Tvrtka Razvoj Golf mora odmah vratiti Gradu tvrđavu Imperijal na Srđu – odredio je Općinski sud u Dubrovniku rješenjem od 25. veljače.

Podsjetimo Grad Dubrovnik je nakon prekida ugovora o koncesiji na tvrđavi s Razvoj Golfom zatražio povrat nekretnine mirnim putem, no kako se to nije dogodilo pokrenut je i ovršni postupak. Iz gradske su uprave priopćili kako su donošenjem rješenja o ovrsi zaštićeni interesi Grada te otvoren put prema obnovi i rekonstrukciji tvrđave na Srđu.

Protiv ovog rješenja moguće je izjaviti žalbu nadležnom tijelu u roku od 8 dana, a hoće li to učiniti, danas nisu htjeli komentirati iz tvrtke razvoj Golf.

- Dok ne dobijemo rješenje suda ne možemo komentirati neke sudske informacije koje dobivamo putem priopćenja od strane Grada Dubrovnika. Dok službeno nešto ne zaprimimo nećemo se ni službeno očitovati niti davati izjave – rekao je Ivan Kusalić pravni zastupnik tvrtke Razvoj Golf.

Odluku suda međutim komentirali su Srđevci. - Trenutak je, da se prisjetimo “onih dosadnih” Srđevaca koji su iz godine u godinu pa tako sedam godina, iz sjednice u sjednicu, pa tako 51 sjednicu, tražili da Gradsko vijeće utvrdi i potvrdi da je ugovor o koncesiji Tvrđave Imperijal s tvrtkom Golf razvojem raskinut – napisali su na društvenim mrežama.

Podsjetio je na to i Đuro Capor, vijećnik u Gradskom vijeću koji ističe kako je sudska potvrda raskida ugovora o koncesiji ujedno i potvrda svega onoga što su vijećnici Srđ je Grad tvrdili uporno na sjednicama Gradskog vijeća, a kada su i predstavnici i aktualne i prošle gradske vlasti bili protiv toga raskida.

– Sjetimo se kako je gospodin Franković vikao da je on za golf, ili kako gospodin Potrebica kaže da je gledao u pod svaki puta kada bi se na jednoj od tih pedeset sjednica Srđevci predlagali ugovorni raskid koncesijskog sporazuma. Trebalo im je sedam godina da progledaju. S druge strane ovo je pobjeda svih građana koji su izašli na referendum ili su volontirali na našem lokalnom referendumu i time jasno pokazali da nekakvi mešetari zemljištem ne mogu raditi što ih je volja u ovom gradu iako ih je i tadašnja i sadašnja gradska vlast uvjeravala da mogu – kaže Đuro Capor.

Zbog nekretnina na Srđu podsjetimo, vode se i dva arbitražna postupka pri Međunarodnom sudu za rješavanje ulagačkih sporova sa sjedištem u Washingtonu, a koji su pokrenule tvrtke Razvoj Golf d.o.o i Elitech kao osnivač društva i investitor u izgradnju na Srđu. I vlasnik tvrtke Razvoj Golf Aaron Frenkel kao privatna osoba je podnio arbitražni zahtjev protiv Republike Hrvatske za odštetu zbog nerealiziranog projekta. Evo što o tome kaže Capor.

- U prvom sporu stojimo dobro jer kakva god bila presuda ne smije o je provesti, jer je ta vrsta sporazuma u kojima je Hrvatska i nadalje nažalost prisutna, suprotna europskoj pravnoj stečevini. Znajući da će Hrvatska odbiti provesti presudu kakva god bila, A. Frenkel je kao državljanin Izraela s kojom Hrvatska također ima potpisan sličan sporazum o zaštiti ulaganja, tužio kao građanin i to je sada isti postupak s istom dokumentacijom i argumentima i on je tek u ranoj procesnoj fazi. Kako Izrael nije član EU neizvjesno je kakva će biti presuda i što će biti u slučaju da presudom ne budemo zadovoljni, hoće li se provoditi – govori Capor.

Prema ranijim medijskim objavama tužba A. Frenkela zbog toga što godinama i uloženih 130 milijuna eura nije uspio pokrenuti projekt na Srđu procjenjuje se na 500 milijuna eura

Tvrtka Razvoj Golf mora odmah vratiti Gradu tvrđavu Imperijal na Srđu – odredio je Općinski sud u Dubrovniku rješenjem od 25. veljače.

