Visoki kazneni sud odbio je zbog zastare optužbu protiv Ivane Domić, bivše bračke sutkinje i nekadašnje predsjednice Općinskog suda u Supetru koja je na šibenskom Županijskom sudu krajem ožujka prošle godine bila osuđena na uvjetnu zatvorsku kaznu od godine dana i 10 mjeseci s rokom kušnje od pet godina zbog deset kaznenih djela zlouporabe položaja i ovlasti vezanih za manipulacije s vrijednim zemljištima. Optužba je zbog istog razloga odbijena i u odnosu na sve ostale okrivljenike, a osim sutkinje Domić zbog malverzacija s nekretninama odnosno poticanja i pomaganja sudilo se i odvjetnicima Zoranu Vuloviću koji je bio nepravomoćno osuđen na uvjetnu kazne od godinu i osam mjeseci s rokom kušnje od pet godina te i Miljenku Jovanoviću koji je dobio godinu i pol zatvora s rokom kušnje od četiri godine. Šibenski je sud na uvjetne kazne osudio i Franu Marinkovića, Jadrana Zaru i Lina Martinića. Radilo se o djelima počinjenim još prije dvadeset i više godina, a već su ranije bile donesene dvije oslobađajuće presude koje su, pak, ukidane.

- Županijski sud u Šibeniku donio je 31. ožujka 2022. presudu kojom je odlučivao o jedanaest točaka optužbe protiv sedmero optuženika zbog kaznenih djela protiv službene dužnosti zlouporabom položaja i ovlasti koja je prvooptužena počinila kao sutkinja Općinskog suda u Supetru u parničnim postupcima radi stjecanja vlasništva nekretnina na otoku Braču, drugooptuženi i trećeoptuženi kao privremeni zastupnici tuženika ili punomoćnici tužitelja, četvrtooptuženi kao privremeni zastupnik tuženika, a petooptuženi, šestooptuženi i sedmooptužena kao tužitelji u tim predmetima. Županijski sud je u pogledu deset točaka optužnice donio osuđujuću presudu protiv šestero optuženika, a u pogledu jedne točke optužnice odbio je optužbu protiv prvooptužene, drugooptuženog i sedmooptužene. Visoki kazneni sud je u povodu žalbi svih stranaka utvrdio da je na štetu svih optuženika povrijeđen kazneni zakon jer je postupanje optuženika, s obzirom na načelo obvezne primjene blažeg zakona, trebalo označiti prema odredbama KZ/97 - navodi se, uz ostalu, u obrazloženju VKS-a.

Ističe se da je šibenski sud proglašavajući optuženike krivima izmijenio činjenični opis nekoliko inkriminacija kako je bio naveden u optužnici, te je umjesto inicijalno u optužnici navedenih iznosa imovinske koristi, odnosno štete, izvršio korekciju tih vrijednosti pa je u činjenične opise inkriminacija stavio tekst: "u točno neutvrđenoj vrijednosti, svakako većoj od 30.000,00".

- Žalba državnog odvjetnika podnesena je isključivo zbog odluke o kazni, što podrazumijeva da je državni odvjetnik prihvatio navedene izmjene činjeničnog opisa tih inkriminacija, a to pak znači da bi u nekom potencijalno ponovljenom postupku vrijedilo načelo da optuženicima nije moguće suditi za drugačiji činjenični opis. Prema tome, imajući na umu pravni kontinuitet, zbog neodređenih vrijednosti kao bitnog obilježja kaznenog djela, sada bi bila riječ o kaznenom djelu zlouporabe položaja i ovlasti iz članka 291. stavak 1. KZ/11., a ne o zlouporabi položaja i ovlasti iz članka 337. stavka 1., 3. i 4. KZ/97. S obzirom na visinu kazne propisanu za kazno djelo iz članka 291. stavka 1. KZ/11. te odredbe o zastari, zastara kaznenog progona za navedena kaznena djela nastupila je tijekom 2018., 2019. i 2020. godine - navodi Visoki kazneni sud.

Što se tiče preostale treće točke optužnice u kojoj su Domić i još dvoje okrivljenih, VKS je utvrdio da "prvostupanjski sud nije na bilo koji način utvrdio vrijednost nekretnina sadržanih činjeničnom opisu inkriminacije iz točke III. izreke pobijane presude, iako je na raspolaganju imao različita dokazna sredstva poput upita poreznoj upravi...". Zato je taj dio vraćen na ponovno suđenje.

