Prema sumnjama istražitelja USKOK-a, glavni organizatori i vođe zločinačkog udruženja koje je varalo državu na utaji poreza i izbjegavanju plaćanja davanja, a čijih je nekoliko desetaka članova tijekom jutra u srijedu uhićeno na području Zagreba, Splita, Trogira, Kaštela i Dubrovnika bili su izvjesni Mirko V. iz Podstrane, vlasnik dviju tvrtki registriranih u Splitu i Muću te Goran N. iz Zagreba, također vlasnik dviju zagrebačkih trvtki.

Više od 180 policajaca u srijedu je na području navedena tri grada provodilo akciju uhićenja i pretraga stanova, poslovnih objekata, automobila i drugih pokretnina i nekretnina osoba koje se sumnjiči za kazneno djelo utaje poreza ili carine u sastavu zločinačkog udruženja te na pomaganje i poticanje na ista (ne)djela.

- Policijski službenici Policijskog nacionalnog ureda za suzbijanje korupcije i organiziranog kriminaliteta (PNUSKOK) u koordinaciji sa Uredom za suzbijanje korupcije i organiziranog kriminaliteta provode kriminalističko istraživanje zbog sumnje u počinjenje kaznenih djela iz domene gospodarskog kriminaliteta. Realizacija je započeta u jutarnjim satima te je na području Policijske uprave zagrebačke, splitsko-dalmatinske i dubrovačko-neretvanske uhićeno više desetaka osoba. U tijeku je provođenje dokaznih radnji - izvjestio je MUP u srijedu. Identično su se šturo oglasili i iz USKOK-a.

Obzirom da se još nije krenulo s istragom, službeno nije poznato što i kako su osumnjičeni varali državu, no po neslužbenim saznanjima čini se da USKOK sumnja da je državni proračun oštećen za najmanje pedesetak milijuna kuna.

Shema je bila, koliko nam je za sad poznato, uvijek ista, a tvrtke uključene u priču bavile su se raznim poslovima od građevinarstva do trgovine, turizma i poslova s nekretninama.

Tako je, primjerice, u jednom slučaju vlasnik i voditelj jedne tvrtke iz Splita, a istu ulogu imala je većina članova zločinačkog udruženja koji su uglavnom bili vlasnici ili odgovorni ljudi u privatnim tvrtkama, izdavao nepostojeće odnosno fiktivne račune sa iskazanim PDV-om tvrtkama na čijem su čelu bili Mirko i Goran iako je znao da isporuka robe navedene u računima nije nikad izvršena.

Mirkove i Goranove firme su potom, po takvim računima, pred poreznicima podnosili zahtjeve u kojima su navodili kako imaju pravo na odbitak pretporeza i tako umanjivali stvarnu obvezu plaćanja PDV-a.

Onda bi vlasnici tih manjih tvrtki koje su bile uključene u lanac prijevare, kako bi sa svojih firmi makli sumnju u nezakonitosti, takve lažirane račune s iskazanim PDV-om evidentirali u svojim knjigama ulaznih računa. Kad bi ti računi bili plaćeni, sumnja USKOK, vlasnici su slali novac na račune firmi koje su bile uključene u lanac ili bi ih dizali u gotovini i prebacivali na račune tvrtki u inozemstvu.

Naravno, bilo je tu i prijevara države vezano za uvoz robe iz EU odnosno za neplaćanje PDV-a na stjecanje dobara iz drugih članica EU-a pa su se tako krajnjim kupcima za gotovinu prodavale čak i keramičke pločice nabavljene iz EU bez da bi se platio PDV. Da bi se sve legalno pokrilo, firmama koje su bile uključene u lanac, izdavani su lažni računi iako se znalo da roba nikad nije isporučena. Tako su se i nekim austrijskim tvrtkama izdavali računi po kojima im je bila prodana i isporučena roba iako se to u stvarnosti nije događalo, a na taj su način prevaranti koristili pravo na odbitak pretporeza uz ostalo i neosnovanim korištenjem oslobađanja od PDV-a za isporuke dobara unutar EU.

Da je bila riječ o unosnom poslu u kojem su svi dobijali i bili zadovoljni svojim dijelom kolača svjedoči i podatak da je jedna od tvrtki Mirka V. prošle godine koja se bavi izradom fasada, soboslikarskih radova, žbuka, estriha i slično, po podacima sudskog registra, imala dobit od preko dva milijuna kuna, a u izvješću se navodi i da je "zadržana dobit iz prethodnih razdoblja" preko sedam i pol milijuna kuna.

Druga Mirkova firma, ona koja se bavi proizvodnjom ploča, listova, cijevi i profila od plastike te ima sjedište u Muću, po podacima iz registra, je osnovana tek 1. veljače ove godine s temeljnim kapitalom od milijun kuna te nema podataka o dobiti ili gubicima.

Što se tiče njegovog sudruga u vrhu zločinačkog udruženja, kako to smatra USKOK, Gorana N., jedna od njegovih zagrebačkih firmi je prošle godine iskazala službenu dobit od preko dva milijuna i 260 tisuća kuna dok je druga njegova tvrtka, po podacima iz sudskog registra, imala tek nešto više od 160 tisuća kuna dobiti.

Kako neslužbeno doznajemo, većina uhićenih na splitskom i dubrovačkom području bit će prepraćena u Zagreb na ispitivanje u prostorije USKOK-a, a tek treba vidjeti za koliko će njih USKOK od nadležnog suca istrage tražiti određivanje istražnog zatvora i po kojoj osnovi.

