Na stranicama sa sudskom praksom Vrhovnoga suda RH objavljena je izuzetno važna revizija Vrhovnog suda RH koja nam daje za pravo očekivati da će ugovori s valutnom klauzulom CHF na tome sudu po tužbama za ništetnost ugovora biti utvrđeni apsolutno ništetnima, poručili su iz udruge Franak.

Pojašnjavaju kako je u rješenju po reviziji Rev-3740/2018 Vrhovni sud RH ukinuo negativnu presudu Županijskoga suda u Zagrebu u dijelu vezanom za valutnu klauzulu u švicarskim francima (CHF) te je vratio predmet tome sudu na ponovno suđenje.

U objavi za medije naveli su kako je Županijski sud u Zagrebu donio negativnu presudu prije svega zbog toga jer u vrijeme kada je odlučivao o žalbi tužitelja još nije imao saznanje o tome da je Visoki trgovački sud odlučio da je valutna klauzula u CHF ništetna u potrošačkim kreditima.

U udruzi Franak ističu kako ono što je daleko važnije od pravorijeka u rješenju jest dio obrazloženja VSRH koje su citirali:

"U ponovljenom postupku sud drugog stupnja će otkloniti bitnu povredu na koju mu je ukazano ovim rješenjem, imajući pri tom na umu i da je odredbom čl. 1021. ZOO propisano da se ugovorom o kreditu banka obvezuje staviti na raspolaganje određeni iznos novčanih sredstava, na određeno ili neodređeno vrijeme za neku namjenu ili bez određene namjene, a korisnik se obvezuje banci plaćati ugovorene kamate i iskorišteni iznos novca u vrijeme i na način kako je ugovoreno.

Obveza plaćanja ugovorene kamate kod drugih ugovora u pravilu nije bitan sastojak ugovora, ali kod ugovora o kreditu jeste jer je to naknada (cijena) koju korisnik plaća za to što mu je banka stavila na raspolaganje određeni iznos novčanih sredstava.

Jednako je tako korisnik kredita dužan vratiti banci iskorišteni iznos novca u vrijeme i na način kako je ugovoreno pa je i ta odredba bitan sastojak ugovora o kreditu.“

Nadalje, u udruzi ističu kako je prema odredbama Zakona o obveznim odnosima, ako su ništetni bitni sastojci ugovora, onda ništetan i cijeli ugovor.

- U skladu s izrečenim stavom Vrhovnoga suda RH da ugovorena kamata kao cijena jest bitni sastojak ugovora te je i novčani iznos kredita koji je izražen u CHF-u također bitni sastojak ugovora, a oba su sastojka utvrđena ništetnima u kolektivnom sudskom sporu, možemo očekivati da će u revizijama vezanim za ništetnost ugovora svaki takav tužbeni zahtjev biti prihvaćen - ističu u udruzi Franak.

Dodaju kako se takvo stajalište VSRH nadovezuje na nedavnu pravomoćnu presudu Županijskog suda u Varaždinu, kojom je utvrđeno da su predmet i cijena ugovora o kreditu nepošteni i ništetni, pa je prema tome nepošten i ništetan ugovor kao cielina.

- Moramo naglasiti i to da je VSRH već u svojim prijašnjim revizijama utvrđivao kako se čak i ne može utvrđivati djelomična ništetnost ugovora ako je ništetna cijena pravnoga posla, nego ukoliko je cijena ništetna, onda je ništetan ugovor! A u slučaju franak nije ništetna samo cijena, nego je ništetan i glavni predmet ugovora odnosno ugovoreni iznos kredita u francima, protuvrijednost u kunama po tečaju franka na dan plaćanja - istaknuli su.

Također navode kako je očigledno da u slučaju ništetnosti valutne klauzule glavni predmet ugovora postaje neodrediv, pa stoga takav ugovor ne može opstati, što je već utvrdio i Sud EU presudom C-118/17, paragraf 52:

„No, u ovom slučaju, kao što je već rečeno u točki 48. ove presude, odredba koja se odnosi na tečajni rizik određuje glavni predmet ugovora. Stoga se u tom slučaju, održavanje valjanosti ugovora ne čini pravno moguće, što je ipak na sudu koji je uputio zahtjev da ocijeni.“

- Čestitamo na izvrsnom pravno utemeljenom obrazloženju sudačkome vijeću VSRH u sastavu: Mirjana Magud, predsjednica vijeća, Goranka Barać-Ručević, izvjestiteljica te Slavko Pavković, Ljiljana Hrastinski Jurčec i Dražen Jakovina, članovi vijeća.

Očekujemo da VSRH tijekom sljedećih mjeseci potvrdi ništetnost CHF ugovora po revizijama s takvim tužbenim zahtjevima. Sve suprotno tome bilo bi rušenje pravnog poretka Republike Hrvatske, ali i suprotstavljanje jasno izraženim stajalištima Suda EU - istaknuli su u udruzi Franak.

Na stranicama sa sudskom praksom Vrhovnoga suda RH objavljena je izuzetno važna revizija Vrhovnog suda RH koja nam daje za pravo očekivati da će ugovori s valutnom klauzulom CHF na tome sudu po tužbama za ništetnost ugovora biti utvrđeni apsolutno ništetnima, poručili su iz udruge Franak.

