Sud EU potvrdio je presudom C-452/18 da sporazum o konverziji nije prepreka za potpuno obeštećenje potrošača, objavili su iz udruge Franak donoseći glavne odrednice dugo očekivane i izuzetno važne presudu koju je Sud EU donio u španjolskom predmetu C-452/18, a kojom su, kako ističu u udruzi Franak, i naši sudovi dobili sve potrebne odgovore na pitanja vezana za prava potrošača koji su konvertirali CHF kredite.

Kako je istaknuto tom presudom ukratko je utvrđeno kako potrošač može sklopiti sporazum kojim zamjenjuje nevaljano odredbu drugom odredbom, međutim zaštite koju mu pruža Direktiva 93/13 i koristi koje bi imao od sudskog proglašenja odredbe nepoštenom potrošač se može odreći samo ako je u trenutku odricanja znao da je odredba o kojoj sklapa sporazum nepoštena i ništetna i slobodno pristao da se zaštite odrekne.

Nadalje, odredba ugovora kojom se mijenja potencijalno nepoštena ugovorna odredba, a o kojoj se nije pojedinačno pregovaralo na način da je potrošač mogao utjecati na njezin sadržaj, može se testirati na poštenost i može se proglasiti nepoštenom.

Odredba ugovora kojom se mijenja potencijalno nepoštena ugovorna odredba smatra se nepoštenom ako u suprotnosti s načelom savjesnosti i poštenja prouzrokuje neravnotežu na štetu potrošača, a to osobito podrazumijeva isključenje prava potrošača na sudsku zaštitu.

Isto tako utvrđeno je kako potrošač nikada valjano ne može ugovoriti odricanje od buduće sudske zaštite, odnosno ne može se odreći prava osporavanja odredbi ugovora kojim se mijenja potencijalno nepoštena ugovorna odredba.

Također Sud EU je utvrdio: Odredba sadržana u ugovoru koji su sklopili prodavatelj robe ili pružatelj usluga i potrošač kako bi razriješili postojeći spor, a kojom se potrošač odriče isticanja pred nacionalnim sudom zahtjeva koje bi mogao istaknuti da te odredbe nema, može se smatrati „nepoštenom”, osobito ako navedeni potrošač nije mogao raspolagati relevantnim informacijama koje bi mu omogućile shvaćanje pravnih posljedica koje za njega iz te odredbe proizlaze.

Iz udruge Franak poručuju kako prevedeno na konkretni slučaj franak u Republici Hrvatskoj, za potrošače koji su konvertirali CHF kredite to znači sljedeće:

- Potrošači se konverzijom kredita nisu odrekli sudske zaštite i zaštite koju im jamči Direktiva 93/13, a to je povrat svih koristi koje je nepošteni trgovac stekao.

- Potrošači su se takve zaštite mogli odreći samo izričito, slobodno i informirano što znači da su morali u trenutku sklapanja sporazuma znati da je odredba po kojoj se zaštite odriču nepoštena i ništetna, a u trenutku konverzije valuta švicarski franak je bila valjana pa prema tome potrošači nisu znali niti mogli znati iznos obeštećenja kojeg se eventualno odriču.

- I odredbe osnovnih ugovora, i odredbe dodatka ugovora kojima je provedena konverzija mogu se ocjenjivati nepoštenima i za tu ocjenu uvijek vrijede pravila savjesnosti i poštenja.

Ujedno, naglašavaju kako je presudom C-452/18 Sud EU nadopunio presudu C-118/17 kojom je već utvrđeno da nakon konverzije potrošač i dalje ima pravo zatražiti povrat svega što je banka stekla korištenjem nepoštenih ugovornih odredaba. Ovdje sud potvrđuje da to vrijedi i kada stranke postignu Sporazum kojim mijenjaju sporne ugovorne odredbe baš kao što je bilo u slučaju konverzije.

- Očekujemo da stavove izražene u presudama Suda EU C-118/17 i C-452/18 konačno potvrdi i Vrhovni sud RH u nekoj od revizija koje se vode povodom pravomoćnih presuda za konvertirane kredite. Proglašavamo konačnu pobjedu potrošača protiv banaka u dijelu koji se tiče prava na obeštećenje iz konvertiranih kredita.

Sljedeća bitka koja se mora dobiti, jest bitka za ništetnost temeljnih CHF ugovora, čime će sva neriješena pravna pitanja u slučaju franak konačno biti riješena - ističu u udruzi Franak.

Sud EU potvrdio je presudom C-452/18 da sporazum o konverziji nije prepreka za potpuno obeštećenje potrošača, objavili su iz udruge Franak donoseći glavne odrednice dugo očekivane i izuzetno važne presudu koju je Sud EU donio u španjolskom predmetu C-452/18, a kojom su, kako ističu u udruzi Franak, i naši sudovi dobili sve potrebne odgovore na pitanja vezana za prava potrošača koji su konvertirali CHF kredite.

