelja radi naknade štete zbog povrede prava osobnosti država je propustila ispuniti svoje pozitivne obveze vezane uz zaštitu prava na slobodu izražavanja – stoji u odluci Ustavnog suda. Ipak, ustavni suci smatraju da nije bilo povrede navijačeva prava na slobodu kretanja.