Prema sumnjama istražitelja USKOK-a, glavni organizatori i vođe zločinačkog udruženja koje je varalo državu na utaji poreza i izbjegavanju plaćanja davanja, a čijih je nekoliko desetaka članova tijekom jutra u srijedu uhićeno na području Zagreba, Splita, Trogira, Kaštela i Dubrovnika bili su izvjesni Mirko V. iz Podstrane, vlasnik dviju tvrtki registriranih u Splitu i Muću te Goran N. iz Zagreba, također vlasnik dviju zagrebačkih trvtki.

Više od 180 policajaca u srijedu je na području navedena tri grada provodilo akciju uhićenja i pretraga stanova, poslovnih objekata, automobila i drugih pokretnina i nekretnina osoba koje se sumnjiči za kazneno djelo utaje poreza ili carine u sastavu zločinačkog udruženja te na pomaganje i poticanje na ista (ne)djela.

- Policijski službenici Policijskog nacionalnog ureda za suzbijanje korupcije i organiziranog kriminaliteta (PNUSKOK) u koordinaciji sa Uredom za suzbijanje korupcije i organiziranog kriminaliteta provode kriminalističko istraživanje zbog sumnje u počinjenje kaznenih djela iz domene gospodarskog kriminaliteta. Realizacija je započeta u jutarnjim satima te je na području Policijske uprave zagrebačke, splitsko-dalmatinske i dubrovačko-neretvanske uhićeno više desetaka osoba. U tijeku je provođenje dokaznih radnji - izvjestio je MUP u srijedu. Identično su se šturo oglasili i iz USKOK-a.

Obzirom da se još nije krenulo s istragom, službeno nije poznato što i kako su osumnjičeni varali državu, no po neslužbenim saznanjima čini se da USKOK sumnja da je državni proračun oštećen za najmanje pedesetak milijuna kuna.

Shema je bila, koliko nam je za sad poznato, uvijek ista, a tvrtke uključene u priču bavile su se raznim poslovima od građevinarstva do trgovine, turizma i poslova s nekretninama.

Tako je, primjerice, u jednom slučaju vlasnik i voditelj jedne tvrtke iz Splita, a istu ulogu imala je većina članova zločinačkog udruženja koji su uglavnom bili vlasnici ili odgovorni ljudi u privatnim tvrtkama, izdavao nepostojeće odnosno fiktivne račune sa iskazanim PDV-om tvrtkama na čijem su čelu bili Mirko i Goran iako je znao da isporuka robe navedene u računima nije nikad izvršena.

Mirkove i Goranove firme su potom, po takvim računima, pred poreznicima podnosili zahtjeve u kojima su navodili kako imaju pravo na odbitak pretporeza i tako umanjivali stvarnu obvezu plaćanja PDV-a.

Onda bi vlasnici tih manjih tvrtki koje su bile uključene u lanac prijevare, kako bi sa svojih firmi makli sumnju u nezakonitosti, takve lažirane račune s iskazanim PDV-om evidentirali u svojim knjigama ulaznih računa. Kad bi ti računi bili plaćeni, sumnja USKOK, vlasnici su slali novac na račune firmi koje su bile uključene u lanac ili bi ih dizali u gotovini i prebacivali na račune tvrtki u inozemstvu.

Naravno, bilo je tu i prijevara države vezano za uvoz robe iz EU odnosno za neplaćanje PDV-a na stjecanje dobara iz drugih članica EU-a pa su se tako krajnjim kupcima za gotovinu prodavale čak i keramičke pločice nabavljene iz EU bez da bi se platio PDV. Da bi se sve legalno pokrilo, firmama koje su bile uključene u lanac, izdavani su lažni računi iako se znalo da roba nikad nije isporučena. Tako su se i nekim austrijskim tvrtkama izdavali računi po kojima im je bila prodana i isporučena roba iako se to u stvarnosti nije događalo, a na taj su način prevaranti koristili pravo na odbitak pretporeza uz ostalo i neosnovanim korištenjem oslobađanja od PDV-a za isporuke dobara unutar EU.

Da je bila riječ o unosnom poslu u kojem su svi dobijali i bili zadovoljni svojim dijelom kolača svjedoči i podatak da je jedna od tvrtki Mirka V. prošle godine koja se bavi izradom fasada, soboslikarskih radova, žbuka, estriha i slično, po podacima sudskog registra, imala dobit od preko dva milijuna kuna, a u izvješću se navodi i da je "zadržana dobit iz prethodnih razdoblja" preko sedam i pol milijuna kuna.

Druga Mirkova firma, ona koja se bavi proizvodnjom ploča, listova, cijevi i profila od plastike te ima sjedište u Muću, po podacima iz registra, je osnovana tek 1. veljače ove godine s temeljnim kapitalom od milijun kuna te nema podataka o dobiti ili gubicima.

Što se tiče njegovog sudruga u vrhu zločinačkog udruženja, kako to smatra USKOK, Gorana N., jedna od njegovih zagrebačkih firmi je prošle godine iskazala službenu dobit od preko dva milijuna i 260 tisuća kuna dok je druga njegova tvrtka, po podacima iz sudskog registra, imala tek nešto više od 160 tisuća kuna dobiti.

Kako neslužbeno doznajemo, većina uhićenih na splitskom i dubrovačkom području bit će prepraćena u Zagreb na ispitivanje u prostorije USKOK-a, a tek treba vidjeti za koliko će njih USKOK od nadležnog suca istrage tražiti određivanje istražnog zatvora i po kojoj osnovi.