Pojašnjavaju kako je u rješenju po reviziji Rev-3740/2018 Vrhovni sud RH ukinuo negativnu presudu Županijskoga suda u Zagrebu u dijelu vezanom za valutnu klauzulu u švicarskim francima (CHF) te je vratio predmet tome sudu na ponovno suđenje.

U objavi za medije naveli su kako je Županijski sud u Zagrebu donio negativnu presudu prije svega zbog toga jer u vrijeme kada je odlučivao o žalbi tužitelja još nije imao saznanje o tome da je Visoki trgovački sud odlučio da je valutna klauzula u CHF ništetna u potrošačkim kreditima.

U udruzi Franak ističu kako ono što je daleko važnije od pravorijeka u rješenju jest dio obrazloženja VSRH koje su citirali:

"U ponovljenom postupku sud drugog stupnja će otkloniti bitnu povredu na koju mu je ukazano ovim rješenjem, imajući pri tom na umu i da je odredbom čl. 1021. ZOO propisano da se ugovorom o kreditu banka obvezuje staviti na raspolaganje određeni iznos novčanih sredstava, na određeno ili neodređeno vrijeme za neku namjenu ili bez određene namjene, a korisnik se obvezuje banci plaćati ugovorene kamate i iskorišteni iznos novca u vrijeme i na način kako je ugovoreno.

Obveza plaćanja ugovorene kamate kod drugih ugovora u pravilu nije bitan sastojak ugovora, ali kod ugovora o kreditu jeste jer je to naknada (cijena) koju korisnik plaća za to što mu je banka stavila na raspolaganje određeni iznos novčanih sredstava.

Jednako je tako korisnik kredita dužan vratiti banci iskorišteni iznos novca u vrijeme i na način kako je ugovoreno pa je i ta odredba bitan sastojak ugovora o kreditu.“

Nadalje, u udruzi ističu kako je prema odredbama Zakona o obveznim odnosima, ako su ništetni bitni sastojci ugovora, onda ništetan i cijeli ugovor.

- U skladu s izrečenim stavom Vrhovnoga suda RH da ugovorena kamata kao cijena jest bitni sastojak ugovora te je i novčani iznos kredita koji je izražen u CHF-u također bitni sastojak ugovora, a oba su sastojka utvrđena ništetnima u kolektivnom sudskom sporu, možemo očekivati da će u revizijama vezanim za ništetnost ugovora svaki takav tužbeni zahtjev biti prihvaćen - ističu u udruzi Franak.

Dodaju kako se takvo stajalište VSRH nadovezuje na nedavnu pravomoćnu presudu Županijskog suda u Varaždinu, kojom je utvrđeno da su predmet i cijena ugovora o kreditu nepošteni i ništetni, pa je prema tome nepošten i ništetan ugovor kao cielina.

- Moramo naglasiti i to da je VSRH već u svojim prijašnjim revizijama utvrđivao kako se čak i ne može utvrđivati djelomična ništetnost ugovora ako je ništetna cijena pravnoga posla, nego ukoliko je cijena ništetna, onda je ništetan ugovor! A u slučaju franak nije ništetna samo cijena, nego je ništetan i glavni predmet ugovora odnosno ugovoreni iznos kredita u francima, protuvrijednost u kunama po tečaju franka na dan plaćanja - istaknuli su.

Također navode kako je očigledno da u slučaju ništetnosti valutne klauzule glavni predmet ugovora postaje neodrediv, pa stoga takav ugovor ne može opstati, što je već utvrdio i Sud EU presudom C-118/17, paragraf 52:

„No, u ovom slučaju, kao što je već rečeno u točki 48. ove presude, odredba koja se odnosi na tečajni rizik određuje glavni predmet ugovora. Stoga se u tom slučaju, održavanje valjanosti ugovora ne čini pravno moguće, što je ipak na sudu koji je uputio zahtjev da ocijeni.“

- Čestitamo na izvrsnom pravno utemeljenom obrazloženju sudačkome vijeću VSRH u sastavu: Mirjana Magud, predsjednica vijeća, Goranka Barać-Ručević, izvjestiteljica te Slavko Pavković, Ljiljana Hrastinski Jurčec i Dražen Jakovina, članovi vijeća.

Očekujemo da VSRH tijekom sljedećih mjeseci potvrdi ništetnost CHF ugovora po revizijama s takvim tužbenim zahtjevima. Sve suprotno tome bilo bi rušenje pravnog poretka Republike Hrvatske, ali i suprotstavljanje jasno izraženim stajalištima Suda EU - istaknuli su u udruzi Franak.

Na stranicama sa sudskom praksom Vrhovnoga suda RH objavljena je izuzetno važna revizija Vrhovnog suda RH koja nam daje za pravo očekivati da će ugovori s valutnom klauzulom CHF na tome sudu po tužbama za ništetnost ugovora biti utvrđeni apsolutno ništetnima, poručili su iz udruge Franak.

Pojašnjavaju kako je u rješenju po reviziji Rev-3740/2018 Vrhovni sud RH ukinuo negativnu presudu Županijskoga suda u Zagrebu u dijelu vezanom za valutnu klauzulu u švicarskim francima (CHF) te je vratio predmet tome sudu na ponovno suđenje.

U objavi za medije naveli su kako je Županijski sud u Zagrebu donio negativnu presudu prije svega zbog toga jer u vrijeme kada je odlučivao o žalbi tužitelja još nije imao saznanje o tome da je Visoki trgovački sud odlučio da je valutna klauzula...