Podsjetimo Grad Dubrovnik je nakon prekida ugovora o koncesiji na tvrđavi s Razvoj Golfom zatražio povrat nekretnine mirnim putem, no kako se to nije dogodilo pokrenut je i ovršni postupak. Iz gradske su uprave priopćili kako su donošenjem rješenja o ovrsi zaštićeni interesi Grada te otvoren put prema obnovi i rekonstrukciji tvrđave na Srđu.

Protiv ovog rješenja moguće je izjaviti žalbu nadležnom tijelu u roku od 8 dana, a hoće li to učiniti, danas nisu htjeli komentirati iz tvrtke razvoj Golf.

- Dok ne dobijemo rješenje suda ne možemo komentirati neke sudske informacije koje dobivamo putem priopćenja od strane Grada Dubrovnika. Dok službeno nešto ne zaprimimo nećemo se ni službeno očitovati niti davati izjave – rekao je Ivan Kusalić pravni zastupnik tvrtke Razvoj Golf.

Odluku suda međutim komentirali su Srđevci. - Trenutak je, da se prisjetimo “onih dosadnih” Srđevaca koji su iz godine u godinu pa tako sedam godina, iz sjednice u sjednicu, pa tako 51 sjednicu, tražili da Gradsko vijeće utvrdi i potvrdi da je ugovor o koncesiji Tvrđave Imperijal s tvrtkom Golf razvojem raskinut – napisali su na društvenim mrežama.

Podsjetio je na to i Đuro Capor, vijećnik u Gradskom vijeću koji ističe kako je sudska potvrda raskida ugovora o koncesiji ujedno i potvrda svega onoga što su vijećnici Srđ je Grad tvrdili uporno na sjednicama Gradskog vijeća, a kada su i predstavnici i aktualne i prošle gradske vlasti bili protiv toga raskida.

– Sjetimo se kako je gospodin Franković vikao da je on za golf, ili kako gospodin Potrebica kaže da je gledao u pod svaki puta kada bi se na jednoj od tih pedeset sjednica Srđevci predlagali ugovorni raskid koncesijskog sporazuma. Trebalo im je sedam godina da progledaju. S druge strane ovo je pobjeda svih građana koji su izašli na referendum ili su volontirali na našem lokalnom referendumu i time jasno pokazali da nekakvi mešetari zemljištem ne mogu raditi što ih je volja u ovom gradu iako ih je i tadašnja i sadašnja gradska vlast uvjeravala da mogu – kaže Đuro Capor.

Zbog nekretnina na Srđu podsjetimo, vode se i dva arbitražna postupka pri Međunarodnom sudu za rješavanje ulagačkih sporova sa sjedištem u Washingtonu, a koji su pokrenule tvrtke Razvoj Golf d.o.o i Elitech kao osnivač društva i investitor u izgradnju na Srđu. I vlasnik tvrtke Razvoj Golf Aaron Frenkel kao privatna osoba je podnio arbitražni zahtjev protiv Republike Hrvatske za odštetu zbog nerealiziranog projekta. Evo što o tome kaže Capor.

- U prvom sporu stojimo dobro jer kakva god bila presuda ne smije o je provesti, jer je ta vrsta sporazuma u kojima je Hrvatska i nadalje nažalost prisutna, suprotna europskoj pravnoj stečevini. Znajući da će Hrvatska odbiti provesti presudu kakva god bila, A. Frenkel je kao državljanin Izraela s kojom Hrvatska također ima potpisan sličan sporazum o zaštiti ulaganja, tužio kao građanin i to je sada isti postupak s istom dokumentacijom i argumentima i on je tek u ranoj procesnoj fazi. Kako Izrael nije član EU neizvjesno je kakva će biti presuda i što će biti u slučaju da presudom ne budemo zadovoljni, hoće li se provoditi – govori Capor.

Prema ranijim medijskim objavama tužba A. Frenkela zbog toga što godinama i uloženih 130 milijuna eura nije uspio pokrenuti projekt na Srđu procjenjuje se na 500 milijuna eura