Visoki kazneni sud odbio je zbog zastare optužbu protiv Ivane Domić, bivše bračke sutkinje i nekadašnje predsjednice Općinskog suda u Supetru koja je na šibenskom Županijskom sudu krajem ožujka prošle godine bila osuđena na uvjetnu zatvorsku kaznu od godine dana i 10 mjeseci s rokom kušnje od pet godina zbog deset kaznenih djela zlouporabe položaja i ovlasti vezanih za manipulacije s vrijednim zemljištima. Optužba je zbog istog razloga odbijena i u odnosu na sve ostale okrivljenike, a osim sutkinje Domić zbog malverzacija s nekretninama odnosno poticanja i pomaganja sudilo se i odvjetnicima Zoranu Vuloviću koji je bio nepravomoćno osuđen na uvjetnu kazne od godinu i osam mjeseci s rokom kušnje od pet godina te i Miljenku Jovanoviću koji je dobio godinu i pol zatvora s rokom kušnje od četiri godine. Šibenski je sud na uvjetne kazne osudio i Franu Marinkovića, Jadrana Zaru i Lina Martinića. Radilo se o djelima počinjenim još prije dvadeset i više godina, a već su ranije bile donesene dvije oslobađajuće presude koje su, pak, ukidane.

- Županijski sud u Šibeniku donio je 31. ožujka 2022. presudu kojom je odlučivao o jedanaest točaka optužbe protiv sedmero optuženika zbog kaznenih djela protiv službene dužnosti zlouporabom položaja i ovlasti koja je prvooptužena počinila kao sutkinja Općinskog suda u Supetru u parničnim postupcima radi stjecanja vlasništva nekretnina na otoku Braču, drugooptuženi i trećeoptuženi kao privremeni zastupnici tuženika ili punomoćnici tužitelja, četvrtooptuženi kao privremeni zastupnik tuženika, a petooptuženi, šestooptuženi i sedmooptužena kao tužitelji u tim predmetima. Županijski sud je u pogledu deset točaka optužnice donio osuđujuću presudu protiv šestero optuženika, a u pogledu jedne točke optužnice odbio je optužbu protiv prvooptužene, drugooptuženog i sedmooptužene. Visoki kazneni sud je u povodu žalbi svih stranaka utvrdio da je na štetu svih optuženika povrijeđen kazneni zakon jer je postupanje optuženika, s obzirom na načelo obvezne primjene blažeg zakona, trebalo označiti prema odredbama KZ/97 - navodi se, uz ostalu, u obrazloženju VKS-a.

Ističe se da je šibenski sud proglašavajući optuženike krivima izmijenio činjenični opis nekoliko inkriminacija kako je bio naveden u optužnici, te je umjesto inicijalno u optužnici navedenih iznosa imovinske koristi, odnosno štete, izvršio korekciju tih vrijednosti pa je u činjenične opise inkriminacija stavio tekst: "u točno neutvrđenoj vrijednosti, svakako većoj od 30.000,00".

- Žalba državnog odvjetnika podnesena je isključivo zbog odluke o kazni, što podrazumijeva da je državni odvjetnik prihvatio navedene izmjene činjeničnog opisa tih inkriminacija, a to pak znači da bi u nekom potencijalno ponovljenom postupku vrijedilo načelo da optuženicima nije moguće suditi za drugačiji činjenični opis. Prema tome, imajući na umu pravni kontinuitet, zbog neodređenih vrijednosti kao bitnog obilježja kaznenog djela, sada bi bila riječ o kaznenom djelu zlouporabe položaja i ovlasti iz članka 291. stavak 1. KZ/11., a ne o zlouporabi položaja i ovlasti iz članka 337. stavka 1., 3. i 4. KZ/97. S obzirom na visinu kazne propisanu za kazno djelo iz članka 291. stavka 1. KZ/11. te odredbe o zastari, zastara kaznenog progona za navedena kaznena djela nastupila je tijekom 2018., 2019. i 2020. godine - navodi Visoki kazneni sud.

Što se tiče preostale treće točke optužnice u kojoj su Domić i još dvoje okrivljenih, VKS je utvrdio da "prvostupanjski sud nije na bilo koji način utvrdio vrijednost nekretnina sadržanih činjeničnom opisu inkriminacije iz točke III. izreke pobijane presude, iako je na raspolaganju imao različita dokazna sredstva poput upita poreznoj upravi...". Zato je taj dio vraćen na ponovno suđenje.
