Kaufland svojem mesaru mora platiti odštetu jer se prilikom usluživanja kupca porezao na nož.

Prema ovotjednoj presudi, mesar je “pretrpio ozljedu na radu prilikom redovitog obavljanja rada na uslužnom pultu mesnice jer je prilikom slaganja pulta desnom rukom slučajno “zakačio” nož na pultu na kojem su mesari uobičajeno držali nož”.

Mesar je pritom zadobio reznu ranu desne šake, i to u području metakarpofalangelanog zgloba trećeg prsta na desnoj ruci, piše portal Danica.hr.

Samo na papiru

Kaufland je odbio zahtjev za odštetu jer su nakon analize događaja ustanovili kako mesar nije obavljao posao sukladno uputama za rad na siguran način na odjelu svježeg mesa. Odnosno, noževi se ne smiju odlagati po pultovima, već na predviđena mjesta.

“Mesar je bio obvezan držati noževe u sterilizatoru ili kutiji za odlaganje. Propisana je zabrana ostavljanja noževa na pultu, policama, stolovima, kao i zabrana nošenja noževa u džepovima kuta i radnih odijela, te obveza vraćanja noževa na zato predviđena mjesta”, kažu u Kauflandu.

No, iskazima na sudu drugi zaposlenici trgovačkog lanca naveli su kako je to tako na papiru, ali u stvarnosti… Slučaj se, inače, dogodio u Kauflandu u Sesvetama.

“Mesar, zaposlenik Kauflanda koji je radio u istoj mesnici kao i ozlijeđeni radnik, rekao je da tada na odjelu svježeg mesa nije postojala kutija za noževe, niti dnevni sterilizator, niti praktično mjesto na pultu ili u blizini pulta za sigurno odlaganje noževa”, ističe se u presudi.

Nije kriv

I drugi su zaposlenici potvrdili kako su svi na odjelu mesa noževe odlagali na isti način. Zbog toga je sutkinja zaključila kako je mesar “radio na uobičajeni način, odnosno na isti način kako su radili svi ostali mesari na tom radnom mjestu”.

“Dakle, nema doprinosa radnika nastanku štetnog događaja, već je za nastalu štetu odgovoran poslodavac koji nije radniku osigurao sva potrebna sredstva i uvjete za siguran rad”, ističe se u presudi.

Kaufland mesaru mora platiti odštetu od oko 6300 eura i pokriti mu troškove postupka u iznosu 3700 eura. Ukupno je to oko 10.000 eura. Presuda je nepravomoćna i trgovački lanac se na nju može žaliti, piše Danica.

Prema ovotjednoj presudi, mesar je “pretrpio ozljedu na radu prilikom redovitog obavljanja rada na uslužnom pultu mesnice jer je prilikom slaganja pulta desnom rukom slučajno “zakačio” nož na pultu na kojem su mesari uobičajeno držali nož”.

Mesar je pritom zadobio reznu ranu desne šake, i to u području metakarpofalangelanog zgloba trećeg prsta na desnoj ruci, piše portal Danica.hr.

Samo na papiru

Kaufland je odbio zahtjev za odštetu jer su nakon analize događaja ustanovili kako mesar nije obavljao posao sukladno uputama za rad na siguran način na odjelu svježeg mesa. Odnosno, noževi se ne smiju odlagati po pultovima, već na predviđena mjesta.

“Mesar je bio obvezan držati noževe u sterilizatoru ili kutiji za odlaganje. Propisana je zabrana ostavljanja noževa na pultu, policama, stolovima, kao i zabrana nošenja noževa u džepovima kuta i radnih odijela, te obveza vraćanja noževa na zato predviđena mjesta”, kažu u Kauflandu.

No, iskazima na sudu drugi zaposlenici trgovačkog lanca naveli su kako je to tako na papiru, ali u stvarnosti… Slučaj se, inače, dogodio u Kauflandu u Sesvetama.

“Mesar, zaposlenik Kauflanda koji je radio u istoj mesnici kao i ozlijeđeni radnik, rekao je da tada na odjelu svježeg mesa nije postojala kutija za noževe, niti dnevni sterilizator, niti praktično mjesto na pultu ili u blizini pulta za sigurno odlaganje noževa”, ističe se u presudi.

Nije kriv

I drugi su zaposlenici potvrdili kako su svi na odjelu mesa noževe odlagali na isti način. Zbog toga je sutkinja zaključila kako je mesar “radio na uobičajeni način, odnosno na isti način kako su radili svi ostali mesari na tom radnom mjestu”.

“Dakle, nema doprinosa radnika nastanku štetnog događaja, već je za nastalu štetu odgovoran poslodavac koji nije radniku osigurao sva potrebna sredstva i uvjete za siguran rad”, ističe se u presudi.

Kaufland mesaru mora platiti odštetu od oko 6300 eura i pokriti mu troškove postupka u iznosu 3700 eura. Ukupno je to oko 10.000 eura. Presuda je nepravomoćna i trgovački lanac se na nju može žaliti, piše Danica.
