Ustavni sud RH ukinuo je presudu Županijskog suda u Zadru i vratio na početak postupak u kojem se bivši zatvorenik G.B. žalio na uvjete vezane uz osobni prostor, higijenske i sanitarne uvjete u Centru za dijagnostiku i Zatvoru u Zagrebu, piše Slobodna Dalmacija.

Županijski sud u Zadru u cijelosti je, naime, prethodno potvrdio presudu Općinskog građanskog suda u Zagrebu koji je odbio tužbeni zahtjev G.B.- a. Bivši zatvorenik tražio je da mu država zbog uvjeta u kojima je bio lišen slobode s osnove naknade neimovinske štete isplati iznos od 30.400 i trošak parničnog postupka u iznosu od 5.250,00 kuna.

U tužbi je naveo da su uvjeti boravka u Zatvoru u Zagrebu bili neadekvatni zbog prenapučenosti ćelija, kao i zbog neodgovarajućih sanitarnih i higijenskih uvjeta, loše prehrane i loše medicinske skrbi.

Boravio je u sobama koje ne zadovoljavaju kriterij od tri m2 po osobi. U takvim je ćelijama u kojima se nalazi i sanitarni čvor bez ventilacije boravio 22 sata u nedostatku prirodnog svjetla u i dodatne ventilacije.

U istoj se sobi posluživala hrana, dok se stol za objedovanje nalazio metar udaljen od sanitarnog čvora. Osporavao je i kvalitetu i dostupnost zdravstvene zaštite, tvrdeći da je rijetko mogao doći do liječnika, dok je u sobi boravio s osobama koje su bile zaražene raznim zaraznim bolestima.

U konačnici prigovarao je i da su mu kontakti s osobama izvan zatvora bili znatno otežani.

U prenapučenom prostoru boravio je 11 mjeseci i osam dana. U Centru za dijagnostiku gdje je bio je od 11. svibnja 2012. do 8. lipnja 2012. godine i u Zatvoru u Zagrebu od 8. lipnja 2012. do 19. travnja 2013. godine bio je smješten u sobama s manje od tri m2 prostora po zatvoreniku.

Ustavni sud je u svom rješenju ponovio kako se površina prostorije koja je manja od 3 m2 osobnog prostora po zatvoreniku smatra nedostatkom osobnog prostora koja ima za posljedicu čvrstu pretpostavku povrede članka 3. Konvencije, prema kojem se nitko ne smije podvrgnuti mučenju, ni nečovječnom ili ponižavajućem postupanju ili kazni.

Ustavni sud je primijetio da se G.B. nije pozvao na svoje konkretno zdravstveno stanje koje bi mu bilo narušeno zbog neprimjerene zdravstvene skrbi tijekom boravka u zatvoru, te da prigovor koji se tiče organizacije posjeta u zatvoru nije konkretizirao pozivajući se na neki određeni događaj tijekom posjeta njemu u Zatvoru u Zagrebu. Naveo je općenitu tvrdnju da posjeti zatvorenicima nisu adekvatno organizirani, jer nije osigurana privatnost razgovora. Slijedom toga Ustavni sud RH ocijenio je neosnovanim njegove prigovore vezane uz organizaciju posjeta i zaštitu zdravlja za vrijeme boravka podnositelja u Zatvoru u Zagrebu.

Ustavni sud RH ukinuo je presudu Županijskog suda u Zadru i vratio na početak postupak u kojem se bivši zatvorenik G.B. žalio na uvjete vezane uz osobni prostor, higijenske i sanitarne uvjete u Centru za dijagnostiku i Zatvoru u Zagrebu, piše Slobodna Dalmacija.

Županijski sud u Zadru u cijelosti je, naime, prethodno potvrdio presudu Općinskog građanskog suda u Zagrebu koji je odbio tužbeni zahtjev G.B.- a. Bivši zatvorenik tražio je da mu država zbog uvjeta u kojima je bio lišen slobode s osnove naknade neimovinske štete isplati iznos od 30.400 i trošak parničnog postupka u iznosu od 5.250,00 kuna.

U tužbi je naveo da su uvjeti boravka u Zatvoru u Zagrebu bili neadekvatni zbog prenapučenosti ćelija, kao i zbog neodgovarajućih sanitarnih i higijenskih uvjeta, loše prehrane i loše medicinske skrbi.

Boravio je u sobama koje ne zadovoljavaju kriterij od tri m2 po osobi. U takvim je ćelijama u kojima se nalazi i sanitarni čvor bez ventilacije boravio 22 sata u nedostatku prirodnog svjetla u i dodatne ventilacije.

U istoj se sobi posluživala hrana, dok se stol za objedovanje nalazio metar udaljen od sanitarnog čvora. Osporavao je i kvalitetu i dostupnost zdravstvene zaštite, tvrdeći da je rijetko mogao doći do liječnika, dok je u sobi boravio s osobama koje su bile zaražene raznim zaraznim bolestima.

U konačnici prigovarao je i da su mu kontakti s osobama izvan zatvora bili znatno otežani.

U prenapučenom prostoru boravio je 11 mjeseci i osam dana. U Centru za dijagnostiku gdje je bio je od 11. svibnja 2012. do 8. lipnja 2012. godine i u Zatvoru u Zagrebu od 8. lipnja 2012. do 19. travnja 2013. godine bio je smješten u sobama s manje od tri m2 prostora po zatvoreniku.

Ustavni sud je u svom rješenju ponovio kako se površina prostorije koja je manja od 3 m2 osobnog prostora po zatvoreniku smatra nedostatkom osobnog prostora koja ima za posljedicu čvrstu pretpostavku povrede članka 3. Konvencije, prema kojem se nitko ne smije podvrgnuti mučenju, ni nečovječnom ili ponižavajućem postupanju ili kazni.

Ustavni sud je primijetio da se G.B. nije pozvao na svoje konkretno zdravstveno stanje koje bi mu bilo narušeno zbog neprimjerene zdravstvene skrbi tijekom boravka u zatvoru, te da prigovor koji se tiče organizacije posjeta u zatvoru nije konkretizirao pozivajući se na neki određeni događaj tijekom posjeta njemu u Zatvoru u Zagrebu. Naveo je općenitu tvrdnju da posjeti zatvorenicima nisu adekvatno organizirani, jer nije osigurana privatnost razgovora. Slijedom toga Ustavni sud RH ocijenio je neosnovanim njegove prigovore vezane uz organizaciju posjeta i zaštitu zdravlja za vrijeme boravka podnositelja u Zatvoru u Zagrebu.