Kako je istaknuto tom presudom ukratko je utvrđeno kako potrošač može sklopiti sporazum kojim zamjenjuje nevaljano odredbu drugom odredbom, međutim zaštite koju mu pruža Direktiva 93/13 i koristi koje bi imao od sudskog proglašenja odredbe nepoštenom potrošač se može odreći samo ako je u trenutku odricanja znao da je odredba o kojoj sklapa sporazum nepoštena i ništetna i slobodno pristao da se zaštite odrekne.

Nadalje, odredba ugovora kojom se mijenja potencijalno nepoštena ugovorna odredba, a o kojoj se nije pojedinačno pregovaralo na način da je potrošač mogao utjecati na njezin sadržaj, može se testirati na poštenost i može se proglasiti nepoštenom.

Odredba ugovora kojom se mijenja potencijalno nepoštena ugovorna odredba smatra se nepoštenom ako u suprotnosti s načelom savjesnosti i poštenja prouzrokuje neravnotežu na štetu potrošača, a to osobito podrazumijeva isključenje prava potrošača na sudsku zaštitu.

Isto tako utvrđeno je kako potrošač nikada valjano ne može ugovoriti odricanje od buduće sudske zaštite, odnosno ne može se odreći prava osporavanja odredbi ugovora kojim se mijenja potencijalno nepoštena ugovorna odredba.

Također Sud EU je utvrdio: Odredba sadržana u ugovoru koji su sklopili prodavatelj robe ili pružatelj usluga i potrošač kako bi razriješili postojeći spor, a kojom se potrošač odriče isticanja pred nacionalnim sudom zahtjeva koje bi mogao istaknuti da te odredbe nema, može se smatrati „nepoštenom”, osobito ako navedeni potrošač nije mogao raspolagati relevantnim informacijama koje bi mu omogućile shvaćanje pravnih posljedica koje za njega iz te odredbe proizlaze.

Iz udruge Franak poručuju kako prevedeno na konkretni slučaj franak u Republici Hrvatskoj, za potrošače koji su konvertirali CHF kredite to znači sljedeće:

- Potrošači se konverzijom kredita nisu odrekli sudske zaštite i zaštite koju im jamči Direktiva 93/13, a to je povrat svih koristi koje je nepošteni trgovac stekao.

- Potrošači su se takve zaštite mogli odreći samo izričito, slobodno i informirano što znači da su morali u trenutku sklapanja sporazuma znati da je odredba po kojoj se zaštite odriču nepoštena i ništetna, a u trenutku konverzije valuta švicarski franak je bila valjana pa prema tome potrošači nisu znali niti mogli znati iznos obeštećenja kojeg se eventualno odriču.

- I odredbe osnovnih ugovora, i odredbe dodatka ugovora kojima je provedena konverzija mogu se ocjenjivati nepoštenima i za tu ocjenu uvijek vrijede pravila savjesnosti i poštenja.

Ujedno, naglašavaju kako je presudom C-452/18 Sud EU nadopunio presudu C-118/17 kojom je već utvrđeno da nakon konverzije potrošač i dalje ima pravo zatražiti povrat svega što je banka stekla korištenjem nepoštenih ugovornih odredaba. Ovdje sud potvrđuje da to vrijedi i kada stranke postignu Sporazum kojim mijenjaju sporne ugovorne odredbe baš kao što je bilo u slučaju konverzije.

- Očekujemo da stavove izražene u presudama Suda EU C-118/17 i C-452/18 konačno potvrdi i Vrhovni sud RH u nekoj od revizija koje se vode povodom pravomoćnih presuda za konvertirane kredite. Proglašavamo konačnu pobjedu potrošača protiv banaka u dijelu koji se tiče prava na obeštećenje iz konvertiranih kredita.

Sljedeća bitka koja se mora dobiti, jest bitka za ništetnost temeljnih CHF ugovora, čime će sva neriješena pravna pitanja u slučaju franak konačno biti riješena - ističu u udruzi Franak.

Sud EU potvrdio je presudom C-452/18 da sporazum o konverziji nije prepreka za potpuno obeštećenje potrošača, objavili su iz udruge Franak donoseći glavne odrednice dugo očekivane i izuzetno važne presudu koju je Sud EU donio u španjolskom predmetu C-452/18, a kojom su, kako ističu u udruzi Franak, i naši sudovi dobili sve potrebne odgovore na pitanja vezana za prava potrošača koji su konvertirali CHF kredite.

Kako je istaknuto tom presudom ukratko je utvrđeno kako potrošač može sklopiti sporazum kojim zamjenjuje nevaljano odredbu drugom odredbom, međutim zaštite koju mu pruža Direktiva 93/13 i koristi koje bi imao od sudskog proglašenja odredbe nepoštenom potrošač se može odreći samo ako je u trenutku odricanja znao da je odredba o kojoj sklapa sporazum nepoštena i ništetna ...
